Based on the Constitution

As approved by the People's Assembly at its meeting held at the date of 17.3-1423 A.H., 28-5-2002,

The following are issued:

Article 1

Amend article V of the Legislative Decree No. 5 of 1982 Rate and become as follows:

-Article 5.

A. 1. The President of the Board presents the draft general organizational chart, the detailed organizational chart and the building system to the Board for consideration and approval for the announcement at the first meeting of the Board.

2. The Council shall declare the draft general organizational chart, detailed organizational chart and construction system within one month from the date of its submission to the Council at its first meeting and in the event that it does not agree to the Declaration, it shall, during that time, establish its observations to be presented to the Regional Technical Committee in the present report. The county concerned for the determination of these observations. Otherwise, the capital master plan and the President of the Council shall declare its declaration.

3. The topics endorsed by the Regional Technical Committee, which were seen by a member of the Committee as a violation of the foundations of urban planning and schematic programme, were presented to the Minister of Housing and Facilities to decide on the issue of disagreement during the 30/day period from the date of registration in the Ministry of the Ministry. Otherwise, it would be considered headquarters and binding. All stakeholders and the President of the Council must declare it.

b. The draft general organizational chart, the detailed organizational chart, the construction system and its amendments are announced in the lobby of the administrative entity and are alleged to be related to the project announced for personal notification or a declaration to be published in two local newspapers or one of the capital's most widespread newspapers Official audio and visual media may be used in accordance with the value of the administrative body.

c. The draft schemes and building regulations referred to in the preceding paragraph may be objected to during the 30/day period of the date of the announcement or notification and the objection shall be called upon to the administrative entity in which the objection shall reflect its observations.

The administrative body shall prepare the press and transmit it to the Directorate of Technical Services for submission to the Regional Technical Committee for a period of no more than 60 days from the date of expiry of the declaration.

d. The Directorate of Technical Services should scrutinize the documents of the press and present them to the regional technical committee after making sure that they are ready for submission within a month from the date of transmission of the press to them.

e. Consider the objections of a regional technical committee formed by the Governor, Chair of the Executive Office, as chair and membership:

1. Member of the competent Executive Office.
2. Director of Technical Services.
3. Archaeology director of the county.
4. Responsible for urban planning in the Directorate of Technical Services.
5. Two engineers with expertise in city planning are designated by the Minister of Housing and Facilities.
6. An engineer with expertise in city planning and a real estate expert from jurists nominated by the Governor.
7. Head of the competent administrative entity.

The Governor shall invite a representative of each of the following:

The General Federation of Peasants, the General Union for Residential Cooperation, the Union of Artisans, the Union of Engineers, the Ministry of Defense, the Ministry of Communications, the Ministry of Irrigation and the Ministry of Tourism, when any of them have to do with the objections presented. When invited to the Committee, the representative of these bodies shall be considered a member of the Committee and has the right to vote

f. To attend the meeting of the Committee responsible for technical affairs in the competent administrative body without the right to vote, and the meeting of the Committee is valid only in the presence of its President and the engineers of the Ministry of Housing and Utilities and more than half of the members, and the decision shall be taken by most votes and the Committee shall be sent in this case. The results of its study and recommendations to the competent reference for the proposal or promulgation of the draft declared under article VI of Legislative Decree No. 5 of the amended 1982.

g. The issues endorsed by the Regional Technical Committee, which are seen by a member of the Committee as a violation of the foundations of urban planning and schematic programme, are presented to the Minister of Housing and Facilities. The Minister decides on the issue of disagreement within 30/day of the date of registration of the record in the Ministry of the Ministry, accompanied by the plan. The Committee is before the Committee and reports the Minister's decision to the Regional Technical Committee for adoption.

Article 2

Article 7/of Legislative Decree No. 5/of Amended 1982 is amended and becomes the following form:

Article 7. The Ministry of Housing and Facilities is informed about the decision of the Office or the Damascus Governorate Council to annex the general organizational plan, the detailed organizational chart, the construction system or its amendment issued under it during the 15-day period from the date of the decision to preserve it, and the Ministry does not have the right to object to Any of the amendments based on the Regional Technical Committee.

Article 3

Add Article 10 to Legislative Decree No. 5 of Amended 1982, which reads as follows:

Article 10

1. The Minister of Housing and Utilities has assigned employees in the Ministry and abroad to work by laying the foundations for urban planning, studying and scrutinING planning programs, regulations and building systems within and outside the official system and granting them compensation and rewards in accordance with the laws and regulations in force.
2. The governor of the bureau may assign state workers to study the organizational charts with construction systems and grant them incentive rewards in accordance with the laws and regulations in force.
3. The administrative body may, with the approval of the Governor, the head of the bureau, contract with any one to carry out the study of the regulatory schemes and their implementation on nature and the establishment of construction systems.
4. The regional technical committee provided for in article 5 of the Legislative Decree No. 5 of 1982, amended by this Act and its decision, shall be awarded compensation by decision of the Governor and in accordance with the laws and regulations in force.
5. The remuneration, compensation and all expenditures stated in paragraphs (b-c-d) of the provisions of the relevant administrative entity shall be acted upon.
