Annex
Exemption under section 1, second subparagraph the nuclear liability Act (1968:45)
from the application
Definitions
1. With the "transport rules" referred to in this annex, international
Atomic Energy Agency (International Atomic Energy Agency, IAEA)
safety rules for the transport of radioactive material
("Regulations for the Safe Transport of Radioactive
Materials ").
2. The expressions "(A) 2", "fissile material" ("Fissile material") and
"radioactive materials of special nature" ("Special Form
Radioactive Material ") has the following the meaning of
section 1 of the 1973 revised edition of transport regulations.
Exception
The following Atomic substances are exempt from the nuclear liability Act
application under the conditions set out in the following.
A. Nuclear substance as the holder of a nuclear plant in Sweden
or in another State party transmit to a receiver for
utilization, during the time when the matter is outside the
Atomic plant.
Exception applies if the conditions during 1-4 below are met, then
exit from the facility and other relevant provisions of
the edition of transport regulations in effect at the same time
have been complied with.
Conditions applicable to all radionuclides
1. The overall activity of the contents of a shipment of a
radionuclide or multiple radionuclides, belonging to the same group shall not
exceed the following values:
Set-up is not included here.
Note: for the purposes attributed a radionuclide whose identity
is not known to the Group 1. In the case of A 2-values refer to
section IV in the 1973 revised edition of transport regulations.
2. The total activity in a consignment of radionuclides is
radioactive materials of special nature must not exceed 500
Curie (18.5 terabecquerel).
3. For consignments containing
both radioactive materials of special nature and other things
radioactive material, or
radionuclides which belong to different groups
the following applies:
The sum of the quotients obtained by dividing each nuklids
task number with the maximum amounts applicable under 1 and 2 shall
not exceed 1. Is the activity of one or more of the
radionuclides are not known, the number indicating the total activity
of these nuclides is divided by the lower of the maximums that apply to
for any of them is not the activity of any of these nuclides
known, the total activity in the consignment exceed the
lowest maximums that apply to any of these.
Additional terms and conditions that apply to fissile material
4. in the case of consignment of fissile material, the conditions in 1-3 above
having been complied with mutatis mutandis with either
(a)) regulations in Division C 5 of the 1967 revised edition of
transport regulations for nuclear safety class I and II, except in
cases referred to in section C 5.1.2 in the same edition of
transport rules, or
(b)) the provisions of section VI of the 1973 revised edition of
transport regulations for nuclear safety class I or II, except in
cases referred to in Section 601 in the same edition of
transport regulations.
In addition, the following conditions shall be satisfied in respect of the amount of
fissile material:
(a)) where the consignment contains only one of the nuclides of plutonium-239,
plutonium-241, uranium-233 or uranium-235, the amount does not exceed
375 g of the nuclide Pu-239
375 g '' '' Pu-241
375 g ' ' ' ' U-233, or
600 g ' ' ' ' U-235.
(b)) if the consignment contains several of the nuclides listed under (a)),
gets the sum of the quotients obtained by dividing the number of grams of
each nuclide with the maximums as referred to under (a)) is applicable not
exceed the number 1.
B. Atomic substance that essentially consists of uranium
Exception applies if the conditions under 1 and 2 below are met.
1. The total activity per gram of substance with regard to all
other radioactive isotopes other than those of uranium isotopes that are commonly included in
natural uranium or uranium isotope products such subsidiary shall
do not exceed
a) 200000 Alpha decay per minute from all isotopes that emit
Alpha radiation, and
b) 20 mikrocurie (0.74 megabecquerels) of all isotopes that emit
Beta or gamma radiation.
2. The amount of the isotope uranium-235 must not exceed 1% of the
total quantity of all uranium isotopes in substance.
