He Council of Ministers, in its meeting of 13 of March of 2015, to proposed of the Commission associate of the Government for Affairs economic, adopted the agreement that figure as annex to this resolution, by which is reviewed and modified them types of interest effective annual force for them loans qualified or agreed granted in the framework of the program 1997 of the Plan of housing 1996-1999 Housing plan 2002-2005 and Housing Plan 2005-2008.

For general knowledge, it has the publication of said agreement as annex to this resolution.

ANNEX agreement by which is reviewed and modified them types of interest effective annual force for them loans qualified or agreed granted in the frame of the program 1997 of the Plan of housing 1996-1999, Plan of housing 2002-2005 and Plan of housing 2005-2008 in them plans state of housing 1996-1999, 2002-2005 and in the 2005-2008, is established the criteria for set them types of interest effective annual initial, the loans granted by credit institutions, within the framework of the cooperation agreements, signed by them, with relevant, competent ministries in housing, to finance actions declared as protected in those plans, as well as, in some cases, their reviews.

In the regulatory regulatory of such plans, is established also, them moments, dates or periodicity and them methods applicable to make them reviews established, of them types of interest effective annual, applicable to them loans qualified and agreed.

By agreements of the Council of Ministers of May 18, 2012 and April 11, 2014 was the latest revision of the rates of interest applicable to qualified loans under the 1997 program Plan 1996-1999, as well as the rest of these plans, 2002-2005 and the 2005-2008, respectively, and set interest rates at the 3.30 per 100 yearly for the 1997 programme , in the 2.97 by 100 annual for the Plan 2002-2005, and in the 2.98 per 100 yearly for the Plan 2005-2008.

Appropriate, again, carry out a review of these annual effective interest rate, applying appropriate methodologies, in each case, to the following considerations: i. Programme 1997 Plan 1996-1999.

According to the agreement of the Council of Ministers of 6 of June of 1997, the review of the type of interest effective, is calculated by a type half of reference, retrieved as average of them six last months with the information available posted of the type of reference of them loans mortgage of the set of entities financial weighing the double of the value the corresponding to them two last months. The revised effective interest rate shall be, in each case, 90 per 100 of the value of the average reference type. The new rate will apply if the difference between the current is, at the time of the review, at least one percentage point.

In accordance with the above, to the date of commencement of processing the file, values corresponding to the last six months that the Bank of Spain has published benchmark of interest rates corresponding to the set of credit institutions are, in per cent:-July 2014: 3,033.

-August 2014: 3,021.

-September 2014: 2,949.

-October 2014: 2,819.

-November 2014: 2,606.

-December 2014: 2,557.

Type revised resulting loans: programme 1997, plan 1996-1999 Tt 3,033 + 3,021 + 2,949 + 2,819 + 2 x 2,606 + 2 x 2,557 = 22,1480 = 2,7685 = 8 8 2,7685 × 90% = 2,49165 rounded to two decimal places: 2,49 such does not differ by more than one percentage point of the force since 2012: 3.30% type.

Therefore, the type of interest effective annual resulting of the review carried out in the first quarter of the 2015, applicable to them loans granted by them entities of credit, in the frame of them agreements with the Ministry of promotion for the program 1997 will continue being of the 3.30 percent annual.

II. Plan 2002-2005.

In the first quarter of the year 2015, appropriate, in compliance with that stipulated in article 5.c) of Royal Decree 1/2002, of 11 January, on measures of financing of the Housing Plan 2002-2005, revise and modify, where appropriate, the type of existing annual effective interest applicable to the totality of the loans or to grant in the framework of the Housing Plan.

Accordance with article 5.c) of the aforementioned Royal Decree, the revised rate of loans granted in the framework of the various programmes of the 2002-2005 plan, will be equal to the average of the values of the last two months, with available information, reference percentage rate, rounded to two decimal places, from loans of the Assembly prepared by the Bank of Spain credit institutions affected such a mean by a percentage. That percentage will be the 91,75 by 100, established in the agreement of the Council of Ministers of 5 April 2002, as a result of the application of a system of competitive offerings, by credit institutions which were proposed to assist in the financing of the 2002-2005 Plan.

The application of the system of competitive offerings, was carried out following the order FOM/268/2002, on 11 February, which develops and concrete the procedure to follow in this respect.

In accordance with the above, the values corresponding to the last two months, as the date of processing the file, for which the Bank of Spain has published a benchmark of interest rates corresponding to the set of credit institutions are as per cent:-November 2014: 2,606.

