European Agreement on Main Inland Waterways of International Importance

(AGN)

Geneva, 19 January 1996

Instrument of ratification deposited by Switzerland on 21 August 1997

The Contracting Parties,

Aware of the need to facilitate and develop international inland waterway transport in Europe,

Knowing that international trade in goods should develop as a result of increased international trade,

Underlining the importance of the role of inland waterway transport which, compared to other modes of inland transport, has economic and ecological advantages and has excess capacity for infrastructure and vessels, and is therefore in a position to Measures to reduce social costs and the negative impact on the overall environment of inland transport,

Convinced that it is essential to make international inland waterway transport in Europe, including transport by sea-river vessels following coastal routes, more efficient and more attractive to customers, to put in place the Put in place a legal framework establishing a coordinated plan for the development and construction of a network of inland waterways of international importance, based on agreed parameters for infrastructure and operations 1 ,

Agreed to the following:

Art. 1 Network Designation

1. The Contracting Parties shall adopt the provisions of this Agreement in the form of a coordinated plan for the development and construction of a waterway network, hereinafter referred to as "the network of navigable waterways of international importance" or "E waterway network", which they intend to set up as part of their appropriate programmes. The E waterway network, in respect of this Agreement, shall consist of the inland waterways and coastal routes taken by the river-sea vessels, as well as of the ports of international importance situated on these routes and Which are set out in Annexes I and II to this Agreement 1 .

2. The Contracting Parties shall take the necessary measures for the effective protection of the route envisaged for the portions of E waterways which do not yet exist-with due regard to their future parameters-but which Are enrolled in infrastructure development programs until a decision on their construction is made 2 .

Art. 2 Technical and operating characteristics of the network

1. The network of inland waterways of international importance referred to in Article 1 shall be in conformity with the characteristics set out in Annex III to this Agreement or shall be aligned with the provisions of that Annex in the course of improvement Future.

2. Contracting Parties are required to draw up national action plans and/or bilateral or multilateral agreements, such as international treaties, directives, memoranda of understanding, joint studies and other similar agreements, to eliminate The current bottlenecks and completing the missing links of the E waterway network crossing their territory 1 .

Art. 3 Annexes

The Annexes to this Agreement shall form an integral part of the Agreement.

Art. 4 Designation of the Depositary

The Secretary-General of the United Nations is the depositary of the Agreement.

Art. 5 Signature

(1) This Agreement shall be open to the United Nations Office at Geneva for the signature of States that are either members of the United Nations Economic Commission for Europe or have consultative status with the Commission in accordance with By. 8 and 11 of the Commission's mandate, of 1 Er October 1996 to September 30, 1997.

2. These signatures will be subject to ratification, acceptance or approval.

Art. 6 Ratification, acceptance or approval

This Agreement shall be subject to ratification, acceptance or approval in accordance with subs. 2 of the art. 5.

(2) Ratification, acceptance or approval shall be effected by the deposit of an instrument with the Secretary-General of the United Nations.

Art. 7 Accession

(1) This Agreement shall be open for accession by any State referred to in paragraph 1 of Art. 5 from 1 Er October 1996.

2. Accession shall be effected by the deposit of an instrument with the Secretary-General of the United Nations.

Art. 8 Entry into force

This Agreement shall enter into force 90 days after the date on which the governments of five States have deposited an instrument of ratification, acceptance, approval or accession, provided that one or more waterways of the Network of inland waterways of international importance shall be uninterrupted between the territories of at least three of those States.

2. If this condition is not met, the Agreement shall enter into force 90 days after the date of deposit of the instrument of ratification, acceptance, approval or accession which has satisfied that condition.

3. For each State that disposes of an instrument of ratification, acceptance, approval or accession after the date from which the 90-day period specified in s. 1 and 2 of this Article, the Agreement shall enter into force 90 days after the date of the said deposit.

Art. Limitations on the application of the agreement

Nothing in this Agreement shall be construed as prohibiting a Contracting Party from taking the measures, consistent with the provisions of the Charter of the United Nations 1 And limited to the requirements of the situation, which it considers necessary for its external or internal security.

2. These measures, which must be temporary, shall be notified immediately to the depositary; their nature must be specified.


