This Royal Decree-law aims to proceed with the granting of extraordinary credits and credit supplements in the budget of the Ministry of Labor and Immigration and other ministerial departments, for to attend to the coverage of obligations of the General Administration of the State, for the reasons set out below.

1. Credit supplement in the budget of the Ministry of Labour and Immigration in the amount

EUR 3,729,690,714

The rate of unemployment predicted for the financial years 2009 and 2010 in terms of the Labour Force Survey was determined at 10.50 percent and 17.45 percent, respectively. However, the real unemployment rate in terms of the aforementioned Labour Force Survey, which was reached in 2009, was 18.01 percent and in 2010, 20.05 percent. This situation has resulted in the existence of EUR 2,263,770,864,87 of expenditure for benefits pending against the budget of the State Employment Public Service at the end of 2010. However, this Agency has charged the financial year 2011 with the amount of EUR 344,407,862,77, as there is sufficient balance to do so, and therefore the amount of the outstanding obligations to be charged to the budget at the current date amounts to EUR 344,407,862,77. EUR 1,919,363,002,10.

Also, for the financial year 2011, it was estimated that the monthly average of persons receiving Active Income from Insertion would be 131,000, while with the information in the period from January to August of this year. The Commission considers that, in reality, the 180,000 beneficiaries will be reached on average monthly, so that at the end of the year higher expenses will be incurred than initially planned to cover this benefit in the amount of 162,137,216,30 euro.

On the other hand, due mainly to the lower revenue collection than initially planned for the financial year 2010, debts were generated in the State Employment Public Service in the amount of EUR 1,648,190,495.60, which have their reflection on the negative cash balance that the said Body had at the end of the financial year 2010, which should be met in the financial year 2011.

For all this, a credit supplement is required in the Ministry of Labour and Immigration's budget for the amount of EUR 3,729,690,714 to the State Employment Public Service.

The obligations to which the credit supplement takes care, with the exception of those corresponding to the Active Income for Insertion of the financial year 2011 in the amount of EUR 162,137,216,30, have already been computed in the deficit of previous financial years, so in terms of General Government the remainder of the credit supplement, in the amount of EUR 3,567,553,497,70, has no impact on the 2011 deficit.

2. Credit supplements in the budget of the Ministry of Defence in the amount of EUR 86,348,105.68

The Council of Ministers, at its meeting of 24 June 2011, agreed to extend the participation of the Spanish Armed Forces in Operations for the resolution of the crisis in Libya, in application of the resolutions 1970 (2011) and 1973 (2011) of the United Nations Security Council, until the end of the NATO operation "UNIFIED PROTECTION" which aims at the end of all violence and attacks against civilians, the withdrawal of military forces from the United Nations. all occupied or besieged cities and the safe and guaranteed access of humanitarian aid to all Libyan territory.

The expenses incurred for the participation of the Spanish Forces in the said Mission require the granting of credit supplements in the budget of the Ministry of Defense in the amount of 86,348,105.68 euros.

3. Credit supplements in the budget of the Ministry of Development, in the amount of 124,100,000 euros

Aid to the beneficiaries of the Basic Income for Emancipation.

The recognition of the right to the aid of the Basic Income of Emancipation, regulated by Royal Decree 1472/2007, of November 2, has originated the appearance of new needs in the exercise 2011 to face the payments that are derive from the decisions which recognise the right to such aid.

As long as the aid remains in force, an average number of additions of 99,600 new beneficiaries is estimated to show the requirements laid down in Article 3 of Royal Decree 1472/2007 of 2 November 2007 for the recovery of the aid during the financial year 2011, to which the State has an obligation to pay the recognised aid.

The credit needs to pay for the payment of the aid to the beneficiaries of the Basic Income for Emancipation in the current financial year amounts to 46,100,000 euros.

Subsidizing interest on loans from State Housing Plans.

The subsidy of interest on loans constitutes one of the economic aid of the State Housing Plans that the financial institutions, in compliance with the agreements signed with the Ministry of Development, advance to the beneficiaries, who subsequently invoice their amount to the General Administration of the State, so that their credit implies meeting commitments already acquired by the State.

The budget allocation allocated in 2011 does not allow the payment of the last quarter of the financial year 2010 and the first three quarters of the financial year 2011 to be fully met, with the need for credit at EUR 78,000,000.

4. Extraordinary appropriation in the budget of the Ministry of Education, amounting to EUR 20,882,460,57

The extraordinary credit is intended to serve the payment of outstanding obligations to the General Treasury of Unprescribed Social Security, derived from inspection records.

