Organization of the work of nurseries

President

On the basis of the provisions of the Constitution, and as adopted by the People's Assembly at its meeting held on 25/5/1436 A.H., 15/03/2015, The following are issued:

Chapter I

Article 1

The expressions contained in the application of the provisions of this Law shall mean what is stated next to each of them:

- Ministry of Social Affairs

- Minister: Minister of Social Affairs.

- Directorate: Directorate of Social Affairs in the Governorate

- Director: Director of Social Affairs in the prefecture.

- Nursery house: a social educational house that embraces children under the age of three.

- Main Committee: Committee on Nursery in the Ministry.

- Subcommittee: Kindergarten Committee of the Directorate.

- The owner of the license: the natural or legal person whose name was issued by the nursery.

- A person shall be considered as such by virtue of the provisions of article 54 of the Civil Code.

Chapter II

Objectives of the nurseries

Article 2

The role of nurseries is to:

a. Take care of children under three years of age and create appropriate conditions for their development so that they develop normal and healthy development in all social, moral, educational, psychological, physical, linguistic and health aspects.

b. Work to develop their talents and abilities in line with the goals of public education.

c. Work to spread the culture of childhood among children's families to this stage and its requirements and needs.

Dr. To create an appropriate climate for children to identify themselves and to meet their different needs according to their psychological, developmental, mental and social characteristics.

e. Personalize the abilities of the child and his queens by giving him a lot of love, encouragement and reassurance.

And. Raising a child is a social upbringing that adopts modern breeding methods and the development of its senses and management with its peers.

Article 3

The nurseries work in programmes and activities designed to this end in accordance with the educational standards adopted by the Ministry and relevant stakeholders.

Chapter III

License

Article 4

Require license student:

a. Natural person:

1. to be Syrian Arabs or those in their judgment.

2. Not guilty of a felony or misdemeanor offence.

3. A recognized university degree holder or a certified assistant is a "average institute certificate".

4. Free from communicable and communicable diseases.

5. Not a factor in the state.

b. Consideration person:

1. The statute must provide for the licence or decision to be authorized by the children's nursery.

2. The legal person is obliged to name a representative for the management of the nursery where the conditions set forth in paragraph (a) of this article are available.

3. The representative of the public is excluded from the requirement set out in section 5, paragraph (a), of this article.

Article 5

The license requester must do the following obligations:

a. Provide general conditions and specifications for the construction, health and public safety requirements specified in the Executive Instructions for this Law.

b. Supervision of the implementation of the children's food programme.

c. Develop the rules of procedure for working in the nursery according to the model adopted by the Ministry.

Dr. A sum of 100000 thousand Syrian pounds is paid for once.

e. An annual payment of 10,000 Syrian pounds.

And. The amounts in paragraphs (d, e) of this article shall be deposited in a special account of a bank adopted on behalf of the Directorate for the exclusive role of the nursery and determines the cases and the exchange of it by decision of the Minister upon the proposal of the Main Committee.

Article 6

The applicant shall submit a request to the subcommission in accordance with the form adopted by the Ministry.

Article 7

The authorization shall be issued by the Minister upon the proposal of the Main Committee.

Article 8

By decision of Minister V, the license holder may propose to the Main Committee the opening of a branch in the governorate where the nursery has been licensed or the opening of branches in the other governorates provided that it meets all the requirements set out in this law.

Article 9

The license student must be fully dedicated to the administration of the house or to be designated as a manager for managing the house where the conditions set out in this law are available.

Chapter IV

Clearance and Canceled Cases

Article 10

The license may be transferred upon the proposal of the Main Committee in the following cases:

a. The license holder shall waive the custody of the custody house in all its material and moral custody to others where the conditions contained in this law are available by decision of the Minister.

b. In the event that the licence holder loses one of the conditions set out in this Act, the licence may be transferred to those who do not meet these conditions by decision of the Minister.

c. Subject to the provisions of this Act, in the event of death of the licence holder:

1. Transfer of the license to one of the heirs by decision of the Minister after the approval of the heirs or guardians within six months of the date of death.

2. If one of the heirs does not have the conditions set out in this Act on the date of death of the licence holder, the licence lasts for six months from the date of death and the heirs within the period mentioned for the designation of a manager on behalf of them in the administration of the nursery or the transfer of the licence to those who do not meet the stipulated conditions. They must be approved by heirs or guardians by decision of the Minister.

3. If heirs or guardians fail to name a manager or transfer the license to others within six months of the date of death, the nursery shall be placed under the interim supervision of the Directorate in accordance with the provisions of this law and its executive instructions and delegate to the Directorate for the designation of a manager to conduct business. The nursery is until the heirs settle their situation no later than six months under the penalty that the license is cancelled by the minister's decision.

Article 11

The permit shall be revoked by decision of the Minister and the Nursery shall be placed under temporary supervision in accordance with the provisions of this Law in the following cases:

a. At the request of the licence holder and the Minister's approval.

b. In case the licence holder has lost one of the conditions set out in this Act.

c. The removal of the legal personality of the person of the licence holder.

