Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data (LOPD), states that the creation, modification or deletion of files of the Public Administrations shall be carried out by the means of a general provision published in the Official Journal of the State or the official journal concerned.

The Spanish Institute of Oceanography is a public research body, in accordance with the provisions of Law 14/2011 of 1 June, of Science, Technology and Innovation, under Royal Decree 345/2012, of 10 February, to the Secretariat of State for Research, Development and Innovation of the Ministry of Economy and Competitiveness. Its legal nature is that of the Autonomous Body, in accordance with the provisions of paragraph (a) of Article 43.1 of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State. Endowed with legal personality and its own heritage, it serves the scientific and technological policy of the State, in the field of oceanography and marine fishing.

The Implementing Regulation of the said Organic Law, approved by Royal Decree 1720/2007 of 21 December, regulates, in Article 53, the form of the provision or agreement to create, modify or delete the public ownership, establishing that where the provision relates to entities or bodies linked or dependent on the General Administration of the State, the form of ministerial order or resolution of the holder of the entity or appropriate body.

In accordance with the provisions of this article, this resolution is to regulate the files in the scope of the aforementioned Agency, having been informed by the Spanish Data Protection Agency in compliance with the provisions of this Article. Paragraph (h) of Article 37 of Organic Law 15/1999 of 13 December.

Therefore, in order to comply with the legal mandate of Article 20 of the said Organic Law 15/1999 of 13 December, as well as Articles 52 and 54 of its Implementing Regulation, as soon as they establish creating, modifying and deleting automated files containing personal data, I have:

Single item. Modifying files.

The personal data file that is listed in the Annex to this resolution is modified.

Single additional disposition. Responsibility for the files.

The Spanish Oceanography Institute, as the body responsible for its files, will take the necessary measures to ensure that the personal data available on them are used for the purposes and functions of public law which is entrusted to it, in relation to the Organic Law 15/1999 of 13 December.

Single end disposition. Entry into force.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".

Relation of modified files with personal data from the Spanish Oceanography Institute

Payroll.

General Data Protection Record Code: 1943292375.

(The purpose, data types, data collection procedure, collective, file manager, security measures, cessions, and ARCO rights exercise are modified.)

Data Types: The personal information contained in the file is structured as follows:

● Identificative data: NIF/DNI, N. SS/Mutuality, No. Staff Register, First Name and Last Name, Address, Signature.

● Personal Feature Data: Civil Status Data, Family Data, Date of Birth, Place of Birth, Sex, Nationality.

● Job Details Data: Body/Scale, Category/Grade, Jobs, Worker History.

● Economic and financial data: Income, income, Credits, loans, endorsements, Bank data, Pension plans, retirement, Payroll economic data, Tax/Tax deduction data, Mortgage.

● Character data specially protected according to article 81.5 and 81.6 of the RLOPD: Health (degree of disability or disability of the affected person for the performance of public duties); union affiliation (money transfer, associations).

Data Collection Procedure: Paper forms, official forms, email.

Collective: Staff who provide services at the Spanish Oceanography Institute.