Art. 10 Dispute Settlement

1. Any dispute between two or more Contracting Parties concerning the interpretation or application of this Agreement, which the disputing Parties could not have settled by negotiation or otherwise, shall be referred to arbitration if Any of the Contracting Parties in dispute the application, and shall accordingly be subject to one or more arbitrators chosen by common accord of the Parties in dispute. If, within three months of the date of the request for arbitration, the disputing Parties are unable to agree on the choice of an arbitrator or arbitrators, any such Party may request the Secretary-General of the United Nations Appoint a sole arbitrator to whom the dispute is referred for a decision.

2. The award of the arbitrator or arbitrators designated in accordance with s. 1 above is binding on the Contracting Parties in dispute.

Art. 11 Reservations

Any State may, at the time when it signs this Agreement or deposits its instrument of ratification, acceptance, approval or accession, notify the depositary that it does not consider itself bound by s. 10 of this Agreement.

Art. 12 Procedure for Amendment of this Agreement

(1) This Agreement may be amended in accordance with the procedure set out in this Article, subject to the provisions of Art. 13 and 14.

2. 1 At the request of a Contracting Party, any amendment to this Agreement proposed by that Party shall be considered by the Working Party on Inland Water Transport of the United Nations Economic Commission for Europe.

(3) If adopted by a two-thirds majority of the Contracting Parties present and voting, the amendment shall be communicated for acceptance to all Contracting Parties by the Secretary-General of the United Nations.

4. Any proposed amendment that has been communicated in accordance with the provisions of s. 3 of this Article shall enter into force for all Contracting Parties three months after the expiry of a period of twelve months following the date of its communication, provided that, during that twelve-month period, no objection to that Proposed amendment has not been notified to the Secretary-General of the United Nations by a State which is a Contracting Party.

5. If an objection to the proposed amendment has been notified in accordance with the provisions of s. 4 of this Article, the amendment shall be deemed to have no effect.

Art. 13 Procedure for amendment of Annexes I and II

Annexes I and II to this Agreement may be amended in accordance with the procedure set out in this Article.

2. 1 At the request of a Contracting Party, any amendment to Annexes I and II proposed by that Party shall be considered by the Working Party on Inland Water Transport of the United Nations Economic Commission for Europe.

3. If adopted by a majority of the Contracting Parties present and voting, the proposed amendment shall be communicated for acceptance to Contracting Parties directly interested in the Secretary-General of the United Nations United. For the purposes of this Article, a Contracting Party shall be considered to be directly interested if, in the case of the inclusion of a new waterway or of a port of international importance, or in the case of the modification of such facilities, Its territory is crossed by this waterway or if the proposed port is situated on that territory.

4. Any proposed amendment communicated in accordance with the provisions of s. 2 and 3 of this Article shall be deemed accepted if, within six months from the date of its communication by the depositary, none of the Contracting Parties directly concerned has notified its objection to that amendment to the Secretary General of the United Nations.

5. Any amendment so accepted shall be communicated by the Secretary-General of the United Nations to all Contracting Parties and shall enter into force three months after the date of its communication by the depositary.

6. If an objection to the proposed amendment has been notified in accordance with par. 4 of this Article, the amendment shall be deemed to have no effect.

7. The depositary shall be kept informed without delay by the secretariat of the Economic Commission for Europe concerning the Contracting Parties which are directly concerned by a proposed amendment.

Art. 14 Amendment procedure for Annex III

Annex III to this Agreement may be amended in accordance with the procedure laid down in this Article.

2. 1 At the request of a Contracting Party, any amendment to Annex III to this Agreement proposed by that Party shall be considered by the Working Party on Inland Water Transport of the United Nations Economic Commission for Europe.

(3) If adopted by a majority of the Contracting Parties present and voting, the amendment shall be communicated for acceptance to all Contracting Parties by the Secretary-General of the United Nations.

4. Any proposed amendment communicated in accordance with the provisions of s. 3 of this Article shall be deemed accepted, unless, within six months from the date of its communication, one fifth or more of the Contracting Parties shall notify their objection to that amendment to the Secretary-General Of the United Nations.

5. Any amendment accepted in accordance with paragraph 5. 4 of this Article shall be communicated by the Secretary-General of the United Nations to all Contracting Parties and shall enter into force three months after the date of its communication for all Contracting Parties except Those who have already notified the Secretary-General of the United Nations of their objection to the proposed amendment within six months of the date of its communication in accordance with paragraph 4 of this article.