These minutes come from the inspections carried out by the Labour and Social Security Inspectorate resulting from an individualized judicial decision, the majority of which are in sentences that declare the origin of the inclusion of teachers of religion in the General Social Security Scheme from the moment of the commencement of the provision of their services.

In addition, it is necessary to meet the obligations arising from settlement acts implemented by the inspector who described the provision of services of teachers of religion with the Ministry of Education. as an employment and notes the lack of high and contribution to the General Social Security Regime.

The amount of obligations to satisfy amounts to EUR 20,882,460.57.

5. Extraordinary appropriations and credit supplement in the budget of the Ministry of Health, Social Policy and Equality in the amount of EUR 260,140,743,71

Statement compliance by collaboration in healthcare delivery.

There are pending payment of sentences from the Superior Court of Justice of Madrid as well as the National Court that condemn the administration to the payment of the financial compensation to satisfy certain companies. in the form of collaboration in the provision of health care to their workers.

The amount of pending statements is raised to 57,948,022.60 euros.

Coverage of the Minimum Level of Protection Guaranteed by Law 39/2006, of 14 December, to promote personal autonomy and care for people in a situation of dependency.

On the other hand, the coverage of the Minimum Level of Protection guaranteed by the General Administration of the State to the Autonomous Communities must be addressed in accordance with the provisions of the Law mentioned above.

The amount of the obligations to satisfy amounts to 202,192,7721.11 euros.

6. Financing of extraordinary credits and credit supplements

The needs to which you cover the extraordinary credits and credit supplements that are approved in this Royal Decree-law constitute enforceable obligations of the General Administration of the State, while the balance The current budgetary implementation contingency fund does not allow its financing to be financed by the Fund. Therefore, the application of the provisions of Article 16 of the Recast Text of the General Law on Budgetary Stability, approved by Royal Decree-Law 2/2007 of 28 December, and Articles 50.1 and 55.1 of the Law, is excepted. 47/2003, of November 26, General Budget, financing all extraordinary credits and credit supplements with Public Debt.

The budgetary coverage of most of the obligations under this Royal Decree-law-that is, the one relating to the payment to the Social Security of the obligations that the State Employment Service has (a) a credit supplement that does not have an impact on the general government deficit, given that it does not have an impact on the general government deficit, since it has no impact on the general government deficit; These obligations have already been computed in previous years.

The requirement to pay for obligations that must be met by the General Administration of the State and the need not to delay its payment in order not to cause harm to third parties, constitute the reasons for extraordinary and urgent need to justify the granting of extraordinary credits and credit supplements through Royal Decree-Law.

In its virtue, making use of the authorization contained in article 86 of the Spanish Constitution, on the proposal of the Vice President of the Government of Economic Affairs and Minister of Economy and Finance, according to the Council of State and prior deliberation of the Council of Ministers at its meeting on 14 October 2011,

DISPONGO:

Article 1. Grant of a credit supplement in the Ministry of Labor and Immigration budget.

A credit supplement to the budget of Section 19 "Ministry of Labour and Immigration", Service 03 "General Secretariat of Employment", Program 000X "Internal Transfers", Chapter 4 "Current Transfers" is authorised. Concept 412 "To finance the budget of the State Employment Public Service", for an amount of EUR 3,729,690,714.

This credit supplement is intended to regulate the cash balance of the State Employment Public Service at 31 December 2010, to apply to the budget and to regularise the payment of liabilities. previous exercises and address the needs of the present exercise in the Active Income of Insertion.

To fund and regularise these obligations, credit supplements are granted in the State Employment Public Service budget in the following terms:

The excess funding of the State Employment Public Service not applied to the coverage of the credit supplements will be used for the payment of the outstanding obligations as of December 31, 2010, which are included in the The Agency's cash balance, closed to the date indicated.

Spending Budget

Credit supplements are allowed in the amount of 2.081.500.218.40 euros in the following detail:

1. In application 19.101.251M.480.01 "Unemployment allowance, even previous exercise obligations" amounting to EUR 1,650,714,231,27.

2. In application 19.101.251M.480.02 "Unemployment allowance for any of the Special Agricultural Social Security Scheme, including obligations for previous financial years" amounting to EUR 229,528.25.

3. In application 19.101.251M.487.01 "Quota of beneficiaries of the unemployment allowance, including obligations of previous years" amounting to EUR 34,196,1114,81.

4. In application 19.101.251M.488 "Active insertion income" of 396,360,344.07 euro. Of this amount, EUR 234,223,127,77 will be used to cover the implementation of the obligations for previous years and the remainder, EUR 162,137,216,30 to cover the obligations of the financial year 2011.

