0.211.112.15 original text relating to the issue of a certificate of legal capacity to marry agreement in Munich on 5 September 1980 Instrument of ratification deposited by the Switzerland on 19 March 1990 entry into force for the Switzerland June 1, 1990 (status on June 27, 2013) the signatory States of the Convention, members of the International Commission on Civil status eager to establish common provisions for the issuance of a certificate of legal capacity to marry their nationals for the celebration of marriage abroad, having in mind the recommendation on the right of marriage adopted by the General Assembly of the International Commission of Civil status in Vienna on 8 September 1976, have agreed to the provisions following: art. 1. each Contracting State undertakes to issue a certificate of legal capacity to marry in accordance with the model attached to this agreement, when one of its nationals asking for the celebration of his marriage abroad and meets the conditions for this marriage under the law of the State that issues the certificate.

Art. 2. for the purposes of this Convention are assimilated to nationals of a Contracting State refugees and stateless persons whose personal status is governed by the law of that State.

Art. 3. all entries on the certificate are written in Latin characters; they can also be written in the characters of the language of the authority that issues the certificate.

Art. 4-1. Dates are written in Arabic numerals indicating successively under symbols Mo and Jo, year, day, month and year. The day and month are indicated by two digits, the year with four digits. The first nine days of the month and the nine months of the year are indicated by numbers from 01 to 09.
2. the name of any place referred to in the certificate is followed by the name of the State where this place is located, whenever this State is not the one whose authority issues the certificate.
3 are exclusively used the following symbols:-to indicate the male, the let. M, the female sex, the let. F; - to indicate nationality, the letters used to designate the country of registration of motor vehicles; - to indicate the status of refugee, the letters REF; - to indicate the condition of statelessness, the letters APA.

4. when a previous marriage has been dissolved, are mentioned in box 12 of the certificate name and the names of the last spouse as well as the date, the place and the cause of the dissolution. To indicate the cause of the dissolution are exclusively used the following symbols: - in the event of death, the letter D; - divorce, DIV letters; - in case of cancellation, the letter A; - in case of absence, the letters ABS.

Art. 5. If the competent authority is not able to fill a box or a part of box, this box or part of box is rendered unusable by lines.

Art. 6-1. On the face of each certificate the invariable mentions, excluding the symbols provided for in art. 4 with respect to the dates, are printed in both languages at least, whose language or one of the official languages of the State where the certificate is issued and the French language.

4. any translation must be approved by the Office of the International Commission of Civil status.

Art. 7. certificates are dated and bear the signature and seal of the authority which issued. Their validity is limited to a period of six months from the date of issue.

Art. 8-1. At the signing, ratification, acceptance, approval or accession, the Contracting States will indicate the competent authorities to issue certificates.
2. any subsequent changes will be notified to the Swiss federal Council.

The list of competent authorities can be obtained from the federal Office of civil status, 3003 Bern.

Art. 9. any changes to the certificate by a State must be approved by the International Commission of Civil status.

Art. 10. the certificates are provided of legalisation or any equivalent formality on the territory of each of the States bound by this Convention.

Art. 11. the present Convention will be ratified, accepted or approved and the instruments of ratification, acceptance or approval shall be deposited with the Swiss federal Council.

Art. 12-1. This agreement will be effective the first day of the third month following the deposit of the third instrument of ratification, acceptance, approval or accession.
2 with respect to the State which will ratify, accept, approve or adhere after its entry into force, the Convention will take effect the first day of the third month following the deposit by that State of the instrument of ratification, acceptance, approval or accession.

Art. 13. any State may accede to the present Convention. The instrument of accession will be deposited with the Swiss federal Council.

Art. 14. no reservation to this Convention is made.

Art. 15-1. Any State, at the time of signature, ratification, acceptance, approval or accession or at any time thereafter, may declare that the Convention will extend to all the territories which it liaises internationally, or to one or more of them.
2. this declaration shall be notified to the Swiss federal Council and the extension will take effect at the time of the entry into force of the Convention for that State or, later, the first day of the third month following that of the receipt of the notification.
3. any declaration of extension may be withdrawn by notification addressed to the Swiss federal Council and the Convention will cease to be applicable to the territory designated the first day of the third month following that of the receipt of the notification.

Art. 16-1. This agreement will remain in effect indefinitely.
2. any State party to this Convention, however, will have the faculty to report at any time after the expiry of a period of one year from the date of the entry into force of the Convention in respect. The denunciation shall be notified to the Swiss federal Council and will take effect the first day of the sixth month following that of the receipt of this notification. The Convention remains in force between other States.

Art. 17-1. The Swiss federal Council shall notify the Member States of the International Commission of Civil status and any other State which has acceded to this Convention: a) the deposit of any instrument of ratification, acceptance, approval or accession; b) any date of entry into force of the Convention; c) any statement concerning the territorial extension of the Convention or its withdrawal, with the date on which it takes effect; d) any denunciation of the Convention and the date on which it will take effect; e) any statement made under art. 8 2. The Swiss federal Council will notify the Secretary General of the International Commission of Civil status of any notification made under the by. 1 3. Upon entry into force of this Convention, a certified copy will be transmitted by the Swiss federal Council to the UN Secretary General for the purposes of registration and publication, in accordance with art. 102 of the Charter of the United Nations.

Done at Munich, on September 5, 1980, in a single copy in the French language, which will be deposited in the archives of the Swiss federal Council, and of which a certified copy will be given, through diplomatic channels, to each of the Member States of the International Commission of Civil status and the acceding States. A certified copy shall also be addressed to the Secretary General of the International Commission of Civil status.
