Treaty prohibiting the testing of nuclear weapons in the atmosphere, in cosmic space and under water

The Governments of the United States of America, the United Kingdom of Great Britain and Northern Ireland and the Union of Soviet Socialist Republics, hereinafter referred to as "originating parties",

Proclaiming that their main objective is to achieve, within the quickest time frame, an agreement on general and complete disarmament under strict international control, in accordance with the purposes of the United Nations, an agreement that would terminate To the arms race and to cease all incitement to the production and experience of all types of weapons, including nuclear weapons,

Seeking to obtain the cessation of all nuclear weapon test explosions forever, determined to continue the negotiations to that end and desiring to put an end to the contamination of the human environment by substances Radioactive,

Have agreed as follows:

Art. I

1. Each party to this Treaty undertakes to prohibit, prevent and refrain from carrying out any experimental explosion of nuclear weapons, or any other nuclear explosion, in any place under its jurisdiction or control:

A.
In the atmosphere, beyond its limits, including cosmic space, or underwater, including territorial waters or the high seas; or
B.
In any other place if such an explosion causes radioactive waste to fall outside the territorial limits of the State under the jurisdiction or control of which the explosion occurred. It was agreed that the provisions of this sub-paragraph would not prejudice the conclusion of a treaty permanently banning all nuclear experiments, including all underground explosions, which were dealt with at the conclusion of the treaty. Which the parties, as they have declared in the preamble to this Treaty, shall endeavour to achieve.

2. Each of the parties to this treaty undertakes to refrain from provoing, encouraging or participating in any way in the execution of any experimental explosion of nuclear weapons, or any other nuclear explosion, which Would take place anywhere in the places mentioned above or that would have the consequences mentioned in subs. 1 of this article.

Art. II

1. Each party may propose amendments to this Treaty. The text of any proposed amendment shall be communicated to the depositary Governments which will transmit it to all parties to this Treaty. If a third party or more of the parties so requests, the depositary Governments shall convene a conference, to which all the parties will be invited, to consider this amendment.

2. Any amendment shall be approved by a majority of the votes of all the parties to this Treaty, including those of all the originating parties. The amendment will enter into force for all parties upon the deposit of instruments of ratification by a majority of them, including the instruments of ratification of all the originating parties.

Art. III

1. This Treaty shall be open for signature by any State. Any State which has not signed this Treaty before its entry into force, as per s. 3 of this article, may accede to it at any time.

2. This Treaty shall be subject to ratification by the signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the originating parties-the United States of America, the United Kingdom of Great Britain and Northern Ireland and the Union of Socialist Republics The Soviet Union-which are, by this Treaty, designated as depositary Governments.

3. This Treaty shall enter into force after its ratification by all the originating parties and after the deposit of their instruments of ratification.

4. For States whose instruments of ratification or accession are to be deposited at a later date upon entry into force of this Treaty, the latter shall enter into force on the date of the deposit of their instruments of ratification or accession.

The depositary Governments shall promptly inform all signatory States and members of the date of each signature, of the date of deposit of each instrument of ratification of this Treaty and of accession to it, of the date of its entry into And the date of receipt of any request for conferences or other communications.

6. This Treaty shall be registered by the depositary Governments in accordance with Art. 102 of the United Nations Charter 1 .


Art. IV

This Treaty will have an unlimited duration.

Each party, in the exercise of its national sovereignty, will have the right to withdraw from the treaty if it decides that extraordinary events, in relation to the subject matter of this treaty, endanger the supreme interests of its country. It will have to notify all other parties to this Treaty with three months' notice.

Art. V Scope of application 6 October 2009

This treaty, of which the English and Russian texts are equally authentic, will be deposited in the archives of the depositary Governments. Certified copies will be transmitted by the Depositary Governments to the Governments of the signatory and acceding States.

In witness whereof, The undersigned, duly authorised, have signed this Treaty.

Done at Moscow, in triplicate, on the fifth of August, nine hundred and sixty-three.