Chapter V

Main Committee for Nursery

Article 12

a. In the ministry, a committee called "Main Committee for Nursery Role" is issued by a minister headed by a minister and a representative of each of the following: "Ministry of Education", "Ministry of Health", Ministry of Labour, "Ministry of Labor", "Union of General Women's Union", "Union of Trade Unions".

b. The Committee is making use of who it deems appropriate.

c. The Committee shall meet at the invitation of its Chairman once every three months and whenever the need arises and the meetings are legal in the presence of the majority of the members, and the decisions shall be issued unanimously or by majority and in the event that the votes are equal to the likely side of the Chairman of the Committee.

Dr. The Secretary of the Committee is called from a staff member of the Ministry with a decision issued by the Minister to prepare for the meetings of the Committee, organize its agendas, record the records of its meetings, follow up on the implementation of its recommendations and maintain its restrictions and records.

Article 13

The Main Committee shall assume the following functions and powers:

a. Draw up the strategy, develop programmes and special plans for nurseries so as to ensure that the work of this role is promoted in all respects and that its performance is raised in favour of this age at children.

b. To study and address all books and reports submitted to them by sub-committees in the provinces.

c. To study complaints, objections and irregularities relating to the role of custody and to raise the necessary proposals to the Minister for decision.

Dr. Develop a regulation for nurseries.

e. Examination of applications for granting consent to installment of financial fines specified in article 17 of this Law and submit their proposals to the Minister for decision.

And. To consider and decide on the procedures and fines proposed by the Subcommittee on the right of owners of nurseries.

g. Study and process all that is transmitted to it by the Minister.

Chapter VI

Nursery Subcommittee

Article 14

a. In each governorate, it is formed by a decision of the governor headed by the director and a representative from each of the following: "The governorate", "Department of Health", "Directorate of Health", "Directorate of Labor", "Women's Union", "representative of the trade union federation."

b. The Committee is making use of who it deems appropriate.

c. The Committee shall meet at the invitation of its Chairperson every two months and whenever the need arises, the meetings shall be legal in the presence of the majority of the members and its decisions shall be issued unanimously or in the majority, and in the case of equality of votes, the Chairman of the Committee will be likely to be the same.

Dr. The Director shall designate a staff member of the Directorate as Secretary of the Committee to prepare for its meetings, organize its agendas, record the minutes of its meetings, follow up on the implementation of its recommendations and maintain its restrictions and records.

Article 15

The Subcommittee shall perform the following functions:

a. License and field disclosure requests are received on the premises to be licensed for incubation in order to ensure that the conditions specified in the Executive Instructions for this Law are met.

b. Prepare the necessary draft resolution and submit it to the Main Committee for its consideration.

c. Examination of applications for waiver of licence, applications for revocation of licences, transfer of licensed nurseries and referral to the Main Committee for consideration.

Dr. Supervision of nurseries and conducting field and periodic inspection tours.

e. :: Reports of violations of the role of kindergartens and the proposal of action to be taken against their owners to the Main Committee

And. Report on the work of kindergartens to the Main Committee of the Ministry, which is being examined and duly processed.

Article 16

Members of the Main Committee, subcommittees and trustees shall receive compensation to be determined by decision of the Prime Minister upon the proposal of the Minister.

Chapter VII

Procedures and fines

Rule 17

The owner of the nursery is charged with a decision by the minister, as follows:

a. Alarm: The owner of the house is required to remove and remedy the violation within one month of the date of the warning under penalty of imposing a fine in the event of repetition of at least 100,000 Syrian pounds and no more than 20,000 Syrian pounds in the following cases.

1. contravention of the rules of procedure of the nursery.

2. Failure to take into account the separation of children by age.

3. Reception of children over the age of three years.

b. A fine of not less than 100000 L.S. 100,000 Syrian pounds and no more than 200,000 thousand Syrian pounds if any of the following offences are committed:

1. Excexceeds the absorptive capacity of the descriptive people specified by the license decision.

2. contravention of the provisions set forth in Article 4 of this Law.

c. A fine of not less than 200,000 to .200 thousand Syrian pounds and no more than 300,000 to .S. 300 thousand Syrian pounds in the two cases:

1. The practice of working without obtaining the necessary license.

2. Opening a branch to the house, expanding its people or moving its licensed headquarters on its basis to another location without obtaining the approval of the Ministry.

Dr. The cancellation of the license in case of repeated violations mentioned above, in addition to closing the open house without a license or an open branch without the Minister's approval.

e. The fines collected as a result of the application of the provisions of paragraphs (a, B, c) of this article shall be transferred to the State treasury.

Chapter VIII

General provisions

Rule 18

The name of the nursery may not be changed or moved to a new building except by decision of the Minister.

Rule 19

All existing nurseries prior to the operation of this law shall comply with their status with the provisions and instructions issued under the Act within one year of the date of its entry into force.

Rule 20

Nursery workers in the private and joint sector are subject to the provisions of the Employment Act No. 17 of 2010 and its amendments.

Rule 21

A decision made in accordance with the provisions of this Law may be appealed against by the administrative courts.

Rule 22

The Minister shall issue executive instructions for the provisions of this Act.

Rule 23

This law is published in the Official Journal.
