Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, provides that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the Official Journal of the State or Official Journal.

Consequently, in order to comply with the provisions of that article and in order to complete the relationship of files with personal data managed by the Ministry of Health, Social Policy and Equality and their (a) the Order of 21 July 1994, which regulates the files with personal data managed by the Ministry of Health, Social Policy and Equality, creating a new file with data from the Ministry of Health, personal character that facilitates the management and enables the knowledge of the sociofamiliar profile of the Users of the Public Network of Primary Care Social Services as well as the social intervention process.

In the processing of this order, the Spanish Data Protection Agency has issued a mandatory report.

In its virtue, I have:

Article 1. Creating a file.

The contents of Annex 2 of the Order of 21 July 1994 are extended by the creation of a new automated file, called "System of Information Users of Social Services (SIUSS)", whose data are listed as an annex to the this order.

Article 2. Management and organization measures.

The head of the body responsible for these files shall, under the top management of the person holding the Ministry of Health, Social Policy and Equality, adopt the necessary management and organisational measures, ensuring, in any case, the confidentiality, security and integrity of the data, as well as the conduct of the guarantees, obligations and rights recognized in Organic Law 15/1999 of 13 December, and in its implementing rules, and Royal Decree 1720/2007 of 21 December 2007 approving the Regulation on the security of automated and non-automated files containing personal data.

Article 3. Data cession.

The data contained in this file may only be transferred in the cases expressly provided for by law.

Single end disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

Filename:

Social Services User Information System (SIUSS).

Purpose and intended uses of the file:

Purpose: To manage the information system of users of social services, according to functions attributed to the General Directorate of Social, Family and Children Policy, dependent on the General Secretariat of Social Policy and Consumption. The intended uses of the file are to enable the knowledge of the sociofamiliar profile of the users as well as the process of social intervention, in order to facilitate the impulse, coordination and monitoring of the programs of action in the field of primary care social services (Royal Decree 263/2010 of 20 October).

Collective of persons who are intended to obtain personal data or who are required to supply data:

Primary care social services users.

Provenance and personal data collection procedure:

Directly from the person concerned, by the professionals who attend them.

Data and/or data transfers that are provided to third countries:

There is no data cession.
