Investigative authority



1 § Investigations under the Act (2007:606) concerning investigations concerning

some deaths are conducted by the National Board of health and welfare

(investigating authority). Regulation (2011:1114).



Conduct of investigations



section 2 of the Investigative Authority shall consult



1. the relevant investigating leaders or prosecutors,

supervisory authority and the person who brought the private prosecution or legal proceedings

If individual claims in respect of criminal offences to ensure

the investigation is carried out in such a way that it does not

causes but for a criminal investigation, a trial or a

case of oversight, and



2. Police and prosecutors to clarify whether a

deaths occurring abroad will be investigated.

section 3 of the investigating authority may request that the Government offices

(The State Department) leaves help to acquire disclosures

that are relevant to an investigation under the Act (2007:606) if

investigations relating to certain death.



Reports for information that originates in from people who

staying abroad and other measures that have been taken with

reason of the investigating authority shall promptly be sent

to the investigating authority. Regulation (2011:1114).



section 4 an investigation should be dealt with promptly. An investigation that has

completed may be resumed if the new circumstances

likely to be relevant to the investigation results.



Report on investigative activities



paragraph 5 of the Investigative Authority shall every two years completing a

report on investigative activities. Report shall be submitted

to the Government by 31 January of the year following

completion and the authority shall also otherwise

publish the report.



paragraph 6 of the report should contain



1. a statement of the scope,



2. the conclusions of the investigation function has given rise

to, and



3. any proposal for action that prevents child father

bad or men and women exposed to violence or other

abuse by relatives or former connected persons.



The report shall be designed in such a way that it does not provide

rise to presumption of guilt or liability in connection with a

death, nor to persons that are present in

case files can be identified. Regulation (2011:1114).



Transitional provisions



2007:748



1. This Regulation shall enter into force on 1 January 2008.



2. The first report pursuant to paragraph 5 shall be submitted to the

Government by 31 January 2010.
