The Federal Department for Foreign Affairs presents its compliments to the Embassy of the Principality of Liechtenstein and has the honour to acknowledge receipt of its note of 27 October 2003, which reads as follows:

" The Embassy of the Principality of Liechtenstein presents its compliments to the Federal Department of Foreign Affairs and-referring to the collaboration that has already proved itself between the Principality of Liechtenstein and Switzerland in the field of Regulation of telecommunications as well as bilateral discussions among experts on cooperation in the field of cross-border telecommunications surveillance-has the honour to propose to conclude an Agreement between the Government of the Principality of Liechtenstein and the Swiss Federal Council concerning the Surveillance of telecommunications between the two countries, with the following content:

1. Telecommunications Monitoring

A.
In the event that one of the Contracting Parties is through an urgent request for mutual legal assistance to monitor the telecommunications of the mobile network, it is possible to use the 24-hour service 24 hours a day. Of the requested party for a telephone contact. The service of permanence shall be responsible for the implementation and coordination of legal and technical measures for the earliest possible execution of the measure required in the context of mutual legal assistance.
B.
The mobile connections to be monitored shall be made available to the requesting party in the form of a direct connection.
C.
The service of piquet of the Federal Office of Justice and for the Principality of Liechtenstein, the piquet service of the Landespolizei, shall be regarded as a service of permanence within the meaning of this Agreement for Switzerland.

2. Information on telecommunications connections

Requests for information on telecommunications connections (identification of telecommunications users) may be addressed without request for mutual legal assistance by the Landespolizei of the Principality of Liechtenstein at the plant Of the Federal Police Office.

3. Urgent research

Contracting Parties may, in cases where the bodily integrity of persons is directly threatened, submit a request for information to locate the person in danger using his mobile connection cell. In Switzerland, requests for information are addressed to the Special Task Service (STS) and the Principality of Liechtenstein to the Landespolizei.

4. Costs

The costs relating to the measures provided for in this Agreement shall be borne by the applicant.

5. Validity and Termination

This Agreement shall be concluded for an indefinite period and may be denounced by each Contracting Party with six months' notice.

If the Swiss Federal Council is prepared to accept the above provisions, this note and the Swiss answer note constitute an Agreement between the two Governments.

This Agreement shall enter into force on 27 October 2003.

The Embassy of the Principality of Liechtenstein takes this opportunity to renew to the Federal Department of Foreign Affairs the assurance of its high regard."

The Federal Department of Foreign Affairs confirms, in this note, that the Swiss Federal Council approves the above provisions. Accordingly, the note by the Embassy is with the present note an Agreement between the two Governments, which will enter into force on 27 October 2003.

The Federal Department of Foreign Affairs takes this opportunity to renew to the Embassy of the Principality of Liechtenstein the assurance of its high regard.
