Introductory provision



section 1 of this Act aims to promote and stimulate the market

for clean and energy efficient vehicles and to improve

Transport's contribution to the European Union's common

environment, climate and energy policy.



The scope of the law



section 2 of this Act shall apply in the case of procurement under the Act (2007:1091)

If the public procurement Act (2007:1092) on procurement

in the water, energy, transport and postal services, if

the contract relates to



1. the purchase or leasing of cars, or



2. purchase of passenger transport services provided by a

public transport operators in the context of a public

traffic.



The law does not apply to the purchase or leasing of vehicles



1. designed and constructed for use by

The armed forces, civil defence, emergency services, or

the forces of law and order, or



2. used exclusively within the fenced-off rail, industrial

or competition areas or other similar fenced areas.



section 3 of the Act does not preclude a contracting authority or

drive puts other or more extensive claims for the Contracting

product or service than that provided for by this law.



Definitions



section 4 of this Act means



vehicle: a vehicle in section 2 of the Act (2001:559) if

road traffic definitions are designated as car, bus or

truck,



lease: lease with a specific rental period of at least one year, and



life: the period of time that usually can be estimated to elapse

from the time a car is purchased until it is taken out of operation.



Other terms and expressions used in this law have the same

meaning as in the Act (2007:1091) on public procurement and

Act (2007:1092) on procurement in the water, energy,

transport and postal services.



§ 5, With public transport operators, public service obligations and contracts for

public services are the same as those of the European Parliament and of the

Council Regulation (EC) No 1370/2007 of 23 October 2007 on the

public passenger transport services by rail and by road and repealing Council

Regulation (EEC) No 1191/69 and (EEC) No 1107/70.



How the energy and environmental impacts to be taken into account



section 6 of the contracting authorities and entities shall, whether the

use of technical specifications or a criterion

for the award of a contract (award criteria), when they

conducting procurement covered by this law, take into account

the energy and environmental impacts when operating during the car's entire

service life.



section 7 If the contracting authority/entity chooses to

take into account lifetime energy and environmental impacts referred to in paragraph 6 as an

award criterion, operational costs during the car's entire

life for energy use and emissions of carbon dioxide,

nitrogen oxides (NOX), non-methane hydrocarbons (NMHC) and particulate matter

converted to a sum of money.

Act (2007:1092) on procurement in the water, energy,

transport and postal services.



Provisions relating to the award criteria can be found in Chapter 12. 1 and

Transitional provisions



2011:846



This law shall enter into force on 1 July 2011, but does not apply to

contracts that have been initiated before the entry into force.
