Scope and content
section 1 of this Regulation shall apply to such toys covered by
Act (2011:579) on the safety of toys. Regulation
also contains provisions on market surveillance
complementary to European Parliament and Council Regulation (EC) no
765/2008 of 9 July 2008 setting out the requirements for accreditation and
market surveillance relating to the marketing of products and
repeal of Regulation (EEC) No 339/93.
Terms and expressions used in the Act on the safety of toys
has the same meaning in this regulation.
Exemptions from the scope
section 2 of the Consumer Authority may provide that the law
(2011:579) on the safety of toys is not to apply to certain
toys or goods which may be perceived as toys.
Requirements on the content of a power of Attorney
section 3 of the Consumer Authority may provide for the requirements

manufacturer appoints a representative.
Particular safety requirements

Traceability
section 11 of the Consumer Authority may provide for economic
operators ' obligations with respect to
1. information that you want to accompany the toy and relating to
a) identification of the toy, and
b) information on the manufacturer and the importer, and
2. documentation necessary for tracing the origin of
toys which they supply or have supplied.
Loss prevention
section 12 of the Consumer Authority may provide for manufacturers
and importer's obligations to conduct a damage prevention
work in order to become aware of the injury risks in toys
they have provided.
Market surveillance authorities
paragraph 13 of the Consumer Agency exercises market control according to law
(2011:579) on the safety of toys, to the extent that any
subject to section 14 or 15.
section 14 of the Chemicals Inspectorate exercises market control according to
Act (2011:579) on the safety of toys when it comes to
Toy flammability and chemical properties.
section 15 of the National Electrical Safety Board exercises market control according to law
(2011:579) on the safety of toys when it comes to toy
electrical characteristics other than radiation.
section 16 of the market surveillance authorities shall coordinate their actions

Market surveillance in accordance with Regulation (EC) no 765/2008

5. cooperate with other pursuant to article 24(4).
Market surveillance authorities may destroy or
otherwise make toys unusable under article 29(4) of the same
Regulation.
Compensation
section 19 of an economic operator shall replace the
market surveillance authority for the cost of sampling and
examination of samples, if the toy does not control
meets the safety requirements laid down in paragraphs 9 and 10 of the law (2011:579)
on the safety of toys, and according to the regulations on the Special
safety requirements has been issued under section 4, 5 or 6

An economic operator shall receive compensation from
market surveillance authority for product samples and the like, if

Transitional provisions
2011:703
1. This Regulation shall enter into force on 20 July 2011, when
Regulation (1993:971) concerning the safety of toys is repealed

2. The repealed regulation continues to apply in respect of
toys placed on the market before entry into force.
