For the partial revision of the conventions adopted by the General Conference of the International Labour Organization in its first twenty-eight sessions, with a view to ensuring the future exercise of certain functions of Chancery entrusted by those Conventions to the Secretary-General of the League of Nations and to make further amendments thereto by the dissolution of the League of Nations and by the amendment of the Constitution of the International Labour Organization

The General Conference of the International Labour Organization,

Convened in Montreal by the Governing Council of the International Labour Office, and met on 19 September 1946, at its twenty-ninth session,

Having decided to adopt certain proposals relating to the partial revision of the conventions adopted by the Conference at its twenty-eight first sessions, with a view to ensuring the future exercise of certain Chancery functions entrusted by Such conventions to the Secretary-General of the League of Nations and to make certain additional amendments thereto necessnecessby the dissolution of the League of Nations, and by the amendment of the Constitution of the International Organization of the Work, which is included in the second item on the agenda of the Session,

Considering that these proposals should take the form of an international convention,

Adopts, this ninth day of October, nine hundred and forty-six, the following Convention, to be referred to as the Convention for the Revision of Final Articles, 1946.

Art. 1

1. In the text of the conventions adopted by the International Labour Conference during its first twenty-five sessions, the words "Secretary-General of the League of Nations shall be replaced by the words" Director General of the Bureau ", the words" Secretary-General "by the words" Director General "and the word" Secretariat "by the words" International Labour Office ", in all the passages containing these various expressions.

2. Registration by the Director-General of the International Labour Office of the ratifications of conventions and amendments, of acts of denunciation and of the declarations provided for in the conventions adopted by the Conference during its The first twenty-five sessions shall have the same effect as the registration of such ratifications, the said acts of denunciation and those declarations which would have been made by the Secretary-General of the League of Nations in accordance with the Provisions of the original texts of the said Conventions.

3. The Director-General of the International Labour Office shall communicate to the Secretary-General of the United Nations, for registration in accordance with art. 102 of the United Nations Charter 1 , all information relating to such ratifications and acts of denunciation and declarations, recorded by it in accordance with the provisions of the conventions adopted by the Conference in its first twenty-five sessions, as they are Modified by the preceding provisions of this Article.


Art. 2

1. The words " of the League of Nations shall be deleted in the first preambular paragraph of each of the conventions adopted by the Conference during its first eighteen sessions.

2. The words "in accordance with the provisions of Part XIII of the Treaty of Versailles and the corresponding Parties of the other Treaties of Peace" and the variations thereof, contained in the preambles to the conventions adopted by the Conference at Of its first seventeen sessions, shall be replaced by the words " in accordance with the provisions of the Constitution of the International Labour Organization 1 ".

3. The words "under the conditions laid down in Part XIII of the Treaty of Versailles and the corresponding Parties of the other Treaties of Peace" and any variations thereof shall be replaced in all articles of the conventions adopted by the Conference during its first twenty-five sessions containing such words or variations, by the words " under the conditions established by the Constitution of the International Labour Organization.

4. The words " art. 408 of the Treaty of Versailles and the corresponding articles of the other Peace Treaties " and all variations of this formula are replaced, in all the articles of the conventions adopted by the Conference during its first twenty-five sessions where Are those words or variations, by the words " art. 22 of the Constitution of the International Labour Organization.

5. The words " art. 421 of the Treaty of Versailles and the corresponding articles of the other Peace Treaties " and any variations thereof shall be replaced in all the articles of the conventions adopted by the Conference during its first twenty-five sessions where These words, by the words " art. 35 of the Constitution of the International Labour Organization.

6. The word "convention" is substituted for the words "draft convention" in the preamble to the conventions adopted by the Conference during its first twenty-five sessions and in all articles in which the expression is included.

7. The title of "Director General" shall be substituted for the title "Director" in all articles of the conventions adopted by the Conference at its twenty-eighth session, which shall refer to the Director of the International Labour Office.

8. In any convention adopted by the Conference during its first seventeen sessions, the words "which shall be" shall be inserted in the preamble and followed by the short title used by the International Labour Office to designate the Convention To which it is concerned.

9. In any convention adopted by the Conference during its first fourteen sessions, all unnumbered paragraphs containing more than one paragraph shall be numbered.


Art. 3

Any Member of the Organization which, after the date of entry into force of this Convention, shall communicate to the Director General of the International Labour Office its formal ratification of a convention adopted by the Conference during its Twenty-eight first sessions will be deemed to have ratified this Convention as amended by this Convention.

Art. 4

Two copies of this Convention shall be signed by the President of the Conference and the Director General of the International Labour Office. One of these copies will be deposited in the archives of the International Labour Office, the other in the hands of the Secretary-General of the United Nations for registration in accordance with art. 102 of the United Nations Charter 1 The Director General shall transmit a certified copy of this Convention to each of the Members of the International Labour Organization.


Art. 5

1. The formal ratifications of this Convention shall be communicated to the Director General of the International Labour Office.

2. This Convention shall enter into force on the date on which the ratifications of two Members of the International Labour Organization have been received by the Director General.

3. On the date of entry into force of this Convention and upon the subsequent receipt of further ratifications of this Convention, the Director-General of the International Labour Office shall notify all Members of this The International Labour Organization and the United Nations Secretary-General.

4. Any Member of the Organization ratifying this Convention shall likewise acknowledge the validity of any action taken under this Convention in the interval between the first entry into force of the Convention and the date Of its own ratification.

Art. 6

Upon the initial entry into force of this Convention, the Director-General of the International Labour Office shall make official texts of the conventions adopted by the Conference during its first twenty-eight sessions, such as Have been amended by the provisions of this Convention, in two originals, duly signed by him, one of which shall be deposited in the archives of the International Labour Office and the other in the hands of the Secretary-General of the Nations United Nations for registration in accordance with Art. 102 of the United Nations Charter 1 ; the Director General shall transmit certified copies of these texts to each of the Members of the Organization.


Art. 7

Notwithstanding any provision contained in one of the Conventions adopted by the Conference during its first twenty-eight sessions, the ratification of this Convention by a Member shall not result in the denunciation of a The entry into force of this Convention shall not have the effect of closing any of the said Conventions to further ratifications.

Art. 8

1. In the event that the Conference adopts a new convention for the total or partial revision of this Convention and unless the new Convention provides otherwise:

(a)
Ratification by a Member of the new Convention would result in the full termination of this Convention, provided that the new Convention for revision entered into force;
(b)
From the date of entry into force of the new Convention for revision, this Convention shall cease to be open for ratification by Members.

(2) This Convention shall in any case remain in force in its form and content for Members who have ratified it and which do not ratify the Convention for revision.
