Article 4 of Law 39/2003, of 17 November, of the Railway Sector, states that the General Interest Rail Network shall be composed of the railway infrastructure that is essential to ensure a system common transport transport throughout the territory of the State or whose joint administration is necessary for the proper functioning of such a common transport system, such as those linked to international traffic routes, which link the different Autonomous Communities and their connections and access to the main population and transport centres or facilities essential to the economy or national defence.

According to the same article, it is up to the Minister of Development to agree, at any moment, to the inclusion, in the General Interest Railway Network, of new railway infrastructures when reasons of general interest so justify, prior to the report of the Autonomous Communities concerned. If the railway infrastructure which is to be included in the General Interest Railway Network, in its entirety, runs through the territory of a single Autonomous Community and without connection to the rest of the Network, it shall be necessary for such inclusion. prior consent.

On the other hand, the additional provision of the Law in the ninth part of the Law pointed out that the General Interest Railway Network would be composed at the time of the entry into force of the Law, of all the railway infrastructures that on that date they were administered by RENFE or whose administration would have been entrusted to the Railway Infrastructure Manager or the corresponding Port Authority in the Ports of General Interest. Equally, the metric wide network of State ownership and managed by FEVE, would integrate the Network of General Interest.

This additional provision has been affected by judgment 245/2012 of 18 December 2012 of the Constitutional Court, and, in accordance with it, Royal Decree-Law 4/2013 of 22 February, and subsequently the Law 11/2013, of 26 July, has given a new wording to it pointing out that, within six months, the Ministry of Development will establish the "Catalog of Lines and Tramos of the Network of General Interest", according to the criteria established in Article 4 of the Law of the Railway Sector. This Catalogue shall relate the lines and sections according to an official code assigned by the Directorate-General of Railways, and shall express their origin and destination and a brief reference to their technical characteristics.

In this catalogue, the lines and sections of general interest will be on the one hand and, on the other hand, the lines and sections of the previous independent, which do not meet the requirements of Article 4 of the Law of the Railway Sector, continue to be administered in accordance with the provisions of the Law of the Railway Sector, while, upon application by the Autonomous Community of the General Administration of the State, the transfer of the the corresponding line or section.

In any case, for the purposes of determining the Catalogue, or of its modifications, the Autonomous Communities shall be heard by those who pass through, or in their case fully understand in their territory, the corresponding lines or sections rail.

In the preparation of the present "Catalogue of Lines and Tramos of the Network of General Interest" has turned to a relation of linear elements, although it must be considered that the Network of the General Interest composed of railway infrastructure, as expressed in Article 3 of the aforementioned Law 39/2003. In this way, all the elements that form part of the main routes and of the service and the branch of diversion for individuals are considered included in the catalogue, with the exception of the routes within the workshops of repair of rolling stock and of tanks or garages of traction machines. Thus, among these elements are the grounds, the stations, the cargo terminals, the civil works, the steps at level, the facilities linked to security, to the telecommunications, to the electrification, to the signaling of the lines, lighting and the processing and transport of electrical energy, and their attached buildings.

In addition, and in relation to the technical characteristics of the lines and sections included in the catalogue, it has been considered appropriate to limit them to the most basic and representative avoiding redundancies or differences with what they should be available in the network declaration documents which are regularly updated by the railway infrastructure managers.

It should also be noted that all the lines and sections included in this Catalogue maintain a clear functional rail relationship, so that the actions, which can be carried out in each of these sections, show effects of diverse range in the rest. It has therefore been considered appropriate to take into account the possible existence of these interdependencies and their joint consideration in the same network, when establishing the Catalogue.

This order has been submitted to the hearing of the Autonomous Communities, the railway infrastructure managers and the Port Authorities.

In its virtue, on the proposal of the Directorate General of Railways, with the agreement of the Secretary General of Infrastructures and the Secretary of State for Infrastructures, Transport and Housing, I have:

First. Catalogue of lines and sections of the Railway Network of General Interest.

The Catalogue of lines and sections of the General Interest Rail Network, detailed in the annex accompanying this order, consists of three different blocks of lines and sections:

1. A set of lines and sections ensuring a common rail transport system and the joint administration of which is necessary for its proper functioning.

This group includes those linked to international traffic routes, which link different Autonomous Communities and their connections and access to the main population and transport centres or to facilities. essential for the economy or national defense. Port networks and their accesses are not considered in this block.

Sections and subsections of varying length are grouped according to the cases, so that complete itineraries of the network are presented, in most cases coinciding with the commonly used denomination. In each of these routes, small sections are considered to be included, although they do not have a main function in the transport system, such as connections, access to parks and others, they are also necessary for the proper functioning of the system. system.

The large axes are coded with two digits that are added three more digits to encode the different sections that make up them:

08-Metric Width Network (except Cough Line).

2. Port networks and their access.

The networks located inside the ports as well as the sections of external access to the ports are included but only comply with that function.

The code that has been assigned is formed by following the following schema: the letter P followed by three digits of which the first two indicate the provincial code and the third the sort.

3. Section Figueras-Frontera Francaise (belonging to the International Section Figueras-Perpignan).

In this case there is a single stretch for which a code consisting of the letter I followed by the three digits 001 has been assigned.

All the lines and sections of these three blocks have been analyzed in detail to verify that they currently meet the requirements of Article 4 of the Law of the Railway Sector. It has also taken into account the possible existence of planned actions in the railway planning, which impose the need to maintain a certain section in the RFIG, as well as the desirability of looking at certain sections in the analysis for adequately reflect the economic sense of the whole and ensure the rationality of the rail network.
