Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or the official journal concerned.

By Order APU/2074/2004, of June 10, regulating the files of personal data of the Ministry of Public Administrations and its public bodies, were included those relating to the General Mutual Civil servants of the State, hereinafter MUFACE (numbers I. 58 to I. 66, within Annex I of that provision). Also, by Order APU/3359/2004, of October 7, the previous Order was modified, regulating within it, among others, the Automated File I. 6a, concerning the Data of the Pension Plan of MUFACE. The Resolution of 15 April 2009, from MUFACE, approved the creation of new personal data files. Finally, the Resolutions of 5 April 2010, 27 May 2011 and 5 August 2011, of MUFACE, set out the creation of the personal data files "History of Digital Health", of the "Electronic Register of MUFACE" and of "Users of Quotations", respectively.

At this time, it is necessary to update the catalogue of personal data files of the General Mutuality of Civil Servants of the State, since we will proceed to create a new file called 'Healthcare Professionals'. This file is created for the purpose of having information regarding the professionals who provide healthcare services to the mutualists and beneficiaries of MUFACE for the management of the coverage of the planned portfolio of services in all the national territory.

To this end, this resolution of the Director General of MUFACE, which contains in attached annex the basic structure of the new creation file in accordance with the provisions of article 54 of the Royal Decree 1720/2007, of 21 December, for which the Regulation of the Development of the Organic Law 15/1999, of 13 December, is approved.

This resolution has been favourably informed by the Spanish Data Protection Agency.

In its virtue, I have:

The following file is created whose data is listed as Annex I to this resolution: "Healthcare Professionals".

Second.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".

1. "Healthcare Professionals" file

a) Identification of the file, purpose and intended uses:

a.1) File Identification: Healthcare Professionals.

a.2) Purpose and intended uses: To provide information on the professionals providing healthcare services to the mutualists and beneficiaries of MUFACE for the management of the coverage of the planned portfolio of services in the entire national territory.

b) Data source:

b.1) Collective: Healthcare professionals.

b.2) Procedure for the collection of data and its source: The data are provided by the entities that provide healthcare through tables, by electronic exchange.

c) Basic file structure and the treatment system used in your organization:

Identifying character data:

CIF_NIF.

First and last names.

Collegiate number.

Specialty.

Place of work.

Email.

Phone number.

Electronic media available.

Enabling prescription prescriptions and the issue of low parts.

c.2) Treatment system: Automated.

d) Communications for expected data: No communications on non-public data are foreseen.

File Manager: MUFACE General Address.

(f) The Authority to which the rights of access, rectification, cancellation and opposition may be exercised, where applicable: General Mutual Affairs of Civil Servants of the State, based on Paseo de Juan XXIII, number 26, Madrid.

g) A basic, medium or high level of security that is required, in accordance with the provisions of Title VIII RLOPD: Basic Level.
