The scope of the law
section 1 of this Act contains provisions which complement
European Parliament and Council Regulation (EC) No 994/2010 by
20 October 2010 on measures to safeguard security of
of gas supply and repealing Council directive
2004/67/EC;
Definitions
section 2 of the terms and expressions defined in the natural gas Act
(2005:403) has the same meaning in this Act.
Competent authority
section 3 of The Government authority determines jurisdiction
authority according to Regulation (EU) No 994/2010.
Business plans
section 4 of the Government or the authority, as the Government determines
may provide for an obligation for natural gas undertakings and
companies that use natural gas to establish and follow a
preventive action plan and an emergency plan for the company's
business (business plans).
Supervision
§ 5 the competent authority supervises the
1. Regulation (EC) No 994/2010 and the action plans and
emergency plans drawn up under the regulation are complied with, and
2. this law and the regulations issued in connection
the law is followed.
section 6, the competent authority shall have the right to request the
information and to obtain the documents necessary for
supervision.
The Government or the authority that the Government may
provide for the obligation to provide the information
needed to enable the competent authority to carry out
its tasks pursuant to Regulation (EC) No 994/2010 and this
team.
paragraph 7, the competent authority may notify the injunctions
needed to ensure that the regulations and plans
subject to supervision are observed. An injunction may be subject to
liquidated damages.
An order effective immediately, unless otherwise
be decided.
Fees
section 8 Government or authority the Government determines
may provide for fees to finance the
data by the competent authority in accordance with regulation
(EC) No 994/2010 and in accordance with this Act and regulations
in connection with the Act.
Appeal
§ 9 a decision notice under section 7 may be appealed to the
General administrative courts.
Leave to appeal is required in case of appeal to the administrative law.
