Introductory provision



Article 1 this regulation lays down provisions on State aid

for special education support and special

educational efforts. The purpose of the grant is to facilitate

studies for people with disabilities.



State aid should be provided on the availability of funds.



Conditions for State aid



2 § State aid under this Regulation may be submitted to

folk high schools for the costs of special education aid

offered to students with disabilities.



State aid may also be provided to universities and colleges for

costs for special educational support offered to students

with severe disabilities or psychiatric and neuropsychiatric

disabilities.



section 3 special education aid under paragraph 2 shall include all

functions that belong to the daily way of life as the

students do not manage itself and that should not be met

by the municipality or insurance fund or by other

support measures for universities, high schools and folk high schools.



4 § State aid under this Regulation may also be submitted to the

folk high schools for the costs of special education

at a folk high school for students with disabilities.



With costs for specific training measures referred to

costs for education and for actions in connection with

training.



Applications and decisions on State aid



section 5 an application for State aid is given to the special needs

Education Office that examines questions about the grant. In the calculation

of the grant, the authority shall have regard to whether the change of Government grants

provided otherwise for the particular training aid or

the specific educational or municipal grants

be given for the aid or the stakes.



In a decision to grant a contribution will be the last day for

report pursuant to paragraph 6 of the stated. The decision may be subject to

terms and conditions. The conditions shall be set out in the decision.



Accounting



section 6 of The who have received Government grants under this regulation

is required to provide such financial and other reporting

to special needs education which authority requests.



An auditor shall examine the financial report and

give an account of his observations in a declaration annexed to the

General Ledger. If the contributions received amounted to

at least five price base amounts according to Chapter 2. 6 and 7 § §

social insurance code, this shall be done by an authorized

or certified public accountant.



Refunds and chargebacks

is the repayment obligation, if



1. the receiver by providing incorrect information or

any other way has caused that the contribution has been provided

improperly or with excessive amounts,



2. the grant of any other reasons have been given incorrectly, or

with the high amount and the recipient should have known this,



3. the recipient does not submit such a report referred to in paragraph 6,

or



4. the refund has not been used for the purpose for which it has been granted

for.



Special needs education shall decide to fully or

partially recover a contribution if someone is

the repayment obligation referred to in the first subparagraph.



If there are special reasons for it, the Agency may exempt

from recoveries in whole or in part.

chargebacks have been made, and after an interest rate at each

time exceeds government lending rate with two

percentage points.

Appropriations

Appeal



paragraph 10 of the Decision pursuant to this Regulation may not be appealed.



Transitional provisions



2011:1163



This Regulation shall enter into force on 1 January 2012, when

Ordinance (2005:1074) on State contributions to particular

training support shall be repealed. Older regulations

still apply for refunds which have been granted before the

January 1, 2012.
