e. for commercial use: any use of geodata base that does not use private; f. use intensity: level of at the same time and repeated use by the user; g. commercial services: services, products and similar services provided by units of public administration outside their official activity, competing with private sector suppliers; h. search service : Internet service allowing the search of geoservices and games of geodata, on the basis of corresponding geometadonnees; i. consultation service: Internet service to view, enlarge, reduce, move representable geodata games, to superimpose data, view the relevant content of geometadonnees and navigate the geodata; j. download service: Internet service to download copies of geodata sets or parts of these games and where it is possible to access directly; k. transformation service: Internet service allowing to turn games of geodata.

Art. 3 quality of the federal Office of topography data specifies the standards of basic geodata and the geometadonnees, in collaboration with other relevant specialized agencies of the Confederation. It takes into account for this purpose the State of technology and international standardization.
Basic geodata and the geometadonnees cannot be subject exclusively to other quality requirements if an Ordinance of the federal Council.

The federal Office of topography set the standard for the geometadonnees of basic geodata. It takes into account for this purpose the State of technology and international standardization.

Art. 18 access


The geometadonnees are made available to the public at the same time as the basic geodata they describe.
Access may be restricted if an order of the federal Council provides.
The competent specialized service ensures access to the geometadonnees.
The federal Office of topography ensures the interconnection of the geometadonnees.

Art. 19 update, check the geometadonnees is updated and archived with geodata base they describe.

In special cases or for some parts of the dataset in the general case, access is limited, delayed or refused, is he: a. hinders execution of concrete action taken by an authority in accordance with its objectives; b. risk of compromising safety inside or outside the Switzerland; c. could compromise the interests of the Switzerland or a canton on foreign policy and international relations; d. could adversely affect relations between the Confederation and the cantons or the relations between cantons; e. might jeopardize the interests of the political economic or monetary to the Switzerland; f. may be professional, business or manufacturing secrets; g. risk of breaking the obligation of secrecy set out in a special law.

Section 10 data exchange between authorities art. 37 access guarantee the service referred to in art. 8, al. 1, Geoig gives access to geodata from base to other services of the Confederation or the cantons, at their request.
It guarantees access to geodata of base via a download service. When this is impossible, it passes the data in a different form.

Art. 38 access denied the service referred to in art. 8, al. 1, Geoig denies access to geodata of base if: a. the level B or C is assigned to the geodata concerned and that the service applicant cannot invoke any public interest to access; b. access may endanger safety inside or outside.

Art. 39 data protection, confidentiality the recipient service is responsible for the compliance with the provisions relating to data protection and the maintenance of secrecy.
The broadcaster service informs the service recipient of the existence of special requirements.

Art. 40 transmission to third parties authority may give access to third parties to the basic geodata that she herself has access in accordance with section 8 and allow their use, regardless of any treatment, if: a. it apply the same requirements in terms of access and use that the service referred to in art. 8, al. 1, Geoig; b it states the news of geodata; c. she perceives the emoluments provided for and pay to the service referred to in art. 8, al. 1, Geoig.

a. estimate of the number and nature of the units of information exchanged; (b) compensation and financial aid of the Confederation; c. estimation of collected fees.

Art. 42aOrganisations international data exchange with international organizations on the basis of obligations under public international law is considered to be an exchange of data between authorities.
It gives rise to no billing, unless otherwise provided by international law.

Section 11 principles governing the collection of fees by the Confederation art. 43Champ of application the provisions of this section apply to all decisions and services which give rise to the collection of fees under the terms of this order.
They apply or the exchange of geodata base between authorities provided in art. 14 Geoig, or their use by authorities as part of their legal tasks. Art. 41 is reserved.

Art. 43aapplicabilite of the General Ordinance on fees general order of 8 September 2004 on the emoluments shall apply, unless otherwise provided by this order.

SR 172.041.1 art. 44Composition and calculation of the fees the fee due for the use of geodata base consists of the following: a. the fee base, possibly minus a discount (art. 45 to 45 c); b. the fixed costs of preparation; c. the variable costs of preparation; d. transport costs.

The basic fee is calculated: a. in the case of private use: by multiplying the number of units of information handed over by the unit price fixed by the tariff of fees of the Department; b. If it is for commercial use: by multiplying the number of units of information used in the final product by the unit price fixed by the tariff of fees of the Department and then multiplying the result by the number of products submitted as part of the use for commercial purposes.

Anyone who uses geodata of base for commercial purposes is liable for the basic fee due for such use, that used Basic geodata is obtained from the competent federal office or a third party.
Anyone who holds an authorization to use for commercial purposes and has no final product within a period of twelve months or longer than contractually, is responsible for the basic fee provided for by para. 2, let. a. new content according to chapter I of O from 18 nov. 2009, in force since Jan. 1. 2010 (2009 6189 RO).

Art. 45Rabais the tariff of fees of the Department may provide discounts based on: a. the intensity of use; (b) the duration of use; c. a particular kind of use; (d) the quantity of units of information; e. the turnover achieved.

Discounts are calculated by multiplying the basic fee by a discount factor. They can be combined, unless it comes to several discounts for different specific types of use.

Art. 45aRabais for private use a discount is granted if the functionality or usability of the basic geodata is reduced because of the intensity of their use for private purposes or their processing.
A special discount factor is applied to the subscribers.

Art. 45bRabais for use for commercial purposes a discount is granted if the importance, functionality or usability of the basic geodata is reduced in the final product because of the intensity of their use for commercial purposes or their processing.
The following discount coefficients are applied based on the use concerned commercial. Thus, if the user: a. is an institution or organization of public utility that are exempt of tax that uses data as part of its statutory activity: 0.5; b. is a public training institution or recognized by the State that uses the data within its mandate of training: 0.5; c. uses the data for resale exclusively: 0.5 to 0.7; d. uses data as a teaching material : 0.5; e. uses the data for transmission to subscribers: 0.3.

