Guidelines for the Encouragement of Extrascolary Activities of Children and Youth

(Child and Youth Incentive Ordinance, OEEJ)

The Swiss Federal Council,

See art. 23, para. 1, of the Federal Act of 30 September 2011 on the Encouragement of Children and Youth (LEEJ) 1 ,

Stops:

Section 1 General provisions

Art. 1 Definitions

For the purposes of this order and the YEJ, the following:

A.
A project conducted at the level of a linguistic region within the meaning of s. 5, let. C, c. 1, EJ: Any project carried out in at least ten alemanic cantons, in at least three Romany cantons, in Italian Switzerland or in Swiss rheto-romane;
B.
Children and youth policy actors: Cantons, inter-cantonal conferences competent in this field, towns and municipalities, competent federal services, non-governmental organisations and experts.
Art. 2 Service of the Confederation responsible for child and youth policy

1 The Federal Office for Social Insurance (OFAS) is the service of the Confederation responsible for child and youth policy.

2 THE OFAS:

A.
Has jurisdiction to fix and remit the financial assistance provided by the YEJ;
B.
Provides information on child and youth policy through an electronic platform;
C.
Provides information on the Confederation's policy in this area;
D.
Regular exchange of information with the various actors involved in child and youth policy;
E.
Takes steps to facilitate collaboration among these actors;
F.
Organise demonstrations and adopt measures for the development of skills in this field under Art. 21 LEEJ.
Art. 3 Distribution of financial resources

1 The financial resources available for the promotion of children and young people are allocated:

A.
75 to 90 % in the form of financial aid for management tasks and regular activities (art. 7 LEEJ) and financial support for training and development (art. 9 LEEJ);
B.
10 to 25 % in the form of financial aid for projects that can serve as a model or encourage the participation of young people (art. 8 LEEJ), financial assistance for projects aimed at encouraging the political participation of young people at the federal level (art. 10 LEEJ) and financial aid to the cantons and municipalities for time-limited projects with a model value (Art. 11 LEEJ).

2 The financial aid allocated to the cantons for programmes designed to establish and develop their policy on children and youth (art. 26 LEEJ) are managed by the OFAS as part of a separate appropriation.

Art. 4 Attributed Expenditures

1 Deemed expenses attributable to the meaning of s. 13 YEJ the actual costs resulting from the regular statutory activities of the lead agency or the implementation of a project.

2 The expenditure for extraordinary investments and the costs resulting from a fault committed by the responsible body, such as compensation, fines and loan depreciation, are not attributable.

Art. 5 Filing and processing of applications

1 The OFAS can provide application forms or implement a computer application to process applications.

2 It lays down guidelines on the procedures for filing applications.

Section 2 Financial assistance for the management tasks and the regular activities of private bodies

Art. 6 Requests

1 The umbrella associations, coordination platforms and the specific organisations applying for the financial aid referred to in Art. 7 LEEJ may apply to the OFAS until the end of April.

2 The application shall contain at least the following indications on the requesting body:

A.
Size and structure;
B.
Presence on the territory and radius of action;
C.
Offers and activities;
D.
Collaboration with other organizations;
E.
Funding and budget.
Art. 7 Review and decision

1 OFAS reviews the application. If it is incomplete, it will return it to the applicant organization for adaptation.

2 Benefit contracts with umbrella associations and coordination platforms are concluded for 1 Er January of the following year and have a duration of three years.

3 OFAS makes its decision on applications submitted by individual organizations no later than four months after the expiration of the time limit for filing applications.

4 OFAS may also enter into benefit contracts with specific organizations. These contracts are concluded for 1 Er January of the following year and have a duration of three years.

Section 3 Financial assistance for projects that can serve as a model or encourage youth participation

Art. 8 Projects that can serve as a model or encourage youth participation

1 Are deemed projects that can serve as a model within the meaning of s. 8 YEJ single projects limited to three years:

A.
Have an innovative character;
B.
That are transposable in another context;
C.
For which there is a proven need; and
D.
For which knowledge transfer is guaranteed.

2 The following are considered projects encouraging the participation of children and young people in single projects limited to three years:

A.
That are developed, directed and carried out for the most part by children or youth; or
B.
In which children or young people in particular need of encouragement play a central and active role.
Art. Thematic and objectives

The Federal Department of the Interior (DFI) can define themes and objectives for projects that can serve as a model and projects encouraging the participation of children and young people.

Art. 10 Requests

1 Private organizations seeking financial assistance under s. 8 LEEJ may apply to the OFAS until the end of February, late June or late November.

2 The application shall contain at least the following indications on the proposed project:

A.
Nature and importance;
B.
Objective and utility;
C.
Model value or capacity to encourage participation;
D.
Participating organizations and individuals;
E.
Funding and budget.
Art. 11 Review and decision

1 OFAS reviews the application. If it is incomplete, it will return it to the applicant organization to complete it.

2 It may seek the advice of external experts.

3 It may require project coordination with other projects.

4 It shall make its decision no later than four months after the expiration of the time limit for filing the application.

Section 4 Financial assistance for training and development

Art. 12 Training and Development

1 Training and development within the meaning of s. 9 YEJ training activities:

A.
Who are regularly organized by organizations to train participants in their leadership, advice or support function; and
B.
Which are clearly distinguishable from general statutory activities.

2 Training and development activities that already qualify for benefits under the Act of 17 June 2011 on the encouragement of sport 1 Do not fall within the scope of training and development within the meaning of this order.


