747.224.26 order of execution of the agreement of 9 September 1996 relating to the collection, filing and reception of waste arising in Rhineland and navigation inside of October 31, 2007 (status on November 1, 2009) the Swiss federal Council, in application of the Convention of September 9, 1996, relating to the collection, filing and receipt of waste occurring in navigation Rhine and inner (Convention) , see the art. 29, 30, al. 2, 56, al. 2, and 58, al. 1, of the Federal Act of 3 October 1975 on inland navigation, stop: art. Territorial application of the Convention 1 applies on the Rhine between the Swiss border (Basel-City) and the road bridge in Rheinfelden (Aargau).
Art. 2 run the cantons of Basel-Stadt, Basel-Landschaft and Aargau are responsible for the execution of the Convention and of this order.
Art. 3 facilities provided by the Convention the cantons are responsible for planning, operation and monitoring of the facilities within the meaning of the Convention.
They can agree to leave the development and operation of one of them.
They assume all development fees, operating and monitoring facilities.
Art. 4 stations waste reception and handling facilities the cantons determine the number and the nature of the stations of reception and handling facilities in Switzerland.
They adapt the Swiss network of stations for receiving and handling facilities following the recommendations of the Conference of the contracting parties.
They draw up a list of the stations of reception and handling facilities and publish it on the Internet.
Art. 5 national institution the cantons implement a national institution (article 9 of the Convention). They ensure that inland navigation is duly represented in this institution.
They enact the necessary implementing provisions and ensure a fair distribution of financial equalization contributions from international including.
Art. 6 International Forum of Equalization and coordination the national institution represents the interests of the Switzerland in the bosom of the international forum of Equalization and coordination (IFCI).
The part of the Switzerland in the IFCI administration fees is supported by the Confederation.
Art. 7 control authority the cantons designate an authority to control the payment of remuneration to elimination in refuelling stations.
They can load the control to other tasks of monitoring authority.
They enact the enforcement provisions necessary to ensure a uniform regime of collection of payments of elimination.
Art. 8 conference of the contracting parties the Swiss delegation to the Conference of the contracting parties is composed of representatives of the Confederation, the competent cantons and inland navigation. Each party bears its own costs.
Art. 9 entry into force this order comes into force with the Convention.
