Law of the General Organization of Forensic Medicine

President

Based on the Constitution

As approved by the People's Assembly at its meeting held in the history of 3-3-1436 A.H., it was approved for 27,10-2014.

The following are issued:


Article 1

The following expression shall mean the meaning given to each of them in the application of the provisions of this Law :

Authority: General Body of Forensic Medicine .

Board: Board of directors of the General Board of Forensic Medicine .

President of the Board: Chairman of the Board of the General Board of Forensic Medicine .

Director: He is the Director General of the General Authority of Forensic Medicine .

Medical examiner: Doctor who has jurisdiction in forensics, forensic dentistry or legal poisons registered with the Ministry of Health and approved by the Authority. .

Section: Branch of the General Authority for Forensic Medicine, comprising more than one centre .

Center: The Forensic Medical Center accredited by the Authority, which provides forensic and criminal services to public and private bodies that require forensic, criminal and scientific expertise to perform their missions. .

Legitimacy Medical Point: One of the public or private forensic points accredited by FDA and licensed assets according to the laws in force .

Clinic: one of the public or private forensic clinics .

Forensic and criminal services: use of the necessary legal and forensic tools, tools and techniques to assist public or private actors in accordance with the executive regulation established by the Authority .
Forensic Medical Report: The report issued by the competent central union accredited by the authority and edited by the medical examiner for forensic medical expertise in all terms of reference. .

Article 2

a. Under this Act, a health scientific authority called the "Public Authority for Forensic Medicine" ??? Its headquarters is Damascus, which has legal personality, financial and administrative independence and is associated with the Prime Minister. .

b. Children, centres, points and medical clinics of the Authority may be established by decision of the Board .

Article 3

a. The Authority shall have its own budget issued by a decision of the Prime Minister on the proposal of the Director General relating to the general budget of the State. .

b. The Authority's income consists of the following sources :

1. State aid to the State budget .

2. Forensic nature .

3. Donations, wills and donations in accordance with laws and regulations in force .

4. Other resources permitted by laws and regulations in force .

Article 4

a. The Authority aims to implement the National Forensic Policy and to provide and coordinate forensic, criminal, scientific, research and training services .

b. To achieve its objectives, the Authority has to do the following. :

1. Development of forensic foundations and regulations and proposal of draft laws on forensic forensics in coordination with the competent authorities .

2. Release of regulations relating to the work of UN-Women on the proposal of the Governing Council .

3. Examination of reports and models in systems related to forensics .

4. Supervision of the work of forensic doctors .

5. Provision of advice, information and data on forensic medicine, production of evidence and guidance for scientific research in legal branches, centres, medical points and clinics .

6. Adoption of the rules of procedure and manual procedures for working in forensics and forensic medical reporting forms required for forensic work in coordination with the relevant trade unions .

7. Preparation of draft conventions on forensic medicine .

8. Holding seminars and conferences in coordination with relevant trade unions and organizing exchanges of visits and meetings related to forensics and criminal science .

9. To approve compensation and incentives for forensic physicians in proportion to the degree of scientific degree and work carried out by the medical examiner in accordance with the provisions of the laws and regulations in force .

10. Securing the independence of legal doctors and providing legal protection .

11. To adopt the names of forensic doctors and experts from various other disciplines and technicians in coordination with the Ministry of Justice and the competent authorities .

12. To set standards for the accreditation of physicians from various other disciplines with legitimate medical expertise in coordination with the competent central union .

13. Accreditation of forensic doctors to participate in the identification of medical responsibility committees .

14. To nominate forensic doctors when required to participate in committees on work injuries, traffic accidents, occupational diseases, organ transplants, transplants, insurance companies, committees, bodies, departments, departments, directorates and other public bodies that are relevant to the work of forensics .

Article 5

The Board is administered by the Board and the Director .

a. The Council shall constitute by decision of the President of the Council of Ministers as follows: :

b. Called the Director by decision of the Prime Minister at least by a legal medical consultant .

c. The Director shall be appointed by a decision of the Prime Minister upon the proposal of the Director-General .

d. Designed the Director ??? After Council Approval ??? The heads of the branches of Obercz or the forensic points of the body's staff are among the legal doctors at least in the first place. .

e. The remuneration of the President and members of the Council shall be determined by decision of the Prime Minister .

