Implementing the Convention of 9 September 1996 on the collection, deposit and receipt of waste in Rhine and Inland Navigation

On 31 October 2007 (State 1 Er November 2009)

The Swiss Federal Council,

Pursuant to the Convention of 9 September 1996 on the collection, deposit and receipt of waste in the Rhine and Inland Waterways (Convention) 1 , given art. 29, 30, para. 2, 56, para. 2, and 58, para. 1, of the Federal Act of 3 October 1975 on Inland Navigation 2 ,

Stops:

Art. 1 Territorial Application

The Convention applies on the Rhine between the Swiss border (Basel-City) and the road bridge of Rheinfelden (Argovie).

Art. 2 Executing

The cantons of Basel-City, Basel-Country and Argovie are responsible for the implementation of the Convention and the present order.

Art. 3 Facilities under the Convention

1 The cantons are responsible for the development, operation and monitoring of the facilities necessary for the purposes of the Convention.

2 They may agree to leave the development and operation to the care of one of them.

3 Together, they are responsible for the development, operation and monitoring of the facilities.

Art. 4 Waste receiving stations and handling facilities

1 The cantons determine the number and nature of reception stations and the necessary handling facilities in Switzerland.

2 They adapt the Swiss network of reception and handling facilities according to the recommendations of the Conference of the Contracting Parties.

3 They list receiving stations and handling facilities and publish it on the Internet.

Art. 5 National Institution

1 The cantons set up a national institution (art. 9 of the Convention). They shall ensure that inland navigation is duly represented in this institution.

2 They enact the necessary implementing provisions and ensure, among other things, a fair distribution of contributions from international financial equalization.

Art. 6 International Mechanism for Equalization and Coordination

1 The national institution represents Switzerland's interests in the International Forum on Equalization and Coordination (IIPC).

2 Switzerland's share of the administration costs of the IIPC is borne by the Confederation.

Art. 7 Control Authority

1 The cantons designate an authority responsible for controlling the payment of disposal fees at the fuelling stations.

2 They can load the controlling authority from other monitoring tasks.

3 They shall enact the implementing provisions necessary to ensure a uniform system for the collection of disposal payments.

Art. 8 Conference of the Contracting Parties

The Swiss delegation to the Conference of Contracting Parties is made up of representatives of the Confederation, the competent cantons and inland navigation. Each party shall bear its own costs.

Art. Entry into force

This order shall enter into force with the Convention. 1
