Introductory provisions



Article 1 this regulation lays down provisions concerning the placing on the

market and the departure of some species of fish and fish products

thereof originating in the Baltic region.



section 2 of the Fish species covered by this regulation are wild



1. salmon (Salmo salar),



2. Baltic herring (Clupea harengus) larger than 17 cm,



3. Char (Salvelinus spp.),



4. flodnejonöga (Lampetra fluviatilis) and



5. trout (Salmo trutta).

1. waters of ICES statistical subdivisions 24-32 (BAL 24 – BAL

32) as described in annex III to European Parliament

and Council Regulation (EC) No 218/2009 of 11 March 2009 on the

submission of nominal catch statistics from

statistics by Member States fishing in the North-East Atlantic and



2. Swedish internal water pursuant to lagen (1966:374) on Sveriges

's territorial waters with the exception of the interior waters of Kattegat and

The Skagerrak.

The placing on the market



4 § the on the Swedish market

fish species covered by this regulation and fish products

thereof originating in the Baltic region which are intended for

consumption within the country and containing higher levels of

dioxins or dioxin-like PCBs and non-dioxin-like PCBs than those

limit values set out in point 5.3 of the annex to Commission

Regulation (EC) No 1881/2006 of 19 december 2006 concerning

the fixing of maximum levels for certain contaminants in

foods.



Export to countries that are members of the European Union



5 § Wild salmon and fish products originating in

The Baltic Sea region may be brought out to the other countries of the European

Union than Finland and Latvia only if the fish or

fish products meet the requirements of point 5.3 of the annex to

Commission Regulation (EC) No 1881/2006.



Other wild fish covered by this regulation and

fishery products originating in the Baltic region may be brought

out to other countries in the European Union than Finland only

If the fish or fish products meet the requirements of paragraph 5(3) of

the annex to Commission Regulation (EC) No 1881/2006.



Penalty



section 6 of the Regulations for the export of fish and

fish products and try to export in violation of this

Regulation or regulations adopted pursuant to this

Regulation Act (2000:1225) of punishment for smuggling.



Notification obligation



section 7 of the food and Drug Administration suspects that a criminal

infringement of this regulation or of any provision

granted under this regulation has been, to this

be notified to the Customs and Excise Department.



Appropriations



paragraph 8 of the food and Drug Administration may announce details relating to what

that will be required for the export of fish and fish products

be considered as permitted under section 5.



The National Food Administration may announce the additional measures

necessary for the implementation of this regulation.
