1 This order regulates the terms and conditions of employment of the following members of the FIF faculty (teachers):
C. Assistant professors.
2 The commitment of professors subject to private law is regulated by the code of obligations 1 .
3 The contract of employment of private law shall include the provisions of the LPers and this order applicable by analogy to teachers engaged under private law. The provisions of Art. 4 to 6 (rights and obligations) and s. 16 (salary) of this order shall apply mutatis mutandis to teachers engaged in private law. 2

1 The President of the EPF shall decide all matters relating to the work reports of the teachers and that this order does not expressly fall within any other jurisdiction.

2 They offer competitive working conditions globally with those offered by advanced universities in the rest of the world. They respect the principle of scientific freedom in research and university education.
3 They periodically check that the objectives set out in para. 1 as well as s. 4 LPers are being reached. They report to the EFA Council.
1 Teachers respond to the maintenance of the international quality of teaching and research. They promote the emergence of a scientific succession with the necessary qualifications and aware of its responsibilities towards society and the environment.
2 They provide high-level services and collaborate to this end with private and public institutions. They shall ensure that their professional independence is maintained.
3 They support periodic reviews of their benefits to which evaluation committees operate.
1 The benefits of regular teachers and associate professors are regularly evaluated. The evaluations relate to the performance of tasks within the meaning of s. 5.
2 The evaluation is based on the principles of fairness and transparency.
3 The outcome of the evaluation may have implications for the endowment of the Chair.
4 FIFs determine the frequency, form and execution of evaluations. They report to the Conseil des EPF.
5 The EFP Council shall monitor the implementation of the evaluations and the implementation of the resulting measures in the framework of the controlling.

1 The teachers train the students, promote their collaborators, and ensure their continuing education, and supervise the PhD students. They are involved in curriculum development through their proposals.
2 The professors shall pass the prescribed examinations and evaluate the scientific work submitted to them in their fields of teaching and research.
3 They organize, direct and develop their Chairs, taking into account the needs of the teaching and research units to which they belong. They assume their hierarchical responsibilities.
4 They promote their specific field through high-level scientific research. They join in the critical dialogue of experts on a global scale. They respond to the dissemination of research results and promote the development of rights resulting from research activities.
5 They participate in academic self-management.
1 Teachers may have on their own behalf, on their own account and under their own responsibility for professional activities outside their working relationship with the FIF, in particular as experts, provided that this is not Not to the detriment of obligations arise from their working relationships.
2 They must obtain permission from the President of the EFA to carry out an activity outside the FIF that requires a total of more than one day per week for full-time employment.
3 They must obtain the authorisation of the President of the EPF to sit on a board of directors or in the direction of a company. The authorisation is granted to them when there is no interest from the EPF.
4 If teachers use FIF resources, such as laboratory equipment or the secretariat, for a remunerated activity outside the FIF, they must compensate the EPF. Both FIEs enact the necessary provisions.
1 The EPF Council appoints teachers on the proposal of the President of the EPF.
2 The proposal shall be accompanied by:
A. A report on the candidate;
B. A report on the selection procedure;
C. The draft contract of employment established in the preliminary negotiations.
3 The President of the EPF is usually a committee responsible for drawing up the proposal. A proposal may exceptionally be submitted to the EPF Board by way of an appeal.
1 Once the teacher is appointed, the EPF Board enters into a written contract with him.
2 In particular, the contract of employment contains:
A. Description of the field of teaching and research;
B. The amount of the initial salary;
3 It provides for the employer's participation in the purchase of years of insurance at the Federal Pension Fund (PUBLICA). 1

1 The contract of employment of the regular teachers and associated teachers is concluded for an indefinite period.
2 The contract of employment of assistant professors shall be concluded for a maximum period of four years. It is renewable once for at most four years. In the case of maternity, the contract may be extended for up to one year.
3 There is no trial period.
1 On the proposal of the President of the EPF, the EPF Council can guarantee to assistant teachers, at the time of their appointment, an open-ended commitment (tenure track) provided that they achieve certain objectives.
2 He appoints the assistant professors referred to in para. 1 Associate teachers at the end of their second period of employment, as soon as the evaluation proves that they have achieved the objectives assigned to them. He may exceptionally appoint them directly as ordinary teachers.
1 The EPF Council may, on the proposal of the President of the EPF, promote a professor associated with the rank of ordinary professor.
2 The proposal is accompanied by the results of the evaluation.
3 An associate professor may ask the President of the EPF to initiate the promotion procedure no sooner than two years after his appointment.
1 Teachers may terminate their work reports in accordance with the ordinary procedure, subject to six months' notice.
2 The termination shall be notified in writing to the President of the EPF, to the attention of the Council of EPF.
1 The EFP Council may terminate the working relationship of a professor at the request of the President of the EPF in accordance with art. 10, para. 3, LPers, subject to six months' notice. 1
2 Before submitting its application, the President of the EPF shall constitute a committee which shall decide on the desirability of termination and shall issue a recommendation. The committee shall consist of at least six members: three of them shall not be covered by the FIF concerned. Three of the six members are proposed by the Conference of the Teaching Body.
4 For teachers who have been at least 58 years of age and employed for 10 years in the FIF area at the time of dismissal according to para. 1 takes effect, but has not yet reached the age limit specified in s. 21 of the Federal Act of 20 December 1946 on old-age and survivors' insurance (LAVS) 3 , an old-age pension is paid in accordance with the Provident Scheme of 9 December 2007 of the EFA Fund for teachers of FIFs (RP-EPF2) 4 This old-age pension is calculated according to Art. 57 RP-EPF2 in the same way as a disability pension. The FIF pays to the Federal Pension Fund the portion of the non-funded pension at the time of termination of the employment reports. The transitional pension is not financed by the employer. 5

1 In the event of termination of employment reports without the fault of the teacher, the teacher shall be entitled to compensation.
2 The allowance is at least one month and a maximum of one year's salary.