Article 2. Concession of credit supplements in the budget of the Ministry of Defense.

To cover the costs incurred for the participation of the Armed Forces in the context of the crisis in Libya, during the period from 27 June to 31 December 2011, they are granted Credit supplements in the budget of Section 14 "Ministry of Defence", Service 03 "Secretary of State of Defence", Programme 122M " Operational expenditure of the Armed Forces " for the total amount of EUR 86,348,105.68, in the following concepts and amounts:

Concept 128 "Expenses originated by the participation of the Armed Forces in peacekeeping operations" amounting to 6.840,622.73 euros.

Concept 228 "Expenditure incurred for the participation of the Armed Forces in peacekeeping operations" amounting to EUR 25,181,957.57.

Concept 668 "Expenditure incurred for the participation of the Armed Forces in peacekeeping operations" in the amount of EUR 54,325,525.38.

Article 3. Granting of credit supplements in the budget of the Ministry of Public Works.

To cover the coverage of expenses arising from the subsidization of loans from the State Housing Plans, a credit supplement is granted in the budget of Section 17 "Ministry of Development", Service 09 "Directorate-General for Architecture and Housing Policy", Programme 261N "Promotion, administration and aid for rehabilitation and access to housing", Chapter 7 "Capital transfers", Concept 782 " Aid for basic income for the emancipation of (i) for the purposes of the European Community's financial support for the European Community. loans " amounting to EUR 78,000,000.

Article 4. Grant of extraordinary credit in the Ministry of Education's budget.

To pay for the payment of Social Security contributions corresponding to previous years, an extraordinary appropriation is granted in the budget of Section 18 "Ministry of Education", Service 01 " Ministry, Undersecretary and General Services ", program 322A" Education and primary education ", Chapter 1" Personnel expenses ", Concept 160" Social quotas ", Subconcept 04" Social Security. Obligations for previous financial years ", amount of EUR 20,882,460,57.

Article 5. Grant of extraordinary appropriations and credit supplement in the budget of the Ministry of Health, Social Policy and Equality.

1. In order to deal with the judgments of the High Court of Justice of Madrid and the National Court of Justice for the payment of financial compensation in the form of collaboration in healthcare provided by collaborating entities, (i) authorise extraordinary appropriations in the budget of Section 26 'Ministry of Health, Social Policy and Equality', Service 12 'Directorate-General for Vocational Management, Cohesion of the National Health and High Inspection System', Programme 311O "Cohesion and Quality of the National Health System", Chapter 4 "Current Transfers", in the amount of EUR 57,948,022,60, in the following concepts and amounts:

Concept 441.06 "For the payment of sentences relating to collaboration in Healthcare." "Judgment of the National Court of 17 June 2009 concerning economic compensation for healthcare provided by the Corporación Radiotelevisión Española, S.A." in the amount of EUR 1,069,787,39.

Concept 471.12 "For the payment of sentences relating to collaboration in Healthcare." 'Judgment of the High Court of Justice of Madrid of 9 June 2008 on financial compensation for the health care provided by Lagun Aro, Voluntary Social Welfare Entity' amounting to EUR 55,789,310,80.

Concept 471.13 "For the payment of sentences relating to collaboration in Healthcare." "Judgment of the National Court, of 28 April 2010, concerning economic compensation for healthcare provided by Altaris and Compañía de Distribución Integral Logista, S.A." in the amount of EUR 1,088,924,41.

2. To meet obligations relating to the Minimum Level of Protection guaranteed by the General Administration of the State to the Autonomous Communities as laid down in Law 39/2006 of 14 December on the promotion of personal autonomy and Attention to persons in a situation of dependency, a credit supplement is authorized in the budget of Section 26 "Ministry of Health, Social Policy and Equality", Service 15 "General Secretariat for Social Policy and Consumption", Program 000X "Internal transfers", Concept 427 "To IMSERSO for Minimum Guaranteed in Dependence", by Amount 202,192,7721.11 EUR.

Article 6. Financing of extraordinary credits and credit supplements.

1. It does not apply to the extraordinary credits and credit supplements contained in this Royal Decree-law the provisions of article 16 of the recast text of the General Law of Budget Stability, approved by Royal Decree Legislative 2/2007 of 28 December and Articles 50.1 and 55.1 of Law 47/2003 of 26 November, General Budget.

2. All outstanding credits and credit supplements granted by this Royal Decree-Law in the State Budget will be funded by Public Debt.

Single end disposition. Entry into force.

This Royal Decree-law will enter into force on the day of its publication in the "Official State Gazette".
