The States Parties to this Protocol and the Vienna Convention on Diplomatic Relations 2 Hereinafter referred to as " the Convention, which was adopted by the United Nations Conference in Vienna from 2 March to 14 April 1961,
Expressing their desire to have recourse, as far as they are concerned, to the compulsory jurisdiction of the International Court of Justice for the resolution of all disputes concerning the interpretation or application of the Convention, unless another mode of By mutual agreement of the Parties within a reasonable period of time,
Agreed to the following provisions:
Disputes concerning the interpretation or application of the Convention fall within the compulsory jurisdiction of the International Court of Justice, which, as such, may be seized by a request from any party to the dispute itself Part of this Protocol.
The parties may agree, within two months of notification by one party to the other that there is a dispute, to adopt by common accord, instead of the use of the International Court of Justice, a procedure before a court Of arbitration. Since that period has elapsed, each party may, by way of application, refer the matter to the Court of dispute.
The parties may also agree, by mutual agreement, within the same two-month period, to resort to a conciliation procedure before appealing to the International Court of Justice.
2. The Conciliation Commission shall make its recommendations within five months of its establishment. If they are not accepted by the parties to the dispute within two months of their statement, each party will be free to apply to the Court of the dispute.
The States Parties to the Convention, the Optional Protocol on the Acquisition of Nationality and this Protocol may at any time declare an extension of the provisions of this Protocol to disputes arising out of The interpretation or application of the Optional Protocol on the acquisition of nationality. Such statements shall be notified to the Secretary-General of the United Nations.
This Protocol shall be open for signature by all States which shall become Parties to the Convention, as follows: until 31 October 1961 at the Federal Ministry of Foreign Affairs of Austria, and thereafter, until 31 March 1962, at the United Nations Headquarters in New York.
This Protocol shall be ratified. Instruments of ratification shall be deposited with the Secretary-General of the United Nations.
This Protocol shall remain open for accession by all States which become Parties to the Convention. Instruments of accession shall be deposited with the Secretary-General of the United Nations.
1. This Protocol shall enter into force on the same day as the Convention or, if that second date is more distant, the thirtieth day after the date of deposit of the second instrument of ratification of the Protocol or accession to that Protocol to the Secretary-General of the United Nations.
2. For each State ratifying or acceding to this Protocol after its entry into force in accordance with par. 1 of this Article, the Protocol shall enter into force on the thirtieth day after the deposit by that State of its instrument of ratification or accession.
The Secretary-General of the United Nations shall notify all States which may become Parties to the Convention:
The original of this Protocol, of which the English, Chinese, Spanish, French and Russian texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies to all States referred to in Art. V.