Art. 13 Requests

1 Private organizations seeking financial assistance under s. 9 LEEJ may apply to the OFAS until the end of July.

2 The application shall contain at least the following indications on training and development offers:

A.
Nature and importance;
B.
Objective and utility;
C.
Funding and budget.
Art. 14 Review and decision

1 OFAS reviews the application. If it is incomplete, it will return it to the applicant organization for adaptation.

2 OFAS enters into a contract with the organizations for which it has approved the application. Contracts are concluded for 1 Er January of the following year and have a duration of four years.

Section 5 Financial aid for projects aimed at encouraging youth political participation at the federal level

Art. 15 Encouraging the political participation of children and young people

The following are considered projects aimed at encouraging the political participation of children and youth at the federal level within the meaning of s. 10 LEB:

A.
Regular offers in this area;
B.
Single projects in this field limited to three years.
Art. 16 Requests

1 Private organizations seeking financial assistance under s. 10 LEEJ may apply to the OFAS until the end of February, late June or late November.

2 The application shall contain at least the following indications on the proposed offer or project:

A.
Nature and importance;
B.
Objective and utility;
C.
Participating individuals and organizations, especially children and youth with a particular need for encouragement;
D.
Funding and budget.
Art. 17 Review and decision

1 OFAS reviews the application. If it is incomplete, it will return it to the applicant organization to complete it.

2 It may seek the advice of external experts.

3 It may require project coordination with other projects.

4 It shall make its decision no later than four months after the expiration of the time limit for filing the application.

Section 6 Financial assistance to cantons and municipalities for projects of national importance with a model value

Art. 18 Projects of national significance with a model value

Are deemed projects of a model value within the meaning of s. 11 YEJ the unique projects of cantons and communes limited to three years:

A.
Have an innovative character;
B.
That are transposable in another context;
C.
For which there is a proven need; and
D.
For which knowledge transfer is guaranteed.
Art. 19 Thematic and objectives

The DFI and the cantons together define themes and objectives for projects of national significance with a model value.

Art. Requests

1 The cantons and municipalities which apply for the financial aid referred to in Art. 11 LEEJ may apply to the OFAS until the end of February, late June or late November.

2 The application shall contain at least the following indications on the proposed project:

A.
Nature and importance;
B.
Objective and utility;
C.
Model value;
D.
Participating organizations and individuals;
E.
Funding and budget.

3 Requests from a municipality shall also contain the opinion of the canton responsible.

Art. Review and decision

1 OFAS reviews the application. If it is incomplete, it will return it to the canton or municipality that presented it.

2 It may seek the advice of external experts.

3 It may enter into a contract with the canton or municipality submitting the application.

Section 7 Collaboration and development of competences in child and youth policy

Art. Electronic Platform

1 OFAS provides an electronic platform.

2 Children and youth policy actors can present their offers and indicate their areas of competence on this platform.

3 OFAS provides information on developments in child and youth policy and presents proven forms of work and promising project models.

Art. Collaboration with the cantons and municipalities

1 Each canton appoints a contact service for child and youth policy.

2 Cantonal contact services:

A.
Inform OFAS of the developments in their cantonal policy;
B.
Inform the competent services in their canton of the OFAS information concerning the policy pursued by the Confederation.

3 The OFAS organises regular exchanges with the cantonal contact services, in collaboration with the relevant intercantonal conferences.

4 The cantons shall ensure that the municipalities are involved in their regular exchanges with the Confederation.

Art. 24 Collaboration in the Federal Government

OFAS maintains contacts and exchanges with the federal departments responsible for child and youth policy; it provides an annual overview of the ongoing work at the federal level in this area.

Section 8 Federal Commission on Children and Youth

Art. 25 Rules of Procedure

The Federal Commission for Children and Youth enacts its own internal regulations and submits it to the DFI for approval.

Section 9 Financial aid for programmes for the establishment and development of cantonal children and youth policy

Art. 26 Conditions

1 Financial aid within the meaning of Art. 26 LEEJ may be allocated to the cantons for programmes designed to establish and develop their policy on children and youth if these programmes:

A.
Have a set design and planning; and
B.
Develop measures of encouragement, protection or concrete participation.

2 OFAS contracts up to four contracts per year. It allocates a maximum of 450,000 francs per canton.

Art. 27 Procedure

1 The cantons can submit their applications to the OFAS until 2019. Applications for financial assistance for a given year must be filed by the end of June of the previous year.

2 The application shall contain at least the following indications on the cantonal programme:

A.
Nature and importance;
B.
Objective and utility;
C.
Opportunities for cooperation with other cantons;
D.
Participating organizations and individuals;
E.
Funding and budget.

3 The OFAS reviews the applications. They may request that they be adapted or completed, and seek the advice of external experts.

4 He may enter into a contract with the requesting canton.

5 It can provide financial support for the preparatory work of the canton.

Art. 28 Contracts between the Confederation and a canton

Contracts shall be for a maximum period of three years and shall include:

A.
The objectives of the cantonal programme;
B.
The benefits of the township;
C.
Reporting and quality assurance;
D.
The terms and conditions for the payment of financial assistance.

Section 10 Final provisions

Art. Executing

The OFAS shall execute this order.

Art. Repeal of the law in force

The order of 10 December 1990 on youth activities 1 Is repealed.

Art. Transitional provisions

The financial aid for training and development allocated for 2013 shall be calculated on the basis of the data provided in accordance with the benefit agreements between the OFAS and the organisations for the years 2008 to 2012.

Art. 32 Entry into force and validity

1 This order shall enter into force on 1 Er January 2013.

2 Art. 26 to 28 apply until December 31, 2022.
