Article 20 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of the files of the Public Administrations may be made only by means of general provision published in the "Official State Gazette" or in the official journal concerned.

For its part, the Regulation on the Development of Organic Law 15/1999 of 13 December on the Protection of Personal Data, approved by Royal Decree 1720/2007 of 21 December, provides in Article 52 that the creation, the modification or deletion of the files of public ownership can only be made by general arrangement or agreement published in the "Official State Gazette" or corresponding official journal. In addition, in Article 53, it determines that where the provision relates to entities or bodies which are linked or dependent on the General Administration of the State, it may take the form of a decision of the holder of the entity or body. corresponding.

The Youth Institute, the Autonomous Body created by Royal Decree 1119/1977, of 20 May, has as general principles to promote equal opportunities among young people, to promote free and effective participation The European Union's youth in the political, social, economic and cultural development of Spain and to promote collaboration with the other ministerial departments and the other public administrations, whose activities have an impact on this sector of the population.

For its part, the Royal Decree 200/2012, of 23 January, which develops the basic organic structure of the Ministry of Health, Social Services and Equality, has in its article 2.7, which the Youth Institute is attached to Department through the Secretariat of State of Social Services and Equality, with the legal nature, structure and functions that are foreseen in its specific regulations.

In order to comply with the provisions of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, and thus to ensure that they are administered the exercise of their legitimate rights, the relationship is completed. of the files managed by the Youth Institute with the deletion of the files set out in Annex I to this Resolution, and the creation of other files in Annex II.

Those affected may exercise the right of access, rectification and cancellation of the personal data contained in these files, in accordance with the provisions of Law 15/1999 of December 13, of Data Protection Personal Character.

In its virtue, prior to the report of the Spanish Agency for Data Protection, I have:

First. Deleting files.

The deletion of the personal data files listed in Annex I to this Resolution is hereby declared. Those responsible for these files shall take the necessary measures to delete and destroy any number of copies of the security or the appropriate measures to comply with the current regulations, as they have become obsolete or have been completely replaced or updated by others. The Youth Institute will also carry out the necessary actions for the destruction and physical deletion of the files and will give the notification of the deletion of the files to the Spanish Data Protection Agency, for the realization of the appropriate procedures for the cancellation of your registration in the General Data Protection Register.

Second. Creating files.

The creation of the personal data files listed in Annex II to this Resolution is hereby declared, in the terms and conditions laid down in the Organic Law 15/1999 of December 13, Personal Data and its Implementing Regulation approved by Royal Decree 1720/2007 of 21 December.

These listed files have become obsolete. The current characteristics of these do not correspond to the current files in the Agency and therefore the declaration of deletion will be made to the General Registry of the Spanish Agency for Data Protection.

Reason for deletion: Changes to treatment and upgrade systems.
