(OOPC)

See art. 32 E , para. 3, of the Act of 24 March 2000 on the Personnel of the Confederation (LPers) 1 ,

Art. 1 Purpose

This order regulates the composition, election and organization of the joint body of the Provident Fund of the Confederation (Joint Body).

Art. 2 Composition, term of office and election

1 The Joint Body shall consist of six representatives of employers and six representatives of employees of the administrative units referred to in Art. 2, para. 1, let. A, b, f and g, LPers, decentralised administrative units without legal personality or proper accounting, and decentralised administrative units with legal personality and proper accounting which are subject to The NWPA without an exemption under special legislation and without employer's qualifications within the meaning of s. 3, para. 2, and 37, para. 3, LPers.

2 The term of office of the members of the Joint Body is four years.

3 Only members of the joint body of the competent and qualified persons may be elected for the exercise of their management task. Gender and official languages must be equitably represented. It is possible to elect persons who are not insured with the Provident Fund of the Confederation.

4 Employers' representatives are appointed by the Federal Council, on a proposal from the Federal Department of Finance (DFF). The DFF consults with the Conference of Secretaries General, the Federal Court and the Services of Parliament.

5 The representatives of employees are elected by the delegates of the Provident Fund of the Confederation to the Assembly of delegates of PUBLICA. The delegates of the Provident Fund of the Confederation adopt an electoral regulation. 1

Art. 3 Organization and allowances

1 The joint body of the Provident Fund of the Confederation constituted itself.

2 The Chair consists of a representative of the employers and a representative of the employees. They exercise the Presidency and the Vice-Presidency for two years.

3 The Joint Body shall issue a regulation.

4 The allowances paid to the members of the joint body shall be fixed by the Board of the Fund of PUBLICA.

Art. 4 Secretariat

1 The secretariat is responsible for the smooth running of the business and liaises with PUBLICA.

2 It is administratively attached to the Federal Office of Personnel and works according to the instructions of the Joint Staff.

Art. 5 Funding

Payments to the members of the joint body and other costs, including secretarial costs, shall be financed from the investment income fund of the Confederacy Fund.

Art. 6 Amendment of the law in force

The amendment to the existing law is set out in the Annex.

Art. 6 A 1 Transitional provisions of the amendment of 25 June 2008

1 Employees' representatives are elected for the first time at 1 Er May 2011 by the delegates of the Provident Fund of the Confederation to the Assembly of delegates of PUBLICA.

2 If a representative of employees leaves the joint body before that date, the staff associations of the Confederation shall appoint a successor under the old right.

Art. 7 Entry into force

This order shall enter into force retroactively on 1 Er May 2007.
