Order IET/389/2015, dated March 5, updates the system of automatic determination of maximum sales prices, before taxes, of liquefied petroleum gases packaged.

In Article 3.5 of the aforementioned order, it is indicated that the maximum sales prices to the public will be reviewed on a bimonthly basis and will produce effects from the third Tuesday of the month in which the review takes place. Article 6 also provides that the Directorate-General for Policy, Energy and Mines, of the Ministry of Industry, Energy and Tourism, shall carry out the calculations necessary for the implementation of the system set out in that order and (a) give the relevant decisions on the determination of marketing costs and the maximum selling prices, before tax, of liquefied petroleum gases, in their packaging, to be published in the Official Journal of the European Union. Status ".

In compliance with the above provisions and in order to make public the new maximum prices of liquefied petroleum gases in such a supply mode, this Directorate General for Energy Policy and Mines has resolved the following:

First. Scope of application.

1. This resolution shall apply throughout the Spanish territory to the supplies of liquefied petroleum gases which are pending for implementation on 15 November 2016, without prejudice to the date of the previous date. For these purposes, they are understood by supplies pending execution, those which at zero hours of the day 15 November 2016 have not yet been completed or are in the process of being carried out.

2. The competent authorities of the Autonomous Community of the Canary Islands and the cities of Ceuta and Melilla may vary in more or less the marketing costs in accordance with the provisions of Article 4.3 of the Order. IET/389/2015 of 5 March 2015 updating the system for the automatic determination of maximum sales prices, before tax, of liquefied petroleum gases packaged.

3. In particular, the provisions of this resolution shall apply to supplies of liquefied petroleum gases packed in containers of a load of 8 kg or more, and less than 20 kg of LPG content, with the exception of mixing packages for uses of liquefied petroleum gases as fuel.

4. This resolution shall not apply to liquefied petroleum gases packed in containers with a tare of less than or equal to 9 kg, except for those operators of LPG, with an obligation to supply home to the corresponding territorial scope, which do not have packages of a size greater than 9 kg, in accordance with the additional thirtieth provision of Law 34/1998 of 7 October of the hydrocarbon sector.

Second. Maximum sales price before tax.

From zero hours of day 15 November 2016, the maximum selling price, before tax, of application to the liquefied petroleum gas supplies included in the scope of this resolution will be 79,7394 c€/Kg.

Third. Marketing cost.

The cost of marketing without taxes, considered in the price indicated in the previous paragraph, and in accordance with the provisions of Article 4 of Order IET/389/2015, of 5 March, for which the system of Automatic determination of maximum sales prices, before tax, of liquefied petroleum gases packaged is 49,5931 c€/Kg.

Fourth. Reference prices and mismatches.

In the maximum selling price referred to in the second subparagraph, as provided for in Articles 3 and 4 and in the single transitional provision of the abovementioned order IET/389/2015 of 5 March, the following calculations and mismatches for the next period:

Dollar/euro exchange average October: 1.102605.

Fifth. Effectiveness.

This resolution will take effect from November 15, 2016.

Against this resolution, and in accordance with the provisions of Articles 121 et seq. of Law 39/2015 of 2 October of the Common Administrative Procedure of the Public Administrations, an appeal may be brought against raised with the Secretary of State of Energy within one month of the day following that of its publication.
