Chapter 1. Scope of application



section 1 of this regulation is notified pursuant to Chapter 8. 7 §

the Constitution in terms of Chapter 8. paragraph 4 and 10. 2 § 1 and 2

and otherwise, with the support of 27 Cape. section 1 of the environmental code.



The regulation applies to the fees payable for examination and

supervision of pesticide under



1. European Parliament and Council Regulation (EC) No 1107/2009

of 21 October 2009 concerning the placing of plant protection products on the

the market and repealing Council Directives 79/117/EEC and

91/414/EEC, in wording pursuant to European Parliament and Council

Regulation (EU) No 652/2014;



2. European Parliament and Council Regulation (EC) No 528/2012

of 22 may 2012 if the making available on the market and

the use of biocidal products, in wording as

European Parliament and Council Regulation (EC) No 334/2014;



3. the Ordinance (2000:338) on biocidal products containing

nematodes, insects or Arachnids,



4. the Regulation (2006:1010) on plant protection products containing

nematodes, insects or Arachnids, and



5. Regulation (2014:425) on pesticides.

paragraph 2 of this regulation,



chemical pesticides: a chemical product that is a

plant protection products pursuant to Regulation (EC) No 1107/2009;



biological plant protection products: a biotechnical organism that is a

plant protection products pursuant to Regulation (EC) No 1107/2009, and



biocidal product: a biocidal product pursuant to Regulation (EC) no

528/2012.



In other words this regulation has the same meaning as in 14

Cape. the environmental code. Regulation (2015:47).



Chapter 2. Fees for examination of chemical plant protection products



section 1 Of the Swedish Chemicals Agency, and the national food administration

agricultural plant examination of applications for approval,

waivers and parallel trade permit in case of chemical

plant protection products pursuant to Regulation (EC) No 1107/2009 is a

the application fee paid pursuant to this chapter.

The application fee is composed of a basic fee and in some cases

of one or more additional fees.



A charge under section 7 is preliminary. Such a fee

establishes the final according to Chapter 9. 2 §. Other fees according to

This chapter is the final charges.



Fee for approval



section 2 of the applicant for an authorisation of a chemical

plant protection products shall, subject to the provisions of section 13 or 14,

pay a basic fee



1. with 120 000 SEK, if another Member State than Sweden

is the Member State in accordance with article 35 of regulation

(EC) No 1107/2009;



2. with 120 000 kroons, if the application concerns a mutual

recognition under article 40 (1) (a) or (c) of Regulation (EC) no

1107/2009;



3. with 140 000 kroons, if the application concerns a mutual

recognition under article 40 (1) (b) of Regulation (EC) no

1107/2009;



4. with 170 000 kroons, if the application concerns a mutual

recognition under article 40 of Regulation (EC) No 1107/2009

and an assessment shall be made under article 41(2)(b),



5. with 140 000 kroons, if the application concerns a mutual

recognition and the application is based on an authorisation which has

granted by another Member State under the provisions

force before 14 February 2011,



6. with 60 000 kroons, if the application concerns the approval of a

funds with low risk according to article 47 of Regulation (EC) no

1107/2009;



7. with the 350 000 kroons, if the application relates to an approval

shall be assessed in accordance with article 50 of Regulation (EC) no

1107/2009;



8. with 350 000 kroons, if the application relates to an approval

should be examined in the light of all the zones in the European Union

and Sweden is the Member State,



9. with 420 000 kroons, if the application relates to a temporary

the approval referred to in article 30 of Regulation (EC) No 1107/2009;

and



10. with 300 000 SEK in other cases.

§ 5 If the Food Administration in a case under section 2 shall assess

the residues of the plant protection product, the applicant shall pay a

additional fee



1. by 15 000 kroons in the case of an application referred to

in paragraph 2 of 6;



2. with 30 000 kroons in the case of an application referred to

in section 2 of the 1, 2, 3, 4 or 5, and



3. with 60 000 kroons in the case of an application referred to

in section 2 of the 7, 8, 9 or 10.

Regulation (EC) No 1107/2009, and



2. the applicant is not entitled to invoke the documentation

Fee for amended approval

3. with 40,000 dollars for each use or conditions of

use that does not need to be examined in accordance with the uniform

principles referred to in 1.



section 9 in a case under section 8, the applicant shall pay a

additional fee



1. with 30 000 kroons, if the NFA shall assess

the residues of the plant protection product, and



2. with 20 000 kroons, if the State's agricultural work to rule

the application in terms of efficiency, selectivity or

phytotoxicity, or whether environmental and

agricultural conditions are comparable.



section 10 in cases other than those referred to in section 8 shall, as a

chemical plant protection products, apply for a modification of a

approval under Regulation (EC) No 1107/2009 pay a

basic fee



1. by 20 000 kroons, if the change refers to a change of the source

for the active substance and the change means that it should be made a

assessment of equivalence under article 29(1)(b) of the regulation

(EC) No 1107/2009;



2. with 20 000 kroons, if the change relates to the plant protection product

composition, and



3. with 8 000 in other cases.



