Key Benefits:
The Ministry of Agriculture, Food and the Environment has a Central Laboratory for the Testing of Materials and Equipment of Riego, as part of the facilities of the National Center for the Technology of Irrigation (CENTER). on the farm "El Palomar" that the Ministry of Agriculture, Food and Environment has in San Fernando de Henares (Madrid). The Laboratory was created for conducting tests on irrigation, materials and irrigation equipment, dependent on the Subdirectorate General of Regadios and Water Economy of the Directorate-General for Rural Development and Forestry Policy.
The Laboratory provides service to meet specific demands voluntarily requested by users. These services generate an additional cost that is not attributable to the normal development of administrative management.
The work in the Laboratory is developed under the guidelines of a quality system based on the regulations UNE-EN-ISO/IEC 17.025 "General requirements for the competence of test and calibration laboratories" which ensures the competent management and the technical capacity of its facilities.
Law 8/1989, of 13 April, of taxes and public prices, sets out in Title III, the rules on the concept, value, fixing and administration of public prices. Article 24 defines the latter as the financial benefits which are satisfied by the provision of services or the performance of activities under the law of the public when, in addition, such services or activities are provided by the sector private, be of voluntary request on the part of the administered.
Applications for tests to perform the above activities have been increased in recent years, as well as the complexity of the test methods used, which makes it necessary to standardise carrying out the testing activities and the adequacy of their economic and administrative management to the existing rules on public expenditure and revenue. It is therefore advisable to issue an order fixing the public prices, which must be governed by the abovementioned measures, in the light of the fact that, in Article 26.1 (a) of Law 8/1989 of 13 April 1989, the establishment or Changes in public prices will be made in the order of the ministerial department on which the body is to be charged and on a proposal from the latter.
In its virtue and as provided for in Article 26.1 of Law 8/1989 of 13 April, I have:
Article 1. Object.
The purpose of this order is to establish public prices for the provision of the services of the Central Laboratory for the Testing of Irrigation Materials and Equipment referred to in Annex 1 of this Standard.
Article 2. Public pricing.
Public prices to be charged for the services referred to in this Ministerial Order are fixed in the amounts determined in Annex 1 of this Standard, all of which are inclusive of VAT.
Article 3. Submission of requests.
The application of the services to be provided must be in the model that to this effect is established by the Subdirectorate General of Regadios and Water Economy of the Directorate General of Rural Development and Forestry Policy.
The instance model can be downloaded on the website of the Ministry of Agriculture, Food and Environment (www.magrama.es), within the section of the National Center for Irrigation Technology (CENTER), and transmitted to the E-mail from the General Subdirectorate of Regadios and the Economy of Water.
It may also be filed through the media, and in the terms laid down in Law 30/1992, of November 26, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in Law 11/2007, of 22 June, Electronic Access of Citizens to Public Services.
Article 4. Method of payment.
The payment of the public prices fixed in the Annex of this Order will be made by the income of its amount in the Public Treasury by the means provided for in the General Regulations of Collection, approved by Royal Decree 939/2005 of 29 July, for which the General Rules of Collection are adopted.
Article 5. Obligation of payment.
The public prices set out in this provision shall be payable before the delivery of the results of the provision of the services concerned. The obligation to pay the regulated public prices in this order, is born, in general, since the service is started.
Single additional disposition. Administrative resources.
The administrative acts resulting from the management and collection of the public prices covered by this Order may be challenged in the form and time limits laid down in Articles 107 et seq. of Law No 30/1992 of 26 May 1992. November, the Legal Regime of Public Administrations and the Legal Procedure.
Single end disposition. Entry into force.
This order shall enter into force on the day following that of its publication in the "Official State Gazette".
