DFI Ordinance on the Incentive Scheme for Professional Cultural Actors' Organisations

Stops:

Section 1 Purpose of encouragement

Art. 1

1 The support of professional cultural stakeholder organisations is aimed at encouraging professional associations which are committed to improving the professional framework conditions of their members and represent them vis-à-vis third parties.

Section 2 Sustained areas

Art. 2

1 Contributions are made for the costs of providing the benefits referred to in s. 3, para. 2.

2 Not supported:

A.
Organizations whose objectives are primarily focused on school education, training or science;
B.
Organizations working in the cultural field, but whose activities focus primarily on the promotion and mediation of the work of cultural actors or on the collection and preservation of cultural property.

3 There is no right to support.

Section 3 Conditions of encouragement

Art. 3

1 Organizations must:

A.
Be active nationally within the meaning of s. 6, para. 2, let. D, CEM;
B.
Consist of members from at least three linguistic regions;
C.
Have representatives of at least three linguistic regions in their steering committee;
D.
Be representative of all of the following disciplines: visual arts, Design , cinema, literature, music, dance and theatre;
E.
Have been active continuously for at least three years;
F.
Have a financial position that will ensure the long-term exercise of their activities.

2 They must provide the following benefits:

A.
Inform their members about their professional framework conditions;
B.
Provide their members with a regular personalized advice;
C.
Informing the public and interested parties about the organization's activities;
E.
Represent and safeguard the interests of the Branch at the national and international levels.

2 The Federal Office of Culture (OFC) sets out in a contract for benefits under s. 6, para. 4, the minimum volume of benefits referred to in para. 2.

3 Organizations must have a secretariat accessible at least three working days per week.

Section 4 Criteria for the promotion and calculation of contributions

Art. 4

1 Are decisive for the calculation of contributions to organisations of professional cultural actors:

A.
The minimum amount determined by the OFC for each organization that meets the conditions of encouragement; if, within any of the disciplines referred to in s. 3, para. 1, let. D, several organizations meet these conditions, the FCO shall prorate the minimum amount; an organization may receive a minimum amount only within the entire discipline;
B.
The number of members who are professional cultural actors in accordance with Art. 6, para. 2, of the order of 23 November 2011 on the encouragement of culture 1 ;
C.
The volume of benefits within the meaning of s. 3, para. 2.

2 Financial aid may not exceed 70 % of the costs of the benefits referred to in Art. 3, para. 2.


Section 5 Procedure and other provisions

Art. 5 Procedure

1 The OFC decides on the granting of financial aid.

2 Requests for contributions must be directed to the CFO until October 31 of the year preceding the start of the incentive period. For the period 2016 to 2020, the deadline for filing applications is October 31, 2016.

3 Applications must demonstrate that the conditions for support are met and contain all the necessary indications in relation to the incentive criteria.

4 The OFC enters into a benefit contract with contribution recipients. This contract shall set out in particular the amount of the contribution allocated and the benefits to be provided.

Art. 6 Weight and preference rule

1 Any decision on financial aid shall be based on a weighting of the incentive criteria referred to in Art. 4. Al. 1, let. B and c.

2 If more than one organization meets the requirements in the same field, only financial assistance is provided for members of cultural professionals within the meaning of s. 6, para. 2, of the order of 23 November 2011 on the encouragement of culture 1 .


Art. 7 Expenses

Contribution recipients are required to:

A.
Raise awareness of the support provided by the OFC;
B.
Provide the FCO with all necessary information in relation to the contribution allocated;
C.
Communicate to the OFC without delay any significant change in the organization's activity.
Art. 8 Trade

Once a year, the OFC invites contribution recipients for a state of play and an exchange of views.

Section 6 Final provisions

Art. Transitional provisions

1 The procedures not closed at the time of entry into force of this order shall be governed by the Ordinance of the DFI of 25 November 2015 establishing a scheme to encourage the organisations of professional cultural operators for the year 2016 1 .

2 Organizations that have received contributions for the period 2012 to 2016 and no longer meet the conditions set out in s. 3 may file until October 31, 2016, a single contribution request for the year 2017. The decision to award a contribution is left to the discretion of the OFC, which is determined on the basis of the benefits provided under s. 3, para. 2. Organizations that, by decision of the OFC, have already received a final contribution are not allowed to file an application.

3 If by December 31, 2017 an organization referred to in para. 2 merges with another organization supported by the OFC under this order, the amount of the contribution is recalculated and adjusted as necessary.


Art. 10 Entry into force

This order shall enter into force on 1 Er September 2016.
