The General Treasury of Social Security and the Social Institute of the Navy have signed, dated September 30, 2011, an Agreement to entrust the latter to the allocation of the Social Security number to the effects of the recognition of entitlement to benefits.

The publication of the said Agreement is available as an annex to this resolution.

ANNEX

MANAGEMENT AGREEMENT BETWEEN THE GENERAL TREASURY OF SOCIAL SECURITY AND THE SOCIAL INSTITUTE OF THE NAVY FOR THE ALLOCATION OF THE SOCIAL SECURITY NUMBER FOR THE PURPOSES OF THE RECOGNITION OF THE RIGHT TO BENEFITS

In Madrid, 30 September 2011.

UNITED

On the one hand, the General Treasury of Social Security, represented by its head, Javier Aibar Bernad, appointed by Royal Decree 838/2004, of 23 April (B.O.E. n. 100, of April 24).

On the other hand, the Social Institute of the Navy, represented by its owner Don Luis José Casqueiro Barreiro, appointed by Resolution of the Secretary of State for Social Security of 8 October 2010 (B.O.E. n. 255, 21 of ).

EXPOSE

I. Royal Decree 1314/1984, of 20 June, which regulates the structure and powers of the General Treasury of Social Security (TGSS), in its article 1, which carries by title "Nature and attributions", specifically assigns to the said Common Service competition in the field of registration of companies and the affiliation, ups and downs of workers in Social Security.

II. The General Regulation on the registration of enterprises and affiliation, high, low and variations of data of workers in the Social Security, approved by Royal Decree 84/1996 of January 26, regulates in its article 21 the allocation of the number of Social (NUSS) citizens for the identification of the same in their relations with the Social Security as well as to the beneficiaries of pensions or other benefits of the System, both in their contributive and non-contributory modality, attributing to the General Treasury of Social Security the competition to the effect.

III. Also, citizens, not affiliated with the System, who request any provision or service of the Management Entities or Social Security Partners or the Public Service of State Employment must also be assigned a Number of Social Security, to which effect they will have to apply to the Provincial Directorates or the General Administration of the TGSS, in accordance with Article 21 of the General Regulation of 26 January 1996.

IV. The Royal Decree 504/2011, of 8 April, of organic structure and functions of the Social Institute of the Navy, defines in its article 3 its competences and functions, including the management, administration and recognition of the right to the benefits of the Special Regime for the Social Security of the Workers of the Sea, as well as the registration of companies, affiliation, ups, downs and variations of data of the workers assigned to that Special Regime, in collaboration with the General Treasury of Social Security.

V. It follows from all the above that any citizen who is not affiliated with the Social Security and meets the other requirements established by the legislation in force to cause the right to a benefit of the System, is obliged to make different In the case of the Commission, the Commission has been able to take the necessary steps to ensure that the right to health care is recognised, and that it is also necessary to move to the General Treasury of the European Union. Social security and the National Social Security Institute or, where appropriate, the Social Institute of the Marina, you must then go to the Public Health Service to request the issuance of the Individual Health Card.

The improvement in the quality of the services provided by the various entities that make up the Social Security System requires the arbitration of the measures necessary to simplify the exercise of the rights by the of the citizens, so that in the field of the recognition of the right to the benefits it is necessary that the Social Institute of the Navy can assign the number of Social Security to the applicants of benefits to the same one that previously are not affiliated with the System, in accordance with the terms laid down in Article 15 of Law 30/1992, November, the Legal Regime of Public Administrations and the Common Administrative Procedure.

VI. For the above and in accordance with Article 15 of Law 30/1992 of 26 November, both parties subscribe to the present

MANAGEMENT TASK AGREEMENT

First.

the General Treasury of Social Security, holder of the jurisdiction to be entrusted, as provided for in Article 21 of the General Regulation on the registration of companies and affiliation, ups, downs and variations of data Social Security workers, approved by Royal Decree 84/1996, of January 26, is the entrusted Entity, and the Social Institute of the Navy the Management Entity entrusted for the allocation of the Social Security Number in the case Roast as listed in this Agreement.

Second.

The management mandate does not imply a transfer of ownership of the competition or the constituent elements of its exercise, being the responsibility of the General Social Security Treasury to dictate how many acts and resolutions of the legal nature of the activity is considered appropriate in relation to the material activity object of encomendenda, which has its scope only in the allocation by the Social Institute of the Social Security Number to those citizens who, not being In the first place, the Commission has been working on the applicants for benefits whose recognition corresponds to that Institute.

Third.

For the purpose of effective management of this management, the General Treasury of Social Security authorizes the Social Institute of the Navy to use the necessary transactions, both for the allocation of the Social security as for the identification of the high, low and variations of data of applicants of benefits not previously affiliated, either in conventional quotation accounts or by other means of identification that is determined by the General Treasury of Social Security, under the SILCON environment, corresponding to the Deputy General Directorate of Social Security of the Sea Workers administration and management of users corresponding to the Gestora Entity.

Fourth.

The allocation of Social Security Number shall require, upon accreditation by the person concerned by his or her personality by identity card or equivalent document in force, the following minimum essential data: name; identifier of natural persons (Nº DNI or NIE); nationality; sex; domicile; location and date of birth; name of father and name of mother.

Fifth.

The assumption that the Management Entity may assign the Social Security Number under this Management Encomienda Agreement is as follows:

Benefits applicants whose recognition corresponds to the Social Institute of the Navy and who are not previously affiliated with the Social Security System, who will be assigned Social Security Number.

Sixth.

Once the Social Security Number is assigned, in respect of the collective indicated in the fifth paragraph of this Agreement, the high number, either in conventional quotation accounts or by identification as determined by the Treasury General of Social Security, will be automatically produced by computer procedure, in cases where the management so permits, performing the discharge manually in the rest of cases, for which the Entity Gestora will have the required transactions.

Seventh.

The alleged fact that the Gestora Entity is entitled to assign Social Security Number, pursuant to the fifth paragraph of this Agreement, may be modified or extended to other assumptions, prior to the express agreement of the parties that subscribe to it.

Eighth.

This Agreement shall have effect from the date of its formalization and shall be valid for one year, being tacitly extended for calendar years, unless any of the parties to the Agreement proceed to express their express complaint with a a minimum period of three months in advance of the date of its expiry.
