Article 2.2.j of Law 50/1997 of 27 November of the Government establishes that it is for the President of the Government to create, modify and delete, by Royal Decree, the Departments of Ministeriales, as well as the Secretaries of State.

In order to develop the political program of government reforms, achieve maximum austerity and effectiveness in its action and the greatest efficiency in the operation of the General Administration of the State, it is considered necessary to reform the current ministerial structure.

In its virtue, on the proposal of the President of the Government,

DISPONGO:

Article 1. Ministerial departments.

The General Administration of the State is structured in the following ministerial departments:

Ministry of Foreign Affairs and Cooperation.

Ministry of Justice.

Ministry of Defense.

Ministry of Finance and Public Administrations.

Ministry of Interior.

Ministry of Development.

Ministry of Education, Culture and Sport.

Ministry of Employment and Social Security.

Ministry of Industry, Energy and Tourism.

Ministry of Agriculture, Food and Environment.

Ministry of the Presidency.

Ministry of Economy and Competitiveness.

Ministry of Health, Social Services and Equality.

Article 2. Ministry of Foreign Affairs and Cooperation.

1. It is for the Ministry of Foreign Affairs and Cooperation to conduct foreign policy and international development cooperation, in accordance with the Government's guidelines and in application of the principle of unity of action in the the outside.

2. This Ministry is structured in the following higher bodies:

(a) The Secretariat of State for Foreign Affairs and Cooperation.

b) The Secretariat of State for the European Union.

c) The Secretariat of State for Latin America.

Article 3. Ministry of Justice.

1. It is up to the Ministry of Justice to propose and implement the Government's policy for the development of the legal system, without prejudice to the powers of other departments, the Government's relations with the administration of Justice, with the General Council of the Judiciary and with the Fiscal Ministry, through the Attorney General of the State, and international legal cooperation, as well as the other functions attributed by the laws.

2. This Ministry has, as a higher body, the Secretariat of State for Justice.

Article 4. Ministry of Defense.

1. It is for the Ministry of Defence to exercise all the powers and powers conferred on it by the legal system as a body responsible for the ordination, coordination and implementation of the Government's general guidelines on policy.

2. This Ministry has, as a higher body, the Secretary of State of Defense, as well as the others provided for in the legal order and, specifically, in the legislation on military organization.

Article 5. Ministry of Finance and Public Administrations.

1. It is up to the Ministry of Finance and Public Administration to propose and implement the Government's policy on public finances, budgets and expenditure, in addition to the other powers and powers conferred on it by the legal order.

2. It is also up to this Ministry to propose and implement the Government's policy on public service and reform and organization of the General Administration of the State, as well as the relations with the autonomous communities and the entities that integrate the Local Administration.

3. This Ministry is structured in the following higher bodies:

(a) The Secretariat of State of Finance.

b) The Secretariat of State for Budgets and Expenses.

c) The Secretary of State for Public Administration.

Article 6. Ministry of the Interior.

1. It is up to the Ministry of the Interior to propose and implement the Government's policy on citizen security, traffic and road safety, promotion of the conditions for the exercise of fundamental rights, the exercise of command of the State Security Forces and Corps and the other powers and powers conferred upon it by the legal system.

2. This Ministry has, as a higher body, the Secretariat of State for Security.

Article 7. Ministry of Development.

1. It is up to the Ministry of Public Works to propose and implement the Government's policies on infrastructure, land transport of state, air and maritime competition, as well as housing, building and soil quality.

2. This Ministry has, as a higher body, the Ministry of Planning and Infrastructure.

Article 8. Ministry of Education, Culture and Sport.

1. It is up to the Ministry of Education, Culture and Sport to propose and implement the Government's policy on education, vocational training and universities, as well as the promotion, protection and dissemination of historical heritage. Spanish, state and arts museums, book, reading and literary creation, cinematographic and audiovisual activities and state books and libraries, the promotion and dissemination of culture in Spanish, as well as the promotion of cultural cooperation actions and, in coordination with the Ministry of Foreign Affairs External relations, international relations in the field of culture.

2. It is also up to this Ministry to propose and implement the Government's policy on sport.

3. This Ministry is structured in the following higher bodies:

(a) The Secretary of State for Education, Vocational Training and Universities.

b) The Secretary of State for Culture.

Article 9. Ministry of Employment and Social Security.

1. It is up to the Ministry of Employment and Social Security to propose and implement the Government's employment and social security policy, as well as the development of the Government's policy on immigration, immigration and migration.

2. This Ministry is structured in the following higher bodies:

(a) The Secretary of State for Employment.

b) The Secretary of State for Social Security.

Article 10. Ministry of Industry, Energy and Tourism.

1. It is up to the Ministry of Industry, Energy and Tourism to propose and implement the Government's policy on energy, industrial development, tourism, telecommunications and the information society.

2. This Ministry is structured in the following higher bodies:

a) The Secretary of State for Energy.

b) The Secretary of State for Telecommunications and the Information Society.

c) The Secretary of State for Tourism.

