Law 41 of 2004 determining the border areas the President on the Constitution and approved by the Assembly in its meeting dated 4 -9-1425 and 18-10-2004.
Issued: article 1 (amended by Decree 49 of 2008) shall not create or move or modify or acquire any right in rem mortgage on land located in a border area or distracting her by renting or investing in any way or for more than three years for the name or for the benefit of the natural or legal person except with prior authorization.
Article 2 defines the border areas by decree upon the proposal of the Ministry of defence.
Article 3-the licence provided for in article 1 of this law by the Minister of the Interior or his representative on the proposal of the Ministry of agriculture and agrarian reform and the approval of the Ministry of defence.
B-Interior Minister refused to cut licensing does not accept any way of review methods redial may, however if the demise of license or cause the expiration of one year from the date of rejection.
Article 4 (amended by Decree 49 of 2008) implement decisions of the courts and judges of land located in real estate border areas after associating with the mentioned license.
Article 5 (amended by Decree 49 of 2008) under forced expropriation of land transactions located in border areas by execution departments of the Ministry of Justice said license auction in the absence of the last almzaod this license supersedes and peremptory land put referral again for sale at auction.
Article 6 (amended by Decree 49 of 2008) in the absence of a licence application within three months from the date of the succession of the right kind of real estate on the land in a border area or the date of the job by renting or investing or in any manner whatsoever for over three years is considered void works.
Article 7 (amended by Decree 49 of 2008)-in case of works the land in a border area by renting or investing or in any way for not more than three years must occupy the land in question notifying the competent administrative authority on the ground within the time limit specified in article 6 of this law.
B-real estate acquisition is not subject to rights in rem over land in a border area or occupancy rights by inheritance or go only to the competent administrative authority notification requirement stipulated in the preceding paragraph.
C-the use of farmers or workers or experts in cases covered by this law, notify the competent administrative authority on everything related to their use in accordance with the procedures contained in the regulations.
Article 8-real circuits and refrain from book fair transactions covered by the provisions of this law unless combined with prior authorization or inform the competent administrative authority is required, as the case may be.
B other contracts are void, behaviours and actions which are contrary to the provisions of this law or in the name of someone who borrowed in order to get rid of it is void of all subsidiary conditions intended to ensure its implementation.
C-the public prosecutor the necessary proceedings to revoke contracts and behaviours and actions contrary to the provisions of this law and to follow up the implementation of judgments.
Article 9-is punishable by imprisonment from six months to two years and a fine from ten thousand to hundred thousand SP SP contravenes the provisions of article 1, paragraph a of article 8 of this law.
B-punished with imprisonment from three months to one year and a fine of three thousand pounds to ten thousand SP contravenes the provisions of paragraphs a and c of article 7 of this law. And is punishable by a fine of three thousand pounds to ten thousand lire contravenes the provisions of paragraph b of article 7 of this law.
Article 10 (amended by Decree 49 of 2008) the provisions of this Act do not apply in the following cases: a the devolution of the right kind of real estate or renting or investing for the benefit of the public.
B-the land within the boundaries of the administrative units certification regulatory schemes or urban domain. x
C-transactions excretion, competence and Division and correct descriptions.
Article 11 the Minister of Interior regulations for this Act.
Article 21 repeals decrees Nos 3-4-1952 date and number 193 75 28-7 -1962 date.
Article 13 of this law shall be published in the Official Gazette.
