Resolution 700 38028-2012, 11 April, Chief Of Staff Of The Army Of The Air, That Certain Powers Are Delegated Management Of Volunteer Reservists.

Royal Decree 1691/2003 of 12 December 2003 approving the Regulation on the access to and the regime of voluntary reservists, regulates the procedure and conditions for access to the condition of voluntary reservists. Armed forces, and establishes its legal regime.

By Resolution 700/38187/2007, of October 1, the Chief of Staff of the Air Force is delegated certain powers regarding the access and regime of the volunteer reservists.

By Royal Decree 383/2011, of March 18, the Regulations of Reserves of the Armed Forces are approved, repealing the precise Royal Decree 1691/2003.

In the operative part of the above mentioned Regulation the Chief of Staff of the Air Force and the Chief of Staff Command are attributed new competences and other of the previously conferred, in matter of personnel in relation to the volunteer reservists.

Order DEF/3537/2003, of December 10, for which the basic organic structure of the Armies is developed, holds the Directorate of Personnel, a body dependent of the Staff Command, responsible for the actions that correspond to the Air Force in the field of reservism.

Therefore, and in use of the powers conferred on me by Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, as amended by Law 4/1999, of January 13, I have:

First. Purpose.

Delegate certain powers attributed to the Chief of Staff of the Air Force and the Chief of Staff of the Air Force, regarding the access and regime of the volunteer reservists, to the Chief of the Command of Personnel or Personnel Command authorities that are indicated.

Second. Delegation of powers.

1) The Chief of Staff of the Air Force is delegated the granting of the acquisition of the condition of a voluntary reserve, which the Reserve Regulations of the Armed Forces, approved by Royal Decree 383/2011, On 18 March, in Articles 16 and 17, he attributes to the Chief of Staff of the Air Force.

2) The following powers are delegated to the Chief of Staff of the Air Force, which the Reserve Regulations of the Armed Forces, approved by Royal Decree 383/2011 of 18 March, attributes to the Chief of Staff of the Air Force:

-Agreed to the loss of the volunteer reservist condition.

-Recovering from the volunteer reservist condition.

-Concession of incorporation and cessation in the situation of activated for service delivery in units.

-Concession of the onboarding suspension.

-Determination of the ratio of volunteer reservists to be incorporated for missions abroad and the corresponding activation periods.

-Concession of the title of officer, noncommissioned officer and soldier, honorific reservist.

3) At the proposal of the Chief of Staff of the Air Force, the following powers are delegated to the Director of Education, which the Regulations of Reserves of the Armed Forces, approved by Royal Decree 383/2011, March 18, attributes to the Chief of the Air Force Staff Command:

-Reducing periods of military, basic, and specific training.

4) At the proposal of the Chief of Staff of the Air Force, the following powers are delegated to the Director of Air Force Personnel, which the Armed Forces Reserve Regulations, approved by Royal Decree 383/2011, of March 18, attributes to the Chief of Staff of the Air Force Staff:

-The granting of new commitments.

-Maintaining the employment previously achieved in the Armed Forces.

-Concession of incorporation and cessation of the activated situation to participate in continuing training programs.

Third. Administrative resolutions.

Administrative resolutions adopted pursuant to the previous paragraph expressly indicate this circumstance, stating in the foreword "By delegation" with reference to this Resolution.

Fourth. Vocation.

At all times and through a reasoned agreement, the Chief of Staff of the Air Force and the Chief of Staff of the Air Force will be able to endorse the knowledge and resolution of any issue of the respective Air Force. (a) the delegations referred to in this Resolution, in accordance with the provisions of Article 14 of Law No 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure.

Single repeal provision. Regulatory repeal.

Resolution 700/38187/2007, of October 1, of the Chief of Staff of the Air Force, is hereby repealed, whereby certain powers relating to the access and regime of the volunteer reservists are delegated.

All provisions of the same or lower rank are repealed in so far as they are contrary to the provisions of this Resolution.

Single end disposition. Entry into force.

This Resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
