Introductory provisions



Article 1 this regulation lays down provisions on a carrier the right to compensation for the costs which he has had for identity checks carried out in accordance with the regulations, which the Government has notified pursuant to section 3 of the Act (2015:1073) on special measures in the case of a serious danger to public policy or internal security of the country.



The terms used in this regulation have the same meaning as in the Act on special measures in case of serious danger to public order or internal security of the country and in the regulations that the Government has communicated with the support of the law.



section 2 of this regulation is notified pursuant to Chapter 8. section 7 of the Constitution.



Receivers and conditions paragraph 3 of the compensation is payable to the carrier.



4 section compensation is provided, subject to availability of funds, for reasonable costs that a carrier has held for identity checks carried out in accordance with the regulations, which the Government has notified pursuant to section 3 of the Act (2015:1073) on special measures in the case of a serious danger to public policy or internal security of the country.



Compensation is payable only for expenses incurred during the period of validity of such provisions referred to in the first subparagraph.



Application and decision



section 5 an application for compensation shall be submitted to and examined by the Transport Department. Application for compensation must be made in writing on a form the Transport Department provides.



section 6, an application for compensation must be submitted to the Transport Department at the latest within the time limit set by the Transport Department decides.

Time, however, must not be longer than nine months from the expiry of the provisions the Government has notified pursuant to section 3 of the Act (2015:1073) on special measures in the case of a serious danger to public order or internal security in the country has expired.



section 7 When the application period referred to in paragraph 6 has expired, the Transport Department to examine all the applications received.



If the funds available are less than the amount of compensation that may be awarded, should compensation be reduced equally for all to be awarded compensation.



The Transport Department is paying out the compensation.



§ 8 the applicant for compensation shall, at the request of the Transport Department within certain period of time as the piece determines the additional information necessary for the examination. If the applicant does not comply with such a request, the application is tested as is.



Refunds and chargebacks



§ 9 the compensation is owed repayment of 1. This, by submitting false declarations, have caused that compensation granted improperly or with excessive amounts, or



2. compensation for any other reason has been granted improperly or with excessive amount and the recipient reasonably should have known this.



The amount is interest rate (1975:635) is paid.



If someone is liable to repay, to the Transport Department decide to fully or partially recover compensation plus interest. If there are special reasons, the Transport Department may decide to reduce the amount of the interest the claim in whole or in part.



Authorization



section 10 of the Finnish transport agency may provide for the enforcement of this regulation.



Appeal



section 11 of the 22 a of the Administrative Procedure Act (1986:223) there are provisions for appeal to the administrative court. Other than a decision under section 7 may not be appealed.



Transitional provisions



2016:1264



1. this Regulation shall enter into force on 11 January 2017.



2. Compensation under regulation provided, however, for the period from 4 April 2016.