2 They may retire early on as long as they are entitled, at the time of termination of their employment reports, to an old-age pension under the RP-EPF 2 2 . 3
3 The Professor and the President of the EPF agree in advance on the terms and dates of departure.
4 In duly justified cases, the EPF Council may exceptionally, on the proposal of the President of the EPF, agree with the teacher concerned that the latter's employment should be maintained beyond the age-limit defined in Art. 21 WASHERS.
5 Retired teachers can continue to provide free courses and use the general facilities of the school. The President of the EPF can entrust them with courses and other mandates, and put premises and equipment at their disposal at their request.

1 The EPF Council decides, on the proposal of the President of the EPF, whether regular teachers and associate professors are allowed to retain the title of EPF once they have left school. In order to retain their title, they must have worked for at least six years at the FIF. The EPF Council may derogate from this rule if it is in the interest of the EFA.
2 Assistant professors are not allowed to retain their title.
1 The initial salary agreed upon at entry is included between the minimum wage and the maximum salary of the category of the teacher concerned.

1 The EFP Council may grant allowances to teachers who carry out functions with decision-making authority within the FIF's management. Such allowances shall not exceed 15 % of the maximum amount according to Art. 16, para. 2.
2 The President of the EPF may grant allowances to teachers in charge of additional tasks, such as the direction of teaching and research units, the management of major projects or the chairmanship of important committees. 1 Such allowances shall not exceed the amount of the function allowance attached to the Vice-Presidency of the EFA.

The EPF Council agrees, on the proposal of the President of the EPF concerned, the salary and benefits of the employer with the teachers at the same time in several institutions, taking into account their obligations outside the FIF.
1 Teachers are entitled to reimbursement of expenses incurred in connection with their professional activities. The provisions of the order of 11 April 2002 concerning the reimbursement of costs in the field of FIF 1 Apply.
2 The EPF may reimburse newly appointed teachers for the transportation costs of their personal effects if the move is motivated by professional imperatives.

1 The EPF shall reimburse the costs of proceedings and judicial costs to the teachers involved in civil, administrative or criminal proceedings, or who are entitled to such a procedure by reason of their professional activity:
2 Only a guarantee of the assumption of costs shall be granted until such time as the decision is entered into force.
1 The professor is entitled to a full semester paid or to a partially paid year of research leave for a period of seven years of employment.
2 He or he must apply to the President of the EPF.
3 The decision to grant a research leave depends on the benefits provided by the teacher and the possibility of appropriate replacement.
The President of the EPF may grant leave without pay to a professor, as long as there is no interest in the EFA.
1 Any absence of more than one week due to illness or accident during the semester must be reported to the head of the relevant teaching and research unit.
2 Any absence of more than one week during the semester for any other reason must be authorized by the head of the relevant teaching and research unit.
1 In case of incapacity for work due to illness or accident, teachers are entitled to their full salary for a maximum of 730 days.
2 The right to pay can be reduced for the reasons provided by legislation and case law on health insurance and accident insurance.
3 An examination by the Medical Officer may be ordered to assess incapacity for work.
4 Mandatory insurance benefits are charged.
In the case of maternity, the teachers are entitled to a work stoppage and to their full salary for four months.
1 Professors on-demand for military service, civil protection and civil service are entitled to full salary for the duration of their absence.
2 In the case of voluntary service, the salary shall be paid up to a maximum of ten working days per year.
3 Benefits for loss of gain under the Act are paid to the FIF.
4 Maintenance allowances are paid without reduction.
1 Disability resulting from a professional accident or occupational disease equated with a professional accident gives the right:
2 Compulsory insurance benefits are charged.
1 In the event of the death of a teacher, survivors are entitled to one-sixth of the annual salary.
2 The person with whom the deceased professor has formed an uninterrupted life community for the last five years of his life is assimilated to the survivors.
3 The same rule applies to the payment of the allowance for assistance to relatives referred to in s. 31 B .

The limitation periods for the rights resulting from the working reports are based on s. 127 and 128 of the Code of Obligations 1 .

1 The term of office of ordinary and associate professors appointed as well as assistant professors shall end on 31 December 2003; all working reports shall be subject to the new right from 1 Er January 2004. Art. 38 is reserved.
2 On the proposal of the President of the EPF, the EPF Board submits before 15 January 2004 to ordinary teachers, associate professors and assistant teachers a written contract of employment according to Art. 8 LPers, with a signature period of at least two months.
3 If no written contract of employment complies with the provisions of Art. 7 of this Order no later than 30 June 2004, the Council of EPAs shall terminate the working reports before 31 December 2004, with effect no later than 30 June 2005, by a written contract of termination or by a decision. Art. 13 does not apply. 1
The applicable law shall apply without change until 31 March 2004 to the working reports of ordinary teachers and associate professors who retire on that date.
1 Rights and measures not provided for in the new right shall lapse on 1 Er January 2004 for all persons whose employment reports are subject to the new entitlement as of that date.
2 They remain valid for all persons whose service reports remain subject to the former right until they expire.
3 The years of determining service for the measures and rights under the old right shall be taken into account for the determination of the measures and rights under the new right, provided that the service reports under the former right are Continue without interruption or that the passage to the new NWPA work reports is done without interruption.
The duration of the previous service reports of assistant teachers shall be taken into account in the calculation of the maximum authorised duration of their employment.
