Convention on the Grant of Plurilingual Extracts of Civil Status

Concluded in Vienna on 8 September 1976

Instrument of ratification deposited by Switzerland on 19 March 1990

Entry into force for Switzerland on 18 April 1990

(State on 23 February 2016)

The States Parties to this Convention,

Wishing to improve the rules on the issue of plurilingual extracts of certain acts of the civil status, in particular when they are intended for use abroad,

Agreed to the following provisions:

Art. 1

Extracts from the acts of the civil status attesting to the birth, marriage or death shall, where an interested party so requests or when their use requires a translation, be drawn up in accordance with Forms A, B and C annexed to the present Convention.

In each Contracting State, such extracts shall be issued only to persons who have standing to obtain literal shipments.

Art. 2

The extracts shall be drawn up on the basis of the originating particulars and subsequent statements of the acts.

Art. 3

Each Contracting State may supplement the forms annexed to this Convention by means of boxes and symbols indicating other particulars or references to the act, provided that the wording has been previously approved by The General Assembly of the International Civil Commission.

However, each Contracting State may adjoin a box to receive an identification number.

Art. 4

All entries on the forms are written in Latin characters of the printed matter; they may also be written in the characters of the language which has been used for the drafting of the act to which they refer.

Art. 5

The dates are inscribed in Arabic numerals indicating successively, under the symbols Jo, Mo and An, the day, month and year. The day and month are indicated by two digits, the year by four digits. The first nine days of the month and the first nine months of the year are indicated by numbers ranging from 01 to 09.

The name of any place mentioned in an extract is followed by the name of the State where that place is located each time that State is not the State in which the extract is issued.

The identification number is preceded by the name of the State which assigned it.

To indicate sex are used exclusively the following symbols:

M = male, F = female.

In order to indicate marriage, separation of bodies, divorce, annulment of marriage, death of the holder of the birth certificate and the death of the husband or wife, are used exclusively for the following symbols: Separation of body; Div = divorce; A = cancellation; D = death; Dm = death of husband; Df = death of wife. These symbols are followed by the date and place of the event. The "Mar" symbol is also followed by the name and surname of the spouse.

Art. 6

On the front of each extract, the invariable formulae, excluding the symbols provided for in s. 5 as regards the dates, shall be printed in at least two languages, including the language or one of the official languages of the State in which the extract is issued and the French language.

The meaning of the symbols shall be indicated at least in the language or in one of the official languages of each State which, at the time of signature of this Convention, are members of the International Commission of the Civil State or are Bound by the Paris Convention of 27 September 1956 1 On the issue of certain extracts from acts of civil status intended for foreign nationals, as well as in the English language.

On the back of each excerpt must appear:

-
A reference to the Convention, in the languages indicated in the second paragraph of this Article,
-
The translation of the invariable formulae, in the languages indicated in the second paragraph of this Article, provided that those languages have not been used on the front,
-
A summary of the art. 3, 4, 5 and 7 of the Convention, at least in the language of the authority issuing the extract.

Each State which accedes to this Convention shall communicate to the Swiss Federal Council, upon the deposit of its instrument of accession, the translation into its official language or languages of the invariable formulae and the meaning of the symbols.

This translation is transmitted by the Swiss Federal Council to the Contracting States and to the Secretary General of the International Commission of Civil Affairs.

Each Contracting State will have the option of adding this translation to extracts which will be issued by its authorities.


Art. 7

If the wording of the act does not permit the filling of a box or part of the box of the extract, this box or part of a box is rendered unusable by strokes.

Art. 8

The extracts shall bear the date of their issuance and shall bear the signature and seal of the authority which issued them. They shall have the same value as extracts issued in accordance with the rules of internal law in force in the State of which they emanate.

They shall be accepted without legalisation or equivalent formality in the territory of each State bound by this Convention.

Art.

Subject to international agreements on the free delivery of shipments or extracts from acts of the civil status, extracts issued pursuant to this Convention shall not give rise to the levying of higher rights than Extracts drawn up pursuant to the internal legislation in force in the State of which they emanate.

Art. 10

This Convention shall not preclude the obtaining of literal shipments of civil status acts established in accordance with the rules of domestic law of the country in which such acts have been prepared or transcribed.