The Council meets at the invitation of its President at least every two months and whenever necessary, and whenever necessary, the meeting is legal in the presence of the absolute majority, including the President or the Vice-President of the Council, and decisions are made in the absolute majority to attend and on equal terms the meeting will likely be made by the President of the session. .

The President of the Council shall have the right to invite those who see it appropriate to attend the meetings of the Council without the right to vote .

h. Rules of procedure governing the organization of work, meetings and other matters relating to the Board shall be determined by the rules of procedure of the Board .

i. The Council has the right to form committees that it deems necessary to assist it in carrying out its tasks .

Article 7

The board of directors takes the following :

  1. Development of UN-Women plans and programmes of activity under the overall State plan .
  2. Development of policies, health and training plans and scientific research plans related to the work of the Entity .
  3. The establishment of branches, centres, points and medical clinics in all governorates .
  4. Adoption of the draft budget and annual report of the Board .
  5. Acceptance of donations, donations and trusteeship under the provisions of laws and regulations in force .
  6. Delegate the Director with some Council privileges .
  7. Identification of service allowance provided by UN-Women .
  8. Dispatch of staff in the body internally and externally in accordance with the provisions of laws and regulations in force .
  9. Contract with Arab and foreign experts and Syrians with medical and health professional, technical, administrative and service professionals within the overall framework of the body's plan in accordance with the provisions of the laws in force. .
  10. Coordination with the administration of State cases to institute proceedings in the name of the Authority, waiver, release, drop and arbitration in accordance with the laws and regulations in force .

Article 8

The director exercises the following missions :

  1. Representation of the body before the judiciary and not taking into account the provisions of paragraph (j) of article/7/7 of this Law.
  2. The manager is the order of exchange and is determined alimony and liquidation.
  3. Adoption of the agenda of meetings of the Council, attendance at meetings and supervision of the organization of records of meetings.
  4. Implementation of decisions of the Board and the Board.
  5. Supervision of the employees of the body and administrative, financial and technical affairs.
  6. To propose programmes and plans for the Board to carry out its tasks and make recommendations thereon to the Council and to follow up on its implementation after its approval in coordination with the competent authorities.
  7. Follow up on the implementation of programmes and plans and turn them into effective action once they have been approved and approved.
  8. Preparation of the draft annual budget of the Authority in coordination with the competent financial services.
  9. Preparation of the annual report on the activities of the Board for the financial year ended and submitted to the Board for approval.
  10. Appointment, promotion, transfer and reassignment of workers in accordance with the provisions of the laws and regulations in force.
  11. Other tasks assigned to it by the Board.

Article 9

The Prime Minister shall issue the rules of procedure upon the proposal of the Council .

Article 10

a. The Authority shall provide forensic services in branches, centres, points and forensic medical clinics for remuneration in accordance with the identification issued by a decision of the Council in coordination with the competent authorities. .

b. The Ministry of Justice will pay a forensic pathology in cases where the victim does not have the necessary money on the proposal of the competent judge. .

Article 11

a. To be issued by a decision of the Prime Minister on the proposal of the Council and in coordination with the Minister of Finance, a special incentive system for workers in the Authority in accordance with the provisions of laws and regulations in force .

b. Some professional and professional positions may be occupied by contracting in accordance with the provisions of the laws and regulations in force .

Article 12

The forensic doctors are classified according to the classification adopted by the Ministry of Health. .

Article 13

Taking into account the provisions contained in this law, the legal doctors are considered to be the assistant attorney general in the exercise of their work. .

Article 14

The owners of the body include all forensic medical personnel, health practitioners, technical assistants, nurses and health administrators. .

Article 15

Staffing is issued by decree .

Article 16

This law is published in the Official Journal and is in effect three months after the date of its promulgation. .
