Royal Decree 1630/1992 of 29 December 1992 laying down provisions for the free movement of construction products pursuant to Directive 89 /106/EC, as amended by Royal Decree 1328/1995 of 28 July 1995, establishes, in Article 4, point 2, 2., that the references of the Spanish rules "UNE" which are the transposition of harmonised standards will be published in the "Official Gazette of the State".
The European Commission has been adopting Decisions, from the year 1995 to the present, which have been published in the L series of the Official Journal of the European Union, establishing conformity assessment systems. with the essential requirements of Directive 89 /106/EEC of the families of products subject to Directive 89 /106/EEC.
In the Communications of the Commission, to give publicity to the availability of harmonized standards of the different families of products, the dates of entry into force and the end date of the period of coexistence are established concerning the use of the CE marking for the relevant products.
In the Order of 29 November 2001 of the Ministry of Science and Technology, references to harmonised standards, co-existence periods, entry into force of the CE marking and notified bodies relating to a Article 5 of the Directive empowers the Director-General of Technology Policy to update or extend, by way of resolution, Annexes I, II and III to the Directive, which is transferred to the Directorate-General for Industrial Development of the Ministry of Industry, Tourism and Trade under the Royal Decree 1554/2004, dated 25 June, transferred to the Directorate-General for Industry of the Ministry of Industry, Tourism and Trade in accordance with Royal Decree 438/2008 of 14 April, and transferred to the Directorate-General for Industry and Small and Medium-sized Enterprises Company pursuant to Royal Decree 344/2012 of 10 February.
Having published a new Communication from the Commission which recasts, updates and extends the previous Communications for the entry into force of the CE marking for various product families, the Commission has transposition into national law.
This resolution, as a continuation of the European provisions on this subject, will be applicable in the field of Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 establishing harmonised conditions for the placing on the market of construction products and repealing Council Directive 89 /106/EEC.
