The Status of the State Agency for the Evaluation of Public Policies and Quality of Services, approved by Royal Decree 1418/2006 of 1 December, establishes in Article 11 the functions of the President. Paragraph 3 of the same Article empowers the President to delegate to the management bodies of the Agency the powers conferred on him by points (a) and (f) of paragraph 1 of that Article, the provision of expenditure and the organisation of payments of the the budget of the Agency, as well as those other powers which may, by their nature and entity, be delegated.

The purpose of this resolution is to delegate, in use of the above powers, the exercise of certain powers of the President in the management of the Agency in order to ensure the agility of the execution of the management procedures and of achieving greater effectiveness in the performance of the Agency.

In its virtue, in use of the powers conferred on Article 11 of Royal Decree 1418/2006 of 1 December, approving the Statute of the State Agency for the Evaluation of Public Policies and the Quality of the Services, in accordance with the provisions of Article 13 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in the additional provision of the Law 6/1997, of 14 April, Organization and Functioning of the General Administration of the State, resolute:

First.

Delegate to the holder of the Management Department the exercise of the following competencies:

1. In the field of administrative procurement:

(a) All the powers conferred on the contracting authority of the Agency, with the exception of the order or the decision to initiate the file, and the award and formalisation of the contract. The memory of necessity and suitability shall in any case correspond to the promoter department.

(b) All the powers relating to the conclusion of minor contracts referred to in Article 138.3, in conjunction with Article 111 of the recast of the Law on Public Sector Contracts, approved by Royal Decree Legislative 3/2011 of 14 November, with the exception of the proposal or memory of necessity that will be the responsibility of the promoter department.

(c) The powers relating to the management tasks, with the exception of the proposal or memory of necessity and suitability which shall be the responsibility of the promoter department and the formalisation of the charge.

2. In the field of collaboration agreements:

The competencies corresponding to the processing of collaboration agreements, except the signature of the memory of necessity and suitability and the formalization of the convention.

3. In terms of expenditure:

a) The approval of credit holds and the authorization of expenses, as well as their cancellation.

(b) In relation to minor contracts, the authorisation and commitment of the expenditure, as well as the recognition of the obligations, and where applicable, the cancellation.

Second.

The delegation of powers provided for in this resolution will be revocable at any time by the President of the State Agency for the Evaluation of Public Policies and the Quality of Services. In addition, as the governing body of the delegated powers, the President may endorse the exercise of the delegated powers in accordance with Article 14 of Law No 30/1992 of 26 November 1992 on the Legal Regime of Administrations. Public and the Common Administrative Procedure.

Third.

In so many resolutions that are adopted in the exercise of the powers delegated by this Resolution, this circumstance shall be expressly stated by the mention of this Resolution and its date of publication in the "Official State Gazette".

Fourth.

The administrative acts performed by delegation shall be considered as adopted by the Chair of the State Agency for the Evaluation of Public Policies and the Quality of Services.

Fifth.

This Resolution shall produce effects from the day following that of its publication in the "Official State Gazette".
