Key Benefits:
Article 4 of the Notary Regulation approved by Decree of 2 June 1944 orders, as a general rule, that the notarial demarcation be fully reviewed every ten years. This mandate is based on the obligation to accommodate the notarial workforce to the needs of the notarial public service. Thus, the notarial demarcation is intended to create new Notaries, territorially reorder the existing ones and, if necessary, delete the ones that are unnecessary.
However, Article 4 of the Notary Regulation itself allows for the total modification or revision of the demarcation after only five years after the approval of the precedent provided that the requirements laid down in this Regulation are met. Article 3 of the Law of the Notary of 28 May 1862. This precept requires that in the demarcation be taken into account, in order to establish the scope of the public service to be attended, the population, the frequency and ease of the transactions, the circumstances of the locality and the decent subsistence of notaries.
The current demarcation, approved by Royal Decree 173/2007 of 9 February, on a notarial demarcation, brings about a markedly expansive economic situation, since its first works date back to 2004. From that moment on, and already in connection with article 3 of the Law of the Notary with the objectives of this royal decree, it is necessary to observe that our country has passed a situation of deep economic crisis that has reduced in a noticeable way the number of transactions, with the consequent decrease in demand for the notarial public service, which has caused a great difficulty in maintaining the viability of some Notaries.
Therefore, the demarcation that the present royal decree is approved aims not only to respond to the abrupt decrease in transactions, but also to solve problems of ordination of the Notary Body itself. have a direct impact on the way in which the notarial public service is provided and which is, in short, the basic criterion to govern how much review of the demarcation takes place.
Consequently, based on the purpose of improving the delivery of the notarial public service received by the citizens, a review of the notarial demarcation is appropriate, which for its full effectiveness must be accompanied by a correct frequency of the call for oppositions, the promotion of the administrative career and, in short, the due adjustment of the number and classification of the Notaries to the current economic situation of the country and the forecasts of the next evolution.
The general criteria set out are intended to ensure the accessibility of citizens to notarial services on a level playing field throughout the national territory. Without prejudice to the technological advances of the information society, which are very useful for the exercise of their functions by the Notaries, the closeness and the personal advice of the Notaries remain the basis for the recognition of the legal effects of the notarial document. For this reason, the rural places are kept to the maximum, in any case the one-person ones, in order to guarantee the existence of notarial offices in places where previously they did not exist, avoiding the citizens inconvenient displacements. In addition, the new social demands are met, as is the case for the telematic creation of companies and companies through the formation of the PAE (points of support for the entrepreneur) in populations of less than 500 inhabitants, in which the Notary, Uniformly technical throughout Spain, it is very often the only public office in the area. With regard to plurialist places, the criterion of their restructuring is adopted, with depreciation only of those which are not essential for the provision of an adequate public service on the basis of the volumes of population and recruitment of each locality.
A logical consequence of the plurality of notarial offices in the same district and the disappearance of the so-called "zones" for the reform of the Notary Regulation carried out by Royal Decree 45/2007, of 19 of January, by which the Regulation of the Organization and the Notarized System, approved by Decree of 2 June 1944, is amended, will be the one to stimulate competition between notaries, within the parameters that their bifronte character of professional and public official permits, making it easier for citizens to exercise their right of free choice of notary.
On the other hand, it is reasonable to have access to the most relevant places on criteria of merit or experience. Therefore, it is necessary to encourage, both the characteristic procedure of internal promotion by contest opposition between notary in exercise, and to propose an equitable reduction of places in the cities and relevant localities currently undervalued.
In short, it is a matter of amoldar the revision of the notarial demarcation to the mentioned purposes, distinguishing between the various notarial categories and adapting the notarial demarcation to the current needs of an adequate one and more optimal attention to the user.
In the process of the demarcation file that is approved by the present royal decree, the Autonomous Communities have been involved, reports from Ayquestas, Superior Courts of Justice, Judicial Authorities, General Council of the Notary, College of Registrar of the Property and Mercantile and Real Estate of Spain, Territorial and Autonomous Deans of the Registrars and data corresponding to the all registrars and notaries in active. The reports of the Ministries of Finance and Public Administrations and the Economy and Competitiveness have also been reported.
