Article 6 of Royal Decree 1076/2014 of 30 December 2014 on the allocation of rights to the basic payment scheme of the Common Agricultural Policy provides that the basic payment scheme shall be applied in Spain following a model national implementation based on regions established on the basis of administrative, agronomic, socio-economic and regional agricultural potential criteria. Article 7 of the Royal Decree provides that the territorial definition of the regions based on the productive potential they present as well as the productive orientation determined in the Community is determined in Annex II to that rule. 2013 marketing year for areas declared in that marketing year or for use as reflected in the geographical identification system for agricultural parcels (SIGPAC) for areas not declared in that marketing year. Such productive orientation may be dry land, irrigated farmland, permanent crops and permanent pasture.

For its part, Article 14.2.b) of Royal Decree 1076/2014 of 30 December 2014 provides that in the case where the farmer declares in more than one region the calculation of the initial unit value of each of the basic payment entitlements to be allocated to that farmer in 2015, excluding allocations from the National Reserve, shall be made by means of a distribution, on the basis of objective and non-discriminatory criteria, of the amounts received in 2014, as Article 13.3 of the said royal decree, between the area declared by each producer in each of the regions included in your single application.

It is therefore necessary to set the objective and non-discriminatory criteria for the allocation of the amounts received in 2014 between regions. It is therefore proposed to make a division on the basis of the area declared in each region in which the amounts to be allocated to it are weighted according to their productive orientation as reflected in the reference layer which is establish the effect on the SIGPAC. This weighting will be based on the participation of each productive orientation in the production of the Spanish Agrarian Branch in the period 2011 to 2013. The production of the Agrarian Branch, calculated by the Ministry of Agriculture, Food and the Environment on the basis of the Eurostat methodology, represents, in an objective and non-discriminatory manner, the contribution of each of the guidelines productive to the national agricultural income.

Thus, for the determination of the factors established in this Ministerial Order the value of the Production of the Agrarian Branch has been determined in each of the productive orientations, and then they have been divided amounts between the total hectares per productive orientation declared by the farmers for the recovery of direct aid from the CAP in 2013. In this way average values of amounts per hectare and productive orientation have been obtained. In order to factor these values, it is established that the Permanent Crop is the value 1 and it is calculated how much each of the other types of productive orientation assumes in proportion to this reference value, obtaining finally some weighting factors that reflect that irrigated areas are the ones that contribute the most to the production of the Agrarian Branch and, therefore, have a higher weighting coefficient. Then there is the permanent crop, then the dry and finally the pastures. This is a target calculation, based on statistical data from 2011 to 2013, and is non-discriminatory as it treats all farmers equally on the basis of the type of area they declare. This objective and non-discriminatory treatment is a requirement of the Community regulations to which the proposed calculation methodology is met.

This order is issued in accordance with the final provision of Royal Decree 1076/2014 of 30 December 2014, which enables the Minister of Agriculture, Food and the Environment to establish by means of the objective and non-discriminatory limits for the process of the allocation of basic payment entitlements.

In the processing of this order the Autonomous Communities and the most representative entities of the sector concerned have been consulted.

In its virtue, according to the State Council, I have:

Single item. Distribution coefficients to be used for the calculation of the initial value of the basic payment entitlements.

To carry out the calculation of the initial value of the basic payment entitlements in the cases provided for in Article 14.2.b) of Royal Decree 1076/2014 of 30 December 2014 on the allocation of rights to the basic payment scheme Common Agricultural Policy, where a farmer declares a land area in more than one region, a share of the total payments received by the farmer in 2014 shall be allocated in each region. This allocation shall be carried out in proportion to the area declared in each region, by applying a weighting factor to those areas in the light of their productive orientation, in accordance with Annex II to that royal decree. The production guidelines used for the weighting shall be those with the areas in the geographical identification system for agricultural parcels (SIGPAC) in the reference year 2013. The weighting factors shall be as follows:

Productive land crop orientation of secano: 0,568.

Productive orientation land of irrigated cultivation: 1,717.

Permanent Crop Orientation: 1.

Permanent Pasture Orientation: 0.376.

Single end disposition. Entry into force.

This order shall enter into force on the day of its publication in the "Official State Gazette".