Art. 11

Each Contracting State may, at the time of the signature of the notification provided for in Article 12 or of accession, declare that it reserves the right not to apply this Convention to extracts from birth certificates concerning children Adopted.

Art. 12

The Contracting States shall notify the Swiss Federal Council of the completion of the procedures required by their Constitution to make this Convention applicable in their territory.

The Swiss Federal Council will notify the Contracting States and the Secretary General of the International Commission of the Civil State of any notification within the meaning of the preceding paragraph.

Art. 13

This Convention shall enter into force as from the thirtieth day after the date of the filing of the fifth notification and shall therefore take effect between the five States which have completed that formality.

For each Contracting State, following the formality provided for in the preceding Article, this Convention shall take effect from the thirtieth day after the date of the filing of its notification.

Upon entry into force of this Convention, the depositary Government shall transmit the text thereof to the Secretariat of the United Nations for registration and publication, in accordance with art. 102 of the United Nations Charter 1 .


Art. 14

The Convention on the Grant of Certain Extracts of Civil Status for Abroad, signed at Paris on 27 September 1956 1 , shall cease to be applicable between the States in respect of which this Convention entered into force.


Art. 15

The reserve referred to in s. 11 may at any time be withdrawn totally or partially. The withdrawal will be notified to the Swiss Federal Council.

The Swiss Federal Council will notify the Contracting States and the Secretary General of the International Commission of the Civil State of any notification within the meaning of the preceding paragraph.

Art. 16

This Convention shall apply to the full extent of the metropolitan territory of each Contracting State.

Any State may, at the time of signature, notification, accession or later, declare by notification addressed to the Swiss Federal Council that the provisions of this Convention shall apply to one or more of its Non-metropolitan areas, states or territories for which it has international responsibility. The Swiss Federal Council will notify the latter each of the Contracting States and the Secretary General of the International Commission of Civil Affairs. The provisions of this Convention shall become applicable in the territory or territories designated in the notification on the sixtieth day following the date on which the Swiss Federal Council receives such notification.

Any State which has made a declaration in accordance with the provisions of para. 2 of this Article, may thereafter declare at any time, by notification addressed to the Swiss Federal Council, that this Convention shall cease to be applicable to one or more of the States or territories designated in the declaration.

The Swiss Federal Council will notify the new notification each of the Contracting States and the Secretary General of the International Commission of Civil Affairs.

The Convention shall cease to be applicable to the territory referred to on the sixtieth day following the date on which the Swiss Federal Council receives such notification.

Art. 17

Any State may accede to this Convention after its entry into force. The Act of Accession will be deposited with the Swiss Federal Council. The latter shall notify each of the Contracting States and the Secretary General of the International Commission of the Civil State of any deposit of an act of accession. The Convention shall enter into force, for the acceding State, on the thirtieth day after the date of the deposit of the Act of Accession.

Art. 18

This Convention shall remain in force without limitation. However, each Contracting State may denounce it at any time by means of a written notification to the Swiss Federal Council, which shall inform the other Contracting States and the Secretary General of the Commission International Civil Status.

Such a right of denunciation shall not be exercised by a State before the expiration of a period of one year from the date on which the Convention entered into force for it.

The denunciation shall have effect from a period of six months after the date on which the Swiss Federal Council receives the notification provided for in the first paragraph of this Article.

In witness whereof, The undersigned representatives duly authorised for this purpose have signed this Convention.

Done at Vienna, on 8 September 1976, in a single copy which shall be deposited in the archives of the Swiss Federal Council and of which a certified copy shall be furnished by diplomatic means to each of the Contracting States and to the Secretary General of the International Civil State Commission.

-Die Daten sind in arabischen Ziffern einzutragen, die nacheinander Tag, Monat und Jahr bezeichnen. Tag und Monat sind durch zwei, das Jahr durch vier Ziffern zu bezeichnen. Die ersten neun Tage des Monats und die ersten neun Monate des Jahres sind durch Ziffern von 01 bis 09 zu bezeichnen.

The Swiss Confederation declares, under s. 11, that it reserves the right not to apply this Convention to extracts from birth certificates concerning adopted children whose original filiation remains.