Article 11. Ministry of Agriculture, Food and Environment.

1. It is up to the Ministry of Agriculture, Food and the Environment to propose and implement the Government's policy on agricultural, livestock and fisheries resources, the agro-food industry, rural development.

2. It is also up to this Ministry to propose and implement the Government's environmental policy.

3. This Ministry has, as a higher body, the Secretary of State for the Environment.

Article 12. Ministry of the Presidency.

1. It is up to the Ministry of the Presidency to coordinate matters of constitutional relevance, the preparation, development and follow-up of the legislative programme, immediate support for the Presidency of the Government, assistance to the Council of Ministers, the Government's Delegate Commissions, the General Secretariat of State Secretaries and, in particular, the Government in its relations with the General Courts, as well as the relations with the Government Delegates in the Autonomous Communities.

2. The Ministry of the Presidency is structured in the following higher bodies:

a) The Secretary of State for Relations with the Courts.

b) The Secretary of State for Communication.

Article 13. Ministry of Economy and Competitiveness.

1. It is up to the Ministry of Economy and Competitiveness to propose and implement the Government's economic policy and reforms to improve competitiveness, scientific research, technological development and innovation in all sectors. the sectors, the commercial policy and the support to the company, as well as the rest of the competences and attributions that the legal order gives it.

2. This Ministry is structured in the following higher bodies:

(a) The Secretary of State for Economic Affairs and Support to the Company.

b) The Secretary of State for Trade.

c) The Secretariat of State for Research, Development and Innovation.

Article 14. Ministry of Health, Social Services and Equality.

1. It is up to the Ministry of Health, Social Services and Equality to propose and implement the Government's policy on health, planning and health care and consumption, as well as the exercise of the powers of the State General Administration to assure citizens of the right to health protection.

2. It is also up to this ministry to propose and implement the Government's policy on cohesion and social inclusion, family, child protection and care for dependent or disabled persons, and for equality.

3. This Ministry has, as a higher body, the Secretariat of State for Social Services and Equality.

Additional disposition first. Admembership of the Superior Council of Sports.

The Sports Council, in accordance with article 7.2 of Law 10/1990 of 15 October of the Sport, is attached to the Ministry of Education, Culture and Sport.

Additional provision second. Membership of the National Intelligence Center.

The National Intelligence Center, in accordance with the additional provision of Law 11/2002, of May 6, of the National Intelligence Center, is assigned to the Ministry of the Presidency.

Additional provision third. Secretary of State for Communication.

The Secretary of State is organically dependent on the Ministry of the Presidency and functionally on the Minister who takes over the functions of Government Spokesperson, for the purposes of exercising them.

Single transient arrangement. Subsistence of existing structures.

Subsystems, until the implementation of the real decrees of basic organic structure of the ministerial departments, the executive organs, units and posts of the ministerial departments object of suppression or of restructuring.

Single repeal provision. Regulatory repeal.

Any provisions of equal or lower rank are repealed as set out in this Royal Decree.

Final disposition first. Removal of organs.

The following ministerial departments and top organs are deleted:

• Ministry of Economy and Finance.

• Ministry of Education.

• Ministry of Labor and Immigration.

• Ministry of Industry, Tourism and Trade.

• Ministry of Environment, and Rural and Marine Environment.

• Ministry of Territorial Policy and Public Administration.

• Ministry of Culture.

• Ministry of Health, Social Policy and Equality.

• Ministry of Science and Innovation.

• Secretariat of State for Foreign and Ibero-American Affairs.

• Secretary of State for International Cooperation.

• Secretary of State for Finance and Budget.

• Secretary of State for Economic Affairs.

• Secretary of State for Transport.

• Secretary of State for Housing and Urban Actions.

• Secretary of State for Education and Vocational Training.

• Secretary of State for Immigration and Emigration.

• Secretary of State for Foreign Trade.

• Secretary of State for Climate Change.

• Secretary of State for Rural Affairs and Water.

• Secretary of State for Constitutional and Parliamentary Affairs.

• Secretary of State for Territorial Cooperation.

• Secretary of State for the Civil Service.

• Secretary of State for Equality.

• Secretary of State for Research.

Final disposition second. References to the deleted organs.

The references of the legal order to the bodies which, by this Royal Decree, shall be deleted shall be construed as those which, by this same rule, are created and replaced or assume their powers.

Final disposition third. Membership of public bodies.

The public bodies are assigned to the ministerial departments in accordance with the distribution of competences established in this Royal Decree, and in the terms that are determined in the actual decrees by which approve the corresponding organic structure.

Final disposition fourth. Budgetary changes.

The Ministry of Finance and Public Administration will make the necessary budgetary changes to comply with the provisions of this Royal Decree.

Final disposition fifth. Entry into force.

This Royal Decree will enter into force on the day of its publication in the "Official Gazette of the State".