6. If an objection to the proposed amendment has been notified in accordance with par. 4 of this Article by a fifth or more of the Contracting Parties, the amendment shall be deemed to be rejected and shall have no effect.

Art. 15 Denunciation

1. Any Contracting Party may denounce this Agreement by written notification addressed to the Secretary-General of the United Nations.

(2) Denunciation shall take effect one year after the date of receipt of such notification by the Secretary-General.

Art. 16 Extinction

If, after the entry into force of this Agreement, the number of States which are Contracting Parties falls to less than five during any period of twelve consecutive months, this Agreement shall become without effect twelve months after the date on which the The fifth State shall have ceased to be a Contracting Party.

Art. 17 Depositary Notifications and Communications

In addition to the notifications and communications referred to in this Agreement, the depositary functions of the Secretary-General of the United Nations are those defined in Part VII of the Vienna Convention on the Law of Treaties 1 , concluded in Vienna on 23 May 1969.


Art. 18 Authentic texts

The original of this Agreement, of which the English, French and Russian texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

Annex I 1

Inland waterways of international importance

Numbering of waterways of international importance

1. All inland waterways of international importance (E waterways) are identified by the letter "E" followed by a number of two, four or six digits.

2. The main elements of the E waterway network shall bear two-digit numbers, while their primary and secondary branches shall bear four-and six-digit numbers, respectively.

3. The main north-south-oriented main waterways, which serve seaports and connect sea basins, are numbered 10, 20, 30, 40 and 50 in ascending order from west to east.

4. The main waterways substantially oriented west-east that cut at least three main routes as mentioned in par. 3 above bear numbers 60, 70, 80 and 90 in ascending order from north to south.

5. The other main waterways shall bear two-digit numbers between the numbers of the two main waterways, as mentioned in the case at par. 3 or 4 above, between which they are located.

6. In the case of primary or secondary branches, the first two or four digits correspond to the higher routes of the waterway network, the other two corresponding to the number of the branch in question in the order From the beginning to the end of the higher rank, as shown in the table below. Peer numbers are used for branches on the right side and odd numbers for those on the left side.

Each inland waterway of international importance (port E) shall be assigned a number consisting of the number of the inland waterway on which it is located, followed by a dash and a two-digit number designating the port on that waterway And increasing from west to east and north to south, the whole number being preceded by the letter "P". Annex III 1

Technical and operating characteristics of inland waterways of international importance

(a) Technical characteristics of inland waterways E

The main technical features of the E waterways will generally conform to the classification of the European inland waterways shown in Table 1.

In order to evaluate the different E waterways, the characteristics of classes IV to VII must be based on the following principles:

(i)
The class of the waterway is determined by the horizontal dimensions of the railcars, barges and pushed convoys, and mainly by the standard main dimension, i.e. their bau or width;
(ii)
Only navigable waterways that meet at least the basic requirements of Class IV (minimum dimensions of vessels: 80 m × 9.5 m) may be considered as waterways E. Limitations on the draft (less than 2.50 m) and the minimum clearance under bridges (less than 5.25 m) may be allowed only for existing waterways and as an exception;
(iii)
When upgrading the Class IV waterways (as well as smaller regional waterways), it is recommended to ensure that at least the parameters of Class V (a) are met;
(iv)
However, the new E waterways should at least meet the requirements of Class V (b). In this regard, a minimum draught of 2.80 m should be guaranteed;
(v)
In the modernisation of existing waterways and in the construction of new waterways, there should always be an increase in the size of vessels and convoys;
(vi)
In order to improve the efficiency of container transport, care should be taken to ensure the widest possible clearance under the bridges in accordance with Note 4 to Table 1. 2 ;
(vii)
Waterways on which significant containerized or transrolling traffic is expected should at least meet the requirements of class Vb. Consideration could also be given to an increase of 7 to 10 per cent of the width of 11.4 m on vessels operating exclusively on Va-class waterways and above to take into account the future evolution of container sizes and Facilitate the transportation of trailers;
(viii)
On waterways at variable water level, the recommended value of the draft draught should correspond to that reached or exceeded on average 240 days per year (or 60 % of the navigation period) 3 . The value of the free height recommended under the bridges (5.25 m, 7.00 m or 9.10 m) should be maintained for the highest level of navigation provided that this is possible and economically feasible;
(ix)
Uniform standards of class, draught and clearance under the bridges on any navigable waterway or at least on significant portions of its length should be maintained;
X)
As far as possible, the parameters of the adjacent waterways should be identical or similar;
(xi)
The largest draught (4.50 m) and the highest minimum clearance under the bridges (9,10 m) should be maintained on all portions of the network that are directly connected to the coastal roads;
(xii)
A minimum free height of 7.00 m under bridges should be maintained on waterways that link major sea ports in the hinterland and are adapted to efficient container transport and river-sea traffic;
(xiii)
The coastal routes listed in Annex I above are intended to maintain the continuity of the E waterway network throughout Europe and are intended to be used, under this Agreement, by fluvio-maritime transport vessels Whose dimensions should, as far as possible and economically feasible, comply with the requirements concerning self-propelled vessels adapted to navigation on the inland waterways of the Va and VIb classes.

