By Royal Decree 863/1985 of 2 April, the General Rules of Basic Standards of Mining Security were approved, preventing their development and execution by means of complementary technical instructions, the scope and validity of which are define in Article 2 of the aforementioned royal decree.

dated May 13, 2008 was published in the "Official State Gazette" No. 116, Order ITC/1316/2008 of 7 May, approving the supplementary technical instruction for the General Regulation of Basic Safety Standards, 2.2.1.02 "Preventive training for the performance of the job".

the purpose of this supplementary technical instruction is to regulate the minimum occupational safety and occupational health training to be provided by workers who carry out their normal work in the workplace. work attached to mining activities. This preventive training should be carried out regularly for all workers, with a retraining or knowledge update.

The contents of the preventive training specific to the performance of the jobs, have been developed in technical specifications published by Resolution of the Directorate General of Energy Policy and Mines.

By this order, additional technical instruction will be amended on the basis of the General Rules of Basic Standards for Mining Safety Regulations (2.1.02), in order to include the minimum duration of training courses recycling or updating of knowledge, as well as to set the mode of impartition of such training.

In the preparation of this order, the mandatory hearing has been carried out for the interested parties and the Minera Security Commission has reported favorably.

This order is dictated by the provisions of Article 149.1.25. of the Constitution, which attributes exclusive competence to the State on the basis of the mining and energy regime.

In its virtue, I have:

Single item. Amendment of Order ITC/1316/2008 of 7 May, approving the supplementary technical instruction for the general regulation of basic rules on mining safety, on 2.1.02 " Preventive training for the performance of the job

Two new paragraphs 3 and 4 are added to Section 7 of Supplementary Technical Instruction 02.1.02 "Preventive training for the performance of the job", of the General Regulations of Basic Safety Standards, approved by Order ITC/1316/2008 of 7 May, with the following wording:

" 7.3 The training regulated in this supplementary technical instruction shall be in person only.

7.4 Training courses with a retraining or knowledge upgrade will be adapted to a minimum of five teaching hours. "

Single end disposition. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