This royal decree is dictated by the exercise of the competence of the State provided for in Article 149.1.8. of the Constitution. With regard to the Autonomous Community of Catalonia and in observance of the powers on the demarcation of power provided for in Article 147.1.c of the Organic Law 6/2006, of July 19, of reform of the Statute of Autonomy of Catalonia, interpreted as According to the judgment of the Constitutional Tribunal 31/2010 (FJ 90), the State establishes the general criteria for the demarcation and establishes the number and classification of Notaries in the territory of that autonomous community by provinces. This action is considered essential for the effects of general coordination to ensure a balanced ratio of notarial presence throughout the national territory and for the configuration of the body of Notaries as a single national body. of officials (STC 4/2014, FJ 4). It is up to the Autonomous Community of Catalonia, in the exercise of its implementing powers, to distribute within the various provinces the number and class of the Notaries provided for as well as the determination of the notarial districts, according to criteria which it considers appropriate in the light of the public service needs. In relation to the Autonomous Community of Andalusia, respecting the provisions of Article 77.1. of the Organic Law 2/2007, of March 19, of reform of the Statute of Autonomy for Andalusia, includes the complete notarial demarcation in its territory, with the compliance of that Autonomous Community.
In its virtue, on the proposal of the Minister of Justice, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on March 6, 2015,
DISPONGO:
Article 1. Review of the notarial demarcation.
In accordance with the provisions of Article 3 of the Notary Law and Articles 4, 72, 74, 76 and 77 of the Notary Regulation, the notarial demarcation is revised, the demarcation and the notarial classification being approved in the terms set out in this Royal Decree and in the Annex which is inserted below.
Article 2. General criteria.
The general criteria on which the notarial demarcation review is based are as follows:
1. Facilitation of citizens ' access to the notarial service and the capillarity of the notarial presence in the territory of the State.
2. Favor of the right to the free choice of notary, stimulating the competition among the notaries.
3. Sustainability of notarial offices.
4. Encouragement of permanent high level legal training of notaries and progression in the professional career.
Article 3. Specific criteria.
In developing the general criteria established by the previous article, the determination of the places to be created or abolished throughout the State will respect the following specific criteria:
1. All Notaries will be maintained in the populations with a single demarcated square.
2. In populations with two demarcated squares, one of them may be removed only, exceptionally, in the case of obvious cases of economic infeasibility.
3. The deletion of Notaries will be carried out in preference to:
-The decrease in economic transactions in each population or notarial district.
-The reduction of the average total notarial activity in each population.
-The non-existence of a notarial public service claim that allows the economic costs of an excessive number of Notaries to be borne in the same population.
-The sustainability of dispatches and stability in employment.
4. Under equal circumstances, the upper class notary shall be written off with preference to the lower class.
5. Exceptionally, places may be created in those localities where there has been a significant increase in population resulting in disproportion between the number of inhabitants and the number of notaries.
6. Installation or transfer of Notaries in neighborhoods to the increase of population and their expected growth, as well as to the installation of industrial or population nuclei near the town.
Article 4. Number and category of Notaries.
In application of the criteria provided for in the above articles, the following number and category or class of Notaries are set:

Article 8. Date of effect of the depreciation of Notaries.
Deleted places that have been declared deserted due to a lack of applicants in the last competition for the provision of vacant vacancies will be amortized to the date of entry into force of this royal decree or decree of the competent Autonomous Community.
Other deleted places which are vacant at the date of entry into force of this royal decree or of the corresponding decree of the Autonomous Community or which in the future become vacant shall be understood as amortised in the form provided for in the third paragraph of Article 74 and Article 76 of the Notary Regulation, with the exception of Notaries installed in neighbourhoods or population centres referred to in the previous Article, which shall not be amortized.
Article 9. Functional mobility.
The Notaries in whose locality or district a new notary is created or whose territorial competence is diminished, as well as the surplus of demarcation for the depreciation of the Notaries that they were holders, will be able to attend without subject to the limitation referred to in Article 95 of the Notary Regulation.
Single additional disposition. No increase in public spending.
The entry into force of this royal decree will not result in an increase in the number of personnel, nor in the remuneration, nor in other personnel expenses with budgetary impact in any public administration.
Single repeal provision. Regulatory repeal.
1. Royal Decree 173/2007 of 9 February 2007 is hereby repealed on a notarial demarcation.
2. Similarly, any provisions of the same or lower rank shall be repealed as laid down in this royal decree, or amended by it.
Final disposition first. Enabling regulatory development.
The Minister of Justice is empowered to lay down the additional rules necessary for the application of this royal decree.
Final disposition second. Conformity of the Autonomous Community of Andalusia.
In the exercise of the executive powers conferred by the constitutionality block and the legislation in force, the Autonomous Community of Andalusia has provided its conformity to the determination of the demarcation The notarial is foreseen in the present royal decree. However, any subsequent review of the notarial demarcation in the territory of this autonomous community shall have the express consent of the same.
Final disposition third. Competence title.
This royal decree is approved in accordance with the provisions of Rule 8. of Article 149.1 of the Spanish Constitution, which attributes to the State exclusive competence over the management of public records and instruments.
Final disposition fourth. Entry into force.
This royal decree will enter into force on the day following its publication in the "Official State Gazette".