-December 2014: 2,557.

Type revised resulting loans: Tt = 2,606 + 2,557 × 0,9175 = 2,5815 x 0,9175 = 2,3685 2 rounded to two decimal places: 2.37.

Therefore the type of annual effective interest resulting from the review effected, applicable to loans granted by credit institutions, within the framework of the signed agreements with the Ministry of public works for the Housing Plan 2002-2005, funding will be 2.37 per cent per annum.

III. 2005-2008 Housing Plan.

In the first quarter of the year 2015, appropriate, in compliance with that stipulated in article 9.3 of the Royal Decree 801/2005, of 1 July, on measures of financing of the Housing Plan 2005-2008, review and modify, where appropriate, the type of existing annual effective interest applicable to the total of loans granted or granted in the framework of the Housing Plan.

According to the article 9.3 of the cited real Decree, the type of interest revised of them loans to grant in the frame of them different programs of the plan 2005-2008, will be equal to the application of a coefficient reducer to the half of them three last months, with information available, of the type percentage of reference, rounded to two decimals, of them loans mortgage of the set of entities of credit made by the Bank of Spain. The coefficient reducer will be the 0,9175, established by the agreement of the Council of Ministers of 5 of April of 2002.

In concordance with it earlier, them values corresponding to them three last months, to the date of home of the processing of the record, for which the Bank of Spain has published indices of reference of types of interest corresponding to the set of entities of credit are, insofar as percent:-October 2014: 2,819.

-November 2014: 2,606.

-December 2014: 2,557.

Type revised resulting loans: Tt = (2,819 + 2,606 + 2,557) × 0,9175 = 2,6607 × 0,9175 = 2,4412 3 rounded to two decimal places: 2.44.

Therefore the type of annual effective interest resulting from the revision is made, applicable to loans granted and granted by credit institutions, in the framework of the agreements with the Ministry of housing, and currently with the Ministry of development, for the Housing Plan 2005-2008, funding will be 2.44 per cent per annum.

By virtue, on the proposal of the delegate of the Government Commission for Economic Affairs, the Council of Ministers, at its meeting of 13 March 2015, agrees: first. Permanence of the effective interest rate annual, revised, applicable to the qualified loans granted in the framework of the program the Housing Plan 1997 1996-1999.

The type of annual effective interest applicable to loans qualified granted by credit institutions to finance actions protected in terms of housing and land, within the framework of the agreements signed for the 1997 programme of the Housing Plan 1996-1999, between credit institutions, and the Ministry of public works, will continue to 3.30 per cent per annum.

Second. New type of annual effective interest, revised and amended, applicable to the qualified loans granted for the financing of the Housing Plan 2002-2005.

1. the new type of annual effective interest applicable to the qualified loans granted by credit institutions, to finance actions protected in terms of housing and land, within the framework of the agreements signed for the Housing Plan 2002-2005, between credit institutions and the Ministry of public works will be 2.37 per cent per annum.


2. This revised and amended, interest rate shall apply, in addition, to all the qualified loans granted by credit institutions within the scope of the agreements for the financing of actions protected the Housing Plan 2002-2005, beginning from the first maturity arising out, once elapsed a month from the day of its publication in the «Official Gazette».

Third. New type of annual effective interest, revised and amended, applicable to the agreed loans granted for the financing of the Housing Plan 2005-2008.

1. the new type of interest effective annual applicable to them loans agreed granted by them entities of credit, to finance performances protected in matter of housing and soil, in the frame of them conventions subscribed to the Plan of housing 2005-2008, between the entities of credit and the Ministry of housing, will be of the 2.44 percent annual.

2. this interest rate will apply to all loans agreed as granted by credit institutions collaborating, corresponding to the mentioned Plan 2005-2008, except to those who referred to 1.b) of the first transitional provision of Royal Decree 801/2005 of 1 July, which will be governed by the provisions of the order FOM/268/2002 , of 11 of February, and in the agreements of the Council of Ministers that review the type of interest of the loans agreed of the Plan of housing 2002-2005. The new type of interest will be of application from the first expiration that is produce, elapsed a month of the publication of this agreement in the «Bulletin official of the State».

Room. Application of new modified without costs for the borrowers interest rates.

Credit institutions who granted the corresponding qualified or agreed, loans referred to in the preceding paragraphs of this agreement, apply the new rate of interest established without cost to the borrowers.