Art. 45cRabais based on the quantities and turnover of the quantity discounts are granted based: a. the number of units of information; b. draw; c. the number of transactions.

A discount to the turnover achieved by calendar year is granted for the resale of products of edition.
Discounts provided for by para. 1, let. a and c, cannot be combined.

Art. fixed 45dFrais of preparation the following fees are collected in respect of the fixed costs of preparation: a. preparation in analog or digital form, not connected to a network (offline): 50 francs at most for each order registered; b. preparation in digital form, connected to a network (online): 30 francs at most for each saved command or 3000 francs per year for each connection.

Art. variable 45eFrais of preparation the following emoluments are perceived as variable of preparation costs when the preparation is not connected to a network (offline): a. support analog or digital: cost price per unit; b. media description: 20 francs at 500 francs per unit; c. packaging and shipping: 5 francs to 25 francs a shipping unit.

A fee is perceived as variable of preparation when the preparation is connected to a network (online), which is set according to the tariff of fees of the Department.
A package can be agreed by contract with subscribers or users for business purposes for a fixed number or unlimited of units of information or for a number of uses of a geoservice.

Art. 45fFrais of transport port is billed according to the rates of the post Switzerland.
The real transport costs are charged if, for technical reasons or to respond to the wish expressed by the author of the command, the transport is supported by other providers of transport services.

Art. 46Emoluments flat flat fees are charged for: a. analogue maps and atlases; b. some cases individuals of publication of basic geodata; c. software; d. the reports and the studies; e. official communities directory; f. official benefits under the holdings or geological information services; g. changes the permissions or licenses; h. the approval procedure a posteriori (art. 27); i. the decision of destruction or confiscation (art. 33).

Are seen in addition to the flat-rate fee: a. the fixed costs of preparation provided for by art. 45 d; b. the packing and shipping costs provided for by art. 45th, al. 1, let. c; c. transport costs provided for by art. 45f. other provisions of the art. 45f 44 do not apply.

Art. 46aTarifs of fees the Department enacts a tariff of fees. It defines the unit prices of the basic fee, the coefficients of discount, fees for the preparation and flat fees.

Art. 47 exemption are exempt from any fee for the use of the geodata base of the Confederation, with the exception of the costs of preparation and distribution: a. public training institutions of the Confederation, cantons and municipalities, for private use; b. research institutions of the Confederation and the cantons, for use; c. the tax exempt non-profit organizations , for any use except for the transmission to third parties.

The use of data from the national land survey map is exempt from any fee in the following cases: a. data undergo deep transformations and their export is proven; forgotten the source. the data undergo deep transformations from abroad and they are marketed.

A fee may be charged in the cases referred to in para. 1 if applications access and use: a. are manifestly absurd, unfair or querulantes; b. involve very heavy treatment, for example research, specific types of reproduction or a specific electronic processing.

Section 12 Coordination, participation art. 48 coordinating body a body of coordination within the meaning of art. 55 of the Act of 21 March 1997 on the Organization of Government and administration was established to coordinate the field of geo-information at the federal level.
It accomplishes the following tasks: a. coordination of the activities of the Federal Government; b. development of federal strategies; c. participation in the development of standards techniques; d. management of a center of competence; e. the cantonal Council.

It is empowered to give directions to the services of the federal administration.
It consists of at least one representative of each Department of the Federal Chancellery, the federal institutes and the federal Office of topography. Each of these authorities itself designates its representatives.
It is administratively subordinated to the federal Office of topography and has its own operational centre.

SR 172.010 art. 49 identifier a unique digital identifier is assigned to all the geodata base. The identifier is defined in Appendix 1.

Art. 50 participation of the cantons, the Confederation organizations hearing guarantees the participation of the cantons and the hearing of the partner organizations of desirability in the preparation of technical standards and other prescriptions of the Confederation which fall within the scope of application of the Ordinance and are not limited to the Federal Government.

Section 13 offences art. 51 illicit behaviour, criminal prosecution is punished with a fine of 5,000 francs at most, anyone: a. procures on its own behalf or that of third one illicit access to geodata of base; b. uses of basic geodata and geoservices without permission; c. sends the geodata base without permission; d. contravene requirements of use, especially in the indication of the source.

The prosecution is the responsibility of the cantons.

Section 14 provisions final art. 52 amendment of the law in force the change in the law in force is regulated in Schedule 2.

Art. 53 transitional provisions within five years from the date of entry into force of this order is granted to the cantons for the implementation of art. 3, 8 to 19 and 34 to 36. If the order refers to technical standards and prescriptions that are not yet available at the entry into force of this order, the transition period from the date on which they are communicated to the cantons.
For geodata of base reproducing restrictions of public right to land ownership, the art. 25 to 30 of the Ordinance of 2 September 2009 on the cadastre of public right to land ownership restrictions apply.
The following transitional periods are set for the passage of the systems and planimetric CH1903/LV03 CH1903 + reference frameworks / LV95: a. for the conversion of the reference data, until December 31, 2016; (b) for the conversion of the other basic geodata, until December 31, 2020.

Art. 4, al. 1, let. a ceases to be in force January 1, 2021.

Art. Transitional 53aDispositions for the change of November 18, 2009 the rules that applied in fees before the entry into force of this amendment remain valid for authorisation procedures pending.
The other contracts in progress at the date of entry into force of the amendment, governing the use of geodata base and geoservices and the fees to be paid in return, remain valid until the end of the agreed period, at the latest however until 31 December 2014.
