Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data establishes that the creation, modification or deletion of the files of public administrations can only be done by means of general provision published in the Official Journal of the State or the official journal concerned.

Order MAM/30 4/2003, of February 11, regulated the automated files of personal data of the Ministry of the Environment, including files managed by the Hydrographic Confederation of the North.

Order ARM/1683/2011, of June 2, regulated the files with personal data managed by the then Ministry of the Environment, and Rural and Marine, repealing the Order MAM/30 4/2003, of February 11, with the exception of of the files contained in the Annex which they have as the responsible organ of the Hydrographic Confederations, until their specific regulatory regulations are developed.

By Royal Decree 266/2008 of 22 February, the Northern Hydrographic Confederation was modified and divided into the Hydrographic Confederation of the Mino-Sil and the Hydrographic Confederation of Cantabrian. The Hydrographic Confederation of the Cantabrian succeeded the Northern Hydrographic Confederation in the goods, rights and obligations of it in the territorial scope of the part of the Spanish State of the Demarcation of the Cantabrian, to which the Article 3.1 of Royal Decree 125/2007 of 2 February laying down the scope of the river basin districts.

Later, Order AAA/1944/2013 developed the regulation of the personal data files of the Hydrographic Confederation of Cantabrian, repealing the previous regulations affecting the files of this Agency. registered in the name of the extinct Northern Hydrographic Confederation.

There is currently a need to reflect on the regulated files some changes that have their origin in the following news:

On the one hand, the implementation of a new information system in the Cantabrian Hydrographic Confederation, in order to improve the productivity and control of the activity of the displaced personnel in the field, has gone accompanied by the installation of geolocation devices on official vehicles.

In addition, the implementation of a new presence control system is incorporated, which allows the digital footprint to be collected as a means of identifying the body's personnel.

Finally, it responds to the desirability of recording IP addressing from which access to citizen participation forums and means of contact with the body are produced, especially for statistical purposes.

The modification of the content of the regulated files to incorporate these three innovations will affect the Human Resources, Citizen Participation and Web Contact.

In the preparation of this order, the Spanish Data Protection Agency and the Ministry of Agriculture, Ministry of Agriculture, Food and Environment have been asked to report.

In its virtue, I have:

Single item. Amendment of the Order AAA/1944/2013 of 16 October, which regulates the files with personal data of the Hydrographic Confederation of the Cantabrian.

One. The HR Management file of Annex I of Order AAA/1944/2013 of 16 October 2013, which regulates the files with personal data of the Hydrographic Confederation of the Cantabrian, is modified in the following terms:

Points (a), (b) and (c) are worded as follows:

" a.1) File name: Human Resources.

a.2) Detailed description of the intended purpose and uses: Management of workers ' payrolls and their associated products, as well as tax deductions, social insurance, time and face control, administration of human resources, prevention of occupational risks, mobility, locomotion, loans and training.

a.3) Tiification corresponding to the intended purpose and uses: Human resources, pension plans, payroll management, occupational risk forecasting, time control, locomotion, other purposes.

b) Source and provenance of data:

b.1) Collective or categories of stakeholders: Employees of the Cantabrian Hydrographic Confederation.

b.2) Data collection procedure: documentation provided by the worker himself or from other public administrations.

b.3) Source of data: Directly of the data subject and/or his/her legal representative, other persons (family data is provided by the worker), Public Administrations (BADARAL), Location data collected of geolocation systems using GPS or similar systems implanted in material means of the Agency (vehicles, mobile phones, tablets, laptops).

Basic structure and description of data types:

c.1) Data description:

Identifying character data: First and last name, DNI/NIF, N. Seg. Social/mutual, Address, Telephone, e-mail, Employee code, Image, Signature, fingerprint.

Data specially protected: Trade union affiliation with the purpose of making the transfer of money from the payroll of the workers who so request. Health data relating exclusively to the degree of disability.

Personal characteristics data: (Date birth, Sex, Age, Place of birth, Civil Status, Nationality, size (exclusively for uniforms), Filiation, Family situation, spouse and child data).

Academic and professional data: (profession, study certificates, driving license).

Job Detail Data: (Contract Type, Professional Category, Age, Body, Scale, Group, Level, Played, Center, Address, NIP (Environmental Agent Personal Identification Number).

Economic-financial data: (Bank data, payroll economic data, tax/tax deduction data, income, grants, pension plan, if any).

Other data: (Non-medical accident data), personnel positioning through the means assigned to your person, such as official vehicles, mobile and corporate laptops.

c.2) Treatment system: Mixed. "

Two. The citizen participation file of Annex I of Order AAA/1944/2013 of 16 October 2013, which regulates the files with personal data of the Hydrographic Confederation of the Cantabrian, is modified in the following terms:

" Basic structure and description of data types:

c.1) Data description:

Identifying character data: First and last name, DNI/NIF, e-mail, system access I.P. address.

Other data: Data that the data subject may contribute in relation to the object of his participation.

c.2) Treatment System: Automated. "

Three. The file Contact Web of Annex I of the Order AAA/1944/2013, of 16 October, is modified by which the files with personal data of the Hydrographic Confederation of the Cantabrian are regulated, in the following terms:

" Basic structure and description of data types:

c.1) Data description:

Identifying character data: First and last name, Address, e-mail, I.P. address of system access.

Other data: data that the citizen can provide on the occasion of their contact.

c.2) Treatment System: Automated. "

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
