Article 132.Siete.2 of the extended Law 39/2010 of 22 December of the General Budget of the State for the year 2011 provides that the contribution for all contingencies and protected situations in the Special Regime of the Social security of the workers of the sea included in the second and third groups referred to in Article 19.5 of the recast of Laws 116/1969 of 30 December, and 24/1972 of 21 June, regulating the Special Regime of the Social Security of the Workers of the Sea, approved by Decree 2864/1974, of 30 August, thus Article 54 of the General Regulation on the Listing and Settlement of Other Social Security Rights, adopted by Royal Decree 2064/1995 of 22 December 1995, shall be made on the remuneration to be determined by means of the Ministry of Employment and Social Security, in its current name, at the proposal of the Social Institute of the Navy, heard the representative organizations of the sector. Such determination shall be carried out by provinces, fisheries and professional categories on the basis of the average values of remuneration received in the preceding year.

To this end the content of this order is answered, by means of which, according to the average values of the remuneration received in 2011, the only bases for the contribution are determined by common contingencies and professionals according to provinces, fishing modalities and professional categories.

At the same time, a single additional provision is included regarding the mandatory incorporation into the RED system from 1 March 2012, of companies, groups of companies and other subjects responsible for compliance of the obligation to list, under the Special Regime of the Social Security of the Workers of the Sea, and that they have ten or fewer of ten workers on the high.

By virtue of the habilitation conferred by Article 132.Siete.2 of Law 39/2010 of 22 December 2010 on State Budgets for the year 2011, and Article 30 of Law 50/1998 of 30 December 1998 on measures Tax, administrative and social order, heard by the employers ' and trade union organisations representing the fisheries sector, I have been willing to:

Single item. Determination of the quotation bases.

The only bases for the contribution of the workers included in the second and third groups, as referred to in Article 19.5 of the recast of Laws 116/1969 of 30 December, and 24/1972 of 21 June, for which the regulates the Special Regime of Social Security of the Workers of the Sea, approved by Decree 2864/1974 of 30 August, as well as Article 54.2 and 3 of the General Regulation on the Listing and Settlement of Other Rights of the Security Social, approved by Royal Decree 2064/1995, of December 22, for all contingencies and situations Protected by the Special Regime of Social Security of the Workers of the Sea, they are established for the year 2012 in the amounts that are reflected in the annexes of this order, without prejudice to the provisions of the Order of 22 November 1974 in relation to the listing for common contingencies and, for employed persons, in relation to the contribution for unemployment, and to the self-employed in relation to the contribution for the protection by cessation of activity.

Single additional disposition. Obligation to check in to the RED system.

1. Companies, groups of companies and other subjects responsible for the fulfilment of the obligation to list, under the Special Regime of the Social Security of the Workers of the Sea and who have ten or fewer of ten workers in the high, must be incorporated in an effective and mandatory way to the Electronic Data Broadcasting System, RED system, from 1 March 2012.

2. Where undertakings, groups of undertakings and other persons responsible for the fulfilment of the obligation to make contributions referred to in the preceding paragraph belong to the third party listing and do not have the corresponding authorisation To be transmitted by the RED system, the Social Institute of the Navy will make available, within the framework of the provisions of article 8 of Law 11/2007, of June 22, of electronic access of citizens to public services, always and where their personal difficulties or their reduced size and geographical location so require, a service of technical assistance and advice, including the means necessary to ensure the effectiveness of compliance with the obligation to incorporate effectively into the RED system.

This service will be provided during three consecutive quota settlement periods without being eligible for extension.

3. As from 1 March 2012, the provisions of Article 29 of the Order of 25 August 1970 on the collection systems of the Special Regime for the Social Security of the Workers of the Sea, concerning the (a) the settlement of the quota settlements of that special scheme.

Single transient arrangement. Income from contribution differences.

The differences in prices which could have been produced by the application of the bases of quotation laid down in this order in respect of the contributions which, as from 1 January 2012, would have been made, may be entered, without a surcharge, within the period ending on the last day of the second month following that of its publication in the Official Gazette of the State.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official Gazette of the State", with effect from 1 January 2012.
