The Royal Decree 949/2001, of 3 August, which regulates the access by third parties to the gas facilities and establishing an integrated economic system of the natural gas sector, develops the basic lines which should contain rules management technology of the natural gas system, establishing in its article 13(1) to the technical manager of the system in collaboration with the rest of the subjects involved, prepare a proposal of standards of management technology system, which will elevate to the Minister for approval or modification.

Pursuant to the above, the Minister of industry, tourism and trade, it issued the order ITC/3126/2005, on 5 October, which approve the norms of technical management of the gas system. Such an order, in its first final provision empowers the Directorate-General for energy and mines to adopt the measures necessary for the implementation and enforcement of the order, in particular to approve and modify protocols detail the rules of technical management and other requirements, rules, documents and established operating procedures to allow the proper functioning of the system.

The aforementioned order ITC/3126/2005, of October 5, the standard of management technique NGTS-12, paragraph 12.2, gas establishes the creation of a working group for updating, revision and modification of the rules responsible for filing for approval by the Department of energy and mines, of proposals for updating, revision and modification of rules and protocols for management of the system.

Based on the above, is dated March 12, 2009, by the technical manager of the system, a proposal again received protocol detail ERM/EM enlargement criteria of transport, whose purpose is to define control parameters and the criteria which must be taken into account for the decision of extension of regulation and measurement (ERM) and stations of the measuring stations (EM) of the transport system.

According to the eleventh additional provision, paragraph third, law 34/1998, of October 7, the hydrocarbons sector, editorially given by law 12/2007 of 2 July, amending the law of hydrocarbons in order to adapt it to the provisions in the Directive 2003/255/EC of the European Parliament and of the Council of 26 June 2003 and article 13 of Royal Decree 949/2001 of 3 August, such proposed new Protocol detail has been subjected to the mandatory report of the National Commission of energy.

By virtue of, this General Directorate resolves: first.

Approves the Protocol in detail PD-14 criteria of definition of the degree of saturation of the regulation and measure stations and stations of measurement and procedure for implementation of proposals for action, included in the annex to the present resolution.

Second.

It replaces the content of paragraph 6.3.4 parameters and considerations for the calculation of the capabilities of a station of regulation and/or extent of the Protocol of detail PD-10 calculation of the capacity of the facilities by the following: is considered as nominal capacity, the maximum flow rate which can vehicular ERM/Ms according to their design features, without considering the reservation line using as parameters the control capacity and the ability to measure.

Regulation of an MRE capacity shall be calculated as the sum of regulating abilities of each of the lines, without considering the reservation line.

The ability to measure of an ERM/EM shall be calculated as the sum of the capacities of the measuring equipment installed in their lines, without considering the reservation line.

In summary, the ability of a station of regulation or measure shall be calculated taking into account: • number of lines.

• Joint regulation capacity of the regulating valves.

• Capacity of the turbine, depending on the standard size of the same measure.

• Conditions of pressure and temperature, and in particular the operating pressure of entrance and the absolute outlet pressure.»

Annex Protocol detail PD-14 criteria of definition of the degree of saturation of the regulation and measure stations and stations of measurement and procedure for implementation of proposals for action' 1. Object. - this detail Protocol aims to determine the criteria to determine whether a regulation and measurement (ERM) station / measurement station (EM) of the transportation system is saturated in their capacity of regulation or measure. Also it aims to establish the procedure to propose actions of technical adaptation to them.

3 definition of the criteria of saturation of ERM/EM.

3.1 period of assessment - in General, the period during which has to assess the State of saturation of the ERM/EM corresponds with winter, considered to be the range between 1 November of the preceding year and 31 March of the current year, both inclusive, equivalent to 3624 hours of sampling (3.648 hours in leap year).

• Average flow (Qmedio): media schedule media flows that have existed in the ERM/EM during the evaluation period.

4. Definition of the actions to perform.

4.1 activities to be carried out in case of ERM/EM saturated. - actions to be performed, in the event that they are viable, will be: • Retimbrado of lines.

• Replacement of counters.

• Expansion/replacement of regulators.

• Expansion with an additional line.

• Installation of a new ERM/EM.

The installation of a new ERM/EM shall take account of the following possibilities: • replace the old ERM/Ms by another on the same site.

• Construction of a new ERM/EM in a location adjacent to the old.

• Construction of a new ERM/Ms that can be alternative point of supply to the connected network.

4.2 analysis of the current state of saturation of ERM/em-each carrier shall draw up each year according to the criteria laid down in this Protocol, a study on the current state of saturation of their ERM/EM, indicating the degree of saturation.

4.3 analysis of the future state of saturation of ERM/em-for all connections with existing networks installation holder carrier will request annually tiered holder (carrier or distributor) forecasts of growth of the network downstream of the station for the next two years.

Before 15 June each year, companies distributors and carriers will send forecasts of demand in their networks. All holders of facilities connected in cascade will send the information to the holder of the upstream ERM/EM.

These forecasts must include the average demand and demand tip time planned for each of the two next winter, next to its justification, to distinguished between contracted for such periods demand and demand expected to hire.
Also, the Distributor may provide additional information about networks as it deems appropriate.

The carrier, with the information received by another licensee interconnected media, and new levels of maximum demand will determine annually the planned future degree of saturation of the ERM/EM.

In the ERM/EM connection between carriers will take into consideration the evolution of the capabilities provided for in mandatory planning.

4.4 report of proposals for adaptation of the ERM/em-before July 30 every year and in accordance with the previous paragraphs, each carrier will send to the Manager technical system (GTS), a report of proposals for adaptation of ERM/EM, that shall include, at least, the following aspects: • current state of saturation of ERM/Ms including Qmax, Q80 Q160 and hours hours.

• Information on the current demand, including demand and the average demand time point during the preceding winter period, and forecasts of growth for the two next winter periods, on networks connected to the ERM/EM in that it is necessary to make adjustments.

• Planned saturation State of ERM/MS in the following two years, including Qmax, Q80 Q160 and hours hours, and distinguishing between the contracted demand and that it plans to hire.

• Proposal for actions to be carried out, with their economic valuation (modifications, expansions, new facilities).

The report's proposals for adaptation of ERM/EM will include completed tables included in the annex 1.1, 1.2 and 1.3. When necessary, the GTS will update the formats of these tables, and forward them is to carriers and distributors in advance for their completion.

As a general rule, proposals for actions are always included in the ERM/EM whose planned State of saturation in one of the following two years out of grade 3. In addition, proposals will be included for the ERM/EM that for two consecutive years have been included in the annual report with planned State of saturation degree 2. Proposals are also included for the ERM/EM that, during three consecutive years, have been included in the annual report with planned State of saturation degree 1.

Also, as a general rule, among the possible actions on an existing ERM/EM that is saturated, always proposing the most economical option whenever it is technically possible, except where aspects of vulnerability of the connected network advise an alternative point of supply.

The proposal of actions to be carried out must be sufficient to meet the increased demand under the network for the next five years.

The GTS may request, in the event that it deems necessary, additional information to the carrier or dealer and, at the same time, the carrier/distributor may provide additional information deemed confidential and timely directly to the GTS.

With the whole of the data received by carriers, the GTS will prepare a final report, which will include both technical adequacy proposals and economic estimation, and an assessment about the suitability of the same. This report shall be sent to the Secretariat of State of energy of the Ministry of industry, energy and tourism before September 30 of each year.
