The technical regulation of Control and certification of seeds of cereals, approved by order ARM/3368/2010, of 27 December, establishes the requirements that must be met in the process of production of cereal seed, in accordance with the Directive 66/402/EEC of the Council of 14 June, on the marketing of cereal seed.

This Directive 66 / 402 / EEC of the Council, of 14 of June, has been modified by the directive of execution 2012 / 1 / EU, of the Commission, of 6 of January of 2012, by which is modifies the annex I of the Directive 66 / 402 / EEC of the Council by what regard to them conditions that must meet the culture of «Oryza sativa».

This standard incorporates into domestic law directive execution 2012/1/EU, of the Commission, on January 6, 2012, through the corresponding modification of the technical regulation of Control and certification of seeds of cereals.

In the elaboration of the present available have been consulted them communities autonomous and them entities representative of the sectors affected.

By virtue, according to the Council of State, I have: single article. Modification of the regulation technical of Control and certification of seeds of cereals, approved by the order ARM / 3368 / 2010, of 27 of December.

Amending the technical regulation of Control and certification of seeds of cereals, approved by order of the Ministry of environment and Rural and marine, of December 27, 2010, in the following terms: one. In annex 1, the title of the fourth observation, as well as the first paragraph is replaced by the following text: «fourth. - plants of other varieties: in rice seed production plots the number of plants recognizable as manifestly wild or red grain shall not exceed: 0 for the production of basic seed. "

Two. In annex 1, the text of the sixth observation, is replaced by the following: «sixth. - infected plants: are considered infected the attacked by coal plants ("Ustilago spp..")» in the fields of wheat, barley and oat seed production, and helmintosporiosis ("Helminthosporium spp.") in barley and rice, as well as by "blast oryzae" in rice.

In the fields of production of seeds of rice, the number of plants recognizable as manifestly infected by "Fusarium fujikuroi" not exceed of: 2 by each 200 m² for the production of seeds of base.

«8 for each 200 m² for the production of seed certified of second generation.»

By this order is incorporates to the right Spanish the directive of execution 2012 / 1 / EU, of the Commission, of 6 of January of 2012, by which is modifies the annex I of the Directive 66 / 402 / EEC, of the Council, by what regard to them conditions that must meet the culture of «Oryza sativa».

Second final provision. Entry in force.

This order shall enter into force the day following its publication in the "Official Gazette".