The following minimum requirements are considered to be met in order for a navigable waterway to be suitable for containerized traffic:

Inland navigation vessels of a width of 11.4 m and a length of approximately 110 m shall be capable of carrying containers on three or more heights; if not, it should be allowed a maximum length of 185 m for the Pushed convoys, in which case they should be able to transport containers on two heights.

The value of the draught for a particular waterway must be determined in accordance with local conditions.

Occasionally, convoys consisting of a higher number of barges may be used on certain sections of Class VII waterways. In this case, the horizontal dimensions may exceed the values shown in the table.

(b) Conditions for the operation of waterways E

E waterways should meet the following basic operating conditions in order to enable international transport to operate reliably:

(i)
Traffic should be ensured throughout the navigation period, with the exception of the following interruptions;
(ii)
The navigation period can be less than 365 days in areas with severe climatic conditions where ice-free channels cannot be maintained during the winter, and navigation should be discontinued. In such cases, the opening and closing dates for navigation should be fixed. The duration of interruptions due to natural phenomena such as freezing, flooding, etc., should be limited to the strict minimum through appropriate technical and organisational measures;
(iii)
The duration of interruptions due to the regular maintenance of the locks and other hydraulic structures should be kept to a minimum. The users of the waterway on which it is planned to carry out maintenance work should be kept informed of the dates and duration of the proposed interruption. In the event of an unexpected failure of a lock or other hydraulic works, or in other cases of force majeure, efforts shall be made to limit the duration of the interruptions to the strict minimum by taking all appropriate measures to remedy the situation. This situation;
(iv)
No interruption due to low water is allowed. On the other hand, reasonable restrictions on the allowable draught on navigable waterways where the water level is variable are acceptable. However, a minimum draught of 1.20 m should be maintained in all circumstances, and the characteristic or recommended draught should be maintained or exceeded for 240 days per year. In the areas mentioned in (ii) above, the minimum draught of 1.20 m should be maintained for 60 % of the average navigation period;
(v)
The hours of operation of locks, mobile bridges and other infrastructure works shall be such that navigation is ensured 24 hours a day on working days, provided that this is economically feasible Feasible. Exceptions may be permitted in certain cases for organisational and/or technical reasons. Reasonable hours of operation must also be provided for navigation on public holidays and on weekends.

(c) Technical and operating characteristics of ports E

The E waterway network is complemented by an inland waterway system of international importance. Each E port must meet the following technical and operating characteristics:

(i)
It must be located on an E waterway;
(ii)
It must be able to receive vessels or pushed convoys used on this waterway in accordance with its class;
(iii)
It must be served by major roads or rail lines (preferably part of the network of international routes and international railway lines established by the European Agreement on Main Traffic Arteries International [AGR] 5 The European Agreement on Main International Railway Lines [AGC] 6 And the European Agreement on Main International Combined Transport Lines and Related Installations [AGTC] 7 );
(iv)
It must be able to process a volume of goods of at least 0.5 million tonnes per year;
(v)
It must provide satisfactory conditions for the development of an industrial port area;
(vi)
It must allow the handling of standard containers (except in the case of a specialized bulk carrier port);
(vii)
Providing all necessary services for the day-to-day operations of international transportation;
(viii)
To meet the needs of environmental protection, facilities for receiving waste products on board vessels should exist in ports of international importance.