Fee for changing the authorisation of plant protection products with low

risk



section 11 instead of what is stated in section 8, the applicant for

agricultural conditions are comparable.



Fee for approval of a smaller area of use



section 13, instead of the provisions of sections 2 and 8, the applicant shall

pay a basic fee of 12 500 kroons, if the application refers to



1. an extension of a smaller area of use

According to article 51 of Regulation (EC) No 1107/2009, or



2. an extension of a smaller area of use

by mutual recognition according to article 40(1) and 51.7 in

Regulation (EC) No 1107/2009.



Fee for approval for a small area cultivated



section 14 of the applicant for approval of a chemical

plant protection products for professional use, and demonstrates that the

total cultivated area at the time of application is

to a maximum of 3 000 hectares shall pay a basic fee

Fee for an exemption from the requirement for approval




section 15 of The who for a chemical plant protection products applying for

exemption from the requirement for approval of Regulation (EC) no

1107/2009 shall pay a basic fee



1. by 6 000 kroons, if the application relates to a period of grace pursuant to

Article 46 of Regulation (EC) No 1107/2009;



2. with 10 000 kroons, if the application relates to a limited and

controlled use in emergency situation as referred to in article 53 of the

Regulation (EC) No 1107/2009;



3. with 8 000 kroons, if the application relates to a single experiment

or test referred to in article 54(1) of Regulation (EC) no

1107/2009, and



4. with 16 000 kroons, if the application relates to prior authorisation for

experiments or tests in advance in accordance with article 54(1) of

Regulation (EC) No 1107/2009.



Fee for a parallel trade permit



section 16 of The who for a chemical plant protection products applying for a

parallel trade permit in accordance with article 52 of Regulation (EC)

No 1107/2009 shall pay a basic fee of 20 000 kroons.



Chapter 3. Fees for the examination of biological plant protection products



section 1 Of the Swedish Chemicals Agency's examination of the applications for

authorization, waiver, and parallel trade permit of

biological plant protection products pursuant to Regulation (EC) no

1107/2009 is a filing fee paid pursuant to this

Chapter. The application fee is composed of a basic fee and of the

some cases of a tillläggsavgift. Provisions on fee for

review of applications for approval of biotech

Chapter 5.



A fee pursuant to section 3 is preliminary. Such a fee

establishes the final according to Chapter 9. 2 §. Other fees according to

Fee for approval



section 2 of the applicant for an authorisation of a biological

plant protection products pursuant to Regulation (EC) No 1107/2009

pay a basic fee



1. with 5 250 kroons, if the application concerns a mutual

recognition under article 40 of Regulation (EC) no

1107/2009;

2. with 5 250 kroons, if the application relates to a

expanded approval for a smaller field of application according to the

Article 51 of Regulation (EC) No 1107/2009, and



3. with 21 000 in other cases.



If the application concerns GMOs to be

1107/2009 shall pay a basic fee



1. with 3 000 kroons, if the application relates to a period of grace pursuant to

Article 46 of Regulation (EC) No 1107/2009;



2. with 5 000 kroons, if the application relates to a limited and

controlled use in emergency situation as referred to in article 53 of the

Regulation (EC) No 1107/2009;



3. with 4 000 dollars, in case of an application for authorisation for a

single experiments or tests referred to in article 54(1) of

Regulation (EC) No 1107/2009, and



4. with 8 000 kroons, if the application relates to a prior authorization

for experiments or tests in advance in accordance with article 54(1) of

Regulation (EC) No 1107/2009.



Fee for a parallel trade permit



section 6 of The who for a biological plant protection products applying for a

parallel trade permit in accordance with article 52 of Regulation (EC)

No 1107/2009 shall pay a basic fee of 10 000 kroons.



Chapter 4. Fees for the examination of biocidal products



section 1 Of the Swedish Chemicals Agency and national food review

applications for approval, registration, waiver and

parallel trade permit in the case of a biocidal product in accordance with

Regulation (EC) No 528/2012 or Chapter 14. section 10 of the environmental code

an application fee shall be paid in accordance with this chapter.

The application fee is composed of a basic fee and in some cases

of one or more additional fees. Provisions on fee

for the examination of applications for approval of biotech

organisms in the form of insects, nematodes or Arachnids

see Chapter 5.

Fee for approval



section 2 of the applicant for an authorisation of a biocidal product

or of a product family referred to in article 3 (1) s in

Regulation (EC) No 528/2012 shall, subject to section 12,

pay a basic fee



1. with 120 000 SEK, if application is made for a authorization by

mutual recognition of a product,



2. with 240 000 kroons, if the application relates to an approval by

mutual recognition of a product family,



3. with 600 000 kroons, if the application relates to a Union endorsement

of a product, and Sweden is evaluating Member State,



4. with 900 000 kroons, if the application relates to a Union endorsement

of a product family and Sweden is evaluating

Member State,



5. with 60 000 kroons, if the application relates to a

approval of a product by a simplified procedure

According to article 26 of Regulation (EC) No 528/2012 and Sweden

are evaluating Member State,



6. with 120 000 kroons, if the application concerns the approval of a

product family by means of a simplified procedure in accordance with article

26 of Regulation (EC) No 528/2012 and Sweden is evaluating

Member State,



7. with 600 000 kroons, if the application relates to a national

approval of a product family,



8. with 660 000 kroons, if the application relates to a temporary

approval of a product family,



9. with 360 000 kroons, if the application relates to a temporary

approval in cases other than those referred to in 8, and



10. with 300 000 SEK in other cases.

trials for research and development in accordance with article 56 of the

Regulation (EC) No 528/2012, and



2. by 15 000 in other cases.



Fee for a parallel trade permit



section 16 of the applicant for a parallel trade permit under

Article 53 of Regulation (EC) No 528/2012 shall pay a

basic fee of 20 000 kroons.



Chapter 5. Fees for the examination of insects, nematodes and

Arachnids



section 1 Of the Swedish Chemicals Agency's examination of the approval and

exemption in respect of biotechnical organisms in the form of insects,

nematodes or Arachnids according to chapter 14. section 10 of the environmental code

an application fee shall be paid in accordance with this chapter.



A fee pursuant to this chapter is a final charge.



section 2 of the applicant for an authorisation of an organism

referred to in paragraph 1 shall pay a fee of 3 000 SEK

product and 8,000 dollars for every active organism

is not part of another approved pesticides.

Chapter 6. Fee for the examination of the active substances in

plant protection products



section 1 Of the Swedish Chemicals Agency's examination of the active substances in

plant protection products pursuant to Regulation (EC) No 1107/2009 is a

section 2 of the person applying for a new or renewal of

an active substance in accordance with Regulation (EC) No 1107/2009

pay a fee



1. with 6 750 000 kroons for every single act of

documentation, if the application is made by several applicants jointly and

refers to a chemical substance,



2. with 4 500 000 SEK for each dossier, on

the application relates to a chemical substance and is not such a common

the application referred to in paragraph 1,



3. with 3 000 000 kroons for every single act of

documentation, if the application is made by several applicants jointly and

refers to a micro-organism, and



4. with 2 000 000 kroons for each dossier, on

the application refers to a micro-organism and is not such a common

application referred to in 3.



Fee for approval of an active substance in

plant protection products

If the Swedish Chemicals Agency's handling of cases covers only the time

crowns instead of what is said in the second paragraph.



Fee for examination of amended terms for approved active

substances in plant protection products



§ 5 the applicant for a change to the terms of a

approved active substance in accordance with Regulation (EC) No 1107/2009

pay a fee of SEK 200 000.



Chapter 7. Fee for the examination of the active substances in

biocidal products



section 1 Of the Swedish Chemicals Agency's examination of the active substances in

biocidal products under Regulation (EC) No 528/2012, a

establishes the final according to Chapter 9. 2 §.

another type of product shall be approved in accordance with regulation

(EC) No 528/2012 or applying for extension of a decision

1. with 5 700 000 kronor for every single act of

documentation, if the application is made by several applicants jointly and

concerns that a chemical substance should be approved or that such

approval shall be extended,



2. with 3 800 000 SEK for each dossier, on

the application relates to a chemical substance should be approved or

such approval shall be extended and the application is not a

such common applications as referred to in 1,



3. with 3 000 000 kroons for every single act of

documentation, if the application is made by several applicants jointly and

concerns that a micro-organism shall be approved, or that such a

approval shall be extended,



4. with 2 000 000 kroons for each dossier, on

the application relates to a microorganism should be approved or

such approval shall be extended and the application is not a

such joint application referred to under 3,



5. with 420 000 kronor for every single act of

documentation, if the application is made by several applicants jointly and

(EC) No 528/2012, and

Fee for examination after the approval of an active substance in

biocidal products

Chapter 8. Annual fees for pesticides

calendar year in which it expires.

Transitional provisions



2013:63



1. This Regulation shall enter into force on 26 March 2013.



2. the provisions of Chapter 2 and 3. apply for the first time for

applications submitted to the Swedish Chemicals Agency, after

the entry into force.



3. the provisions of Chapter 4. apply for the first time for

applications submitted to the Swedish Chemicals Agency after the

August 31, 2013.



4. A fee as referred to in Chapter 8. section 3 will be paid on May 31

2013, instead of what is said in the section are paid

by 31 October 2013.



5. in the case of annual fee which relates to 2013 shall levy instead

2015:47



1. This Regulation shall enter into force on 24 March.



2. the provisions of Chapter 8. section 3 of the new wording is applied

first time in terms of annual fees relating to 2016.



3. The annual fee in accordance with Chapter 8. 3 paragraph 1 relating to

2016 shall be paid in an amount equal to the sum of



a) 4% of the sales value of the vehicle in 2015

multiplied by 83 and divided by 365, but not less than 455

dollars and not more than SEK 79 589, and



b) 5.5% of the sales value of the vehicle in 2015

multiplied by 282 and divided by 365, but not less than 1 545

dollars and not more than SEK 309 051.
