Article 11.2 of law 30/2014, of 3 December, national parks, establishes that the Council of Ministers may join adjacent land national parks with similar characteristics to them or whose values are complementary with those when fulfilled in them any of the following circumstances: to) that are belonging to the State or the autonomous communities.
(b) that are built-in to the heritage public for the best compliance of those purposes and of the referred law of parks national.
(c) that are provided by their owners for the achievement of these purposes.
Based on that article, dated 30 January 2015, the Council of Ministers has agreed the extension of the National Park of the Picos de Europa by incorporation territories adjacent to it expressly provided by its owners, with an area of 2,467 has 59 to 36 AC.
Given the need for wide dissemination of the agreement of enlargement, in attention to the general interest and the legal significance that resides therein, this Presidency has resolved: order the publication in the "Official Gazette" of the agreement of Council of Ministers, which expands the boundaries of the National Park of the Picos de Europa by incorporation of land adjacent to the same.

AGREEMENT BY THE COUNCIL OF MINISTERS THAT EXPANDS THE BOUNDARIES OF THE NATIONAL PARK OF THE PICOS DE EUROPA BY INCORPORATION OF LAND ADJACENT to THE SAME first.
Of conformity with the article 11.2 of the law 30 / 2014, of 3 of December, of parks national, and with the article 2.2 of the law 16 / 1995, of 30 of mayo, of Declaration of the Park national of them peaks of Europe, is agrees to the enlargement of the Park national of them peaks of Europe, incorporating different land public and of particular expressly provided by property owners for the fulfilment of the purposes of the National Park. These land are adjacent with the Park in a surface of 2,467 has 59 to 36 ca, and have of them features natural suitable for this, as is described in the annex I of this agreement and according to the limits and boundaries that is defined in the annex II of the same.
As a result of enlargement and correction of the quantification of the total surface area provided by the municipality of Peñamellera Baja the total area of the National Park of the Picos de Europa is set in 67.127 has 59 to 36 ca, belonging to the municipalities of Amieva, Cabrales, Cangas de Onís, Onís, Peñamellera Alta and Peñamellera Baja in the autonomous community of the Principality of Asturias; of Camaleño, Cillorigo de Liébana and Tresviso in the community autonomous of Cantabria; and of Oseja de Sajambre and Posada de Valdeón, in the autonomous community of Castile-Leon. Them limits geographical of the Park national of the peaks of Europe, thus expanded, are that appear cartographically in the annex III of this agreement.
EXHIBITION national parks in Spain make up a network coherent, homogeneous and representative of the natural systems of our country at the service of the conservation of its natural values and enjoyment by all citizens. They are declared by Act of the Cortes Generales, and though its further enlargement is covered with the character of a statement in itself, the legislator has established some exceptional circumstances where will empowers the national Government to proceed in that regard by agreement of the Council of Ministers, dramatically simplifying the procedure not to specify this is the participation of the Cortes Generales.
In accordance with article 11.2 of the law 30/2014, of 3 December, national parks, the Government, on the proposal of the Ministry of agriculture, food and environment on its own initiative, or at the initiative of the corresponding Autonomous Community, can join a National Park terrestrial or marine spaces adjacent to the same, similar, or whose values are complementary with the one (, when if any of the following circumstances: to) that are of ownership of the State or of them communities autonomous.
(b) that it be incorporated into the public assets for better compliance with the purposes and the aforementioned National Parks Act.
(c) that are provided by their owners for the achievement of these purposes.
Law 16/1995, 30 may, Declaration of the National Park of Picos de Europa also includes enlargement by this exceptional procedure.
The proposal that meets these requirements, since enlargement which is proposed is, for the most part, on areas of public property composed of mountains of public utility of the municipalities of Peñamellera Alta and Peñamellera Baja and in a reduced surface, on grounds of alleged private property, provided with the express agreement of the property owners for the fulfilment of the purposes of the law 30/2014 , of 3 of December, and of the law 16 / 1995, of 30 de mayo.
He mentioned article 11 of the law of parks national, is clear as regards them requirements of ownership or possession and as soon as them values natural requires, in first place, that is produce on land adjoining and sets two possible requirements: that are of similar features to them of the Park national, or that their values are complementary to them of the Park national.
The definition of what are those «similar» is inferred from the characteristic features that the Director Plan of the network of national parks established for the territories to include in these spaces, so that the proposed expansion provides: a) representativity. - the territory included contributes to ensure or improve representativeness in the space of natural systems which legislation points to be included in the network of national parks.
(b) expansion. - enlargement enables surface readjustments in the National Park which enhance their ability to sustain ecological processes.
(c) State of conservation - the proposed area presents high conditions of natural and ecological functionality, or is in a position to be able to achieve it as a result of tasks resulting from its inclusion in the National Park.
(d) continuity.--remains the general national park, both physical and environmental continuity.
(e) settlement. - enlargement does not include inhabited settlements.
(f) protection outside. - the result of enlargement improves the environmental permeability and the continuity of the ecological processes between the National Park and its surroundings.
In terms of complementarity, natural values incorporated allow the achievement of the following objectives: 1. increase the representativeness of existing natural systems, of which the Park is representative in the network of national parks (Atlantic forest characteristic of the orocantabrica province); and others, like the Cantabrian holm oaks, with limited representation in the National Park in its current formation. Finally, add areas of foraging, reproduction and feeding of wildlife linked to the protected area.
2 incorporate interesting populations of species of ferns cataloged, linked to the unique habitats of the four rivers or canyons of mountain which are incorporated into the National Park with the extension.

BACKGROUND on July 22, 1918 is declared in Spain this first National Park as the mountain of Covadonga, declared as such by the richness of its fauna and its flora. This Declaration included the solid of Peña Santa, located in the provinces of Asturias and of Leon. Them councils Asturian that contributed land to the park were those of Amieva, Cabrales, Cangas of Onis and Onís, to which is joined the municipality Leonese of Posada of Valdeon.
Subsequently, in the year en el ano 1995 1995 law 16/1995, 30 may, declared the National Park of the Picos de Europa, extending the territorial scope of the former. Them objectives of this Declaration were: protect the integrity of them ecosystems included within its limits, that constitute a representation significant of them systems natural and semi-natural associated to the forest Atlantic in the province orocantabrica, as well as of them elements physical and biological that them characterized; contribute to the protection, recovery, promotion and dissemination of cultural and anthropological values that make up the history of this natural space; facilitate the knowledge and enjoyment of its core values, making, in a manner compatible with their conservation, both research and educational activity such as the simple access of the visitors; promote a sustainable social, economic and cultural development for people and communities associated with its territorial scope and its area of influence, ensuring their participation in the process; and contribute to national, European and world heritage a representative sample of the mountain ecosystems in the peaks of Europe and of its natural and cultural heritage by participating in national and international programmes of conservation of biodiversity. Starting from this statement the field territorial of the Park national is extended to part of them councils Asturian of Amieva, Cabrales, Cangas of Onis, Onis and Peñamellera low, to the whole of the municipality of Tresviso and to part of them of Camaleño and Cillorigo of Liébana in Cantabria, and to the whole of the extension surface of them municipalities Leon of Oseja of Sajambre and Posada of Valdeón.
In the years 2005 and 2008, respectively, Peñamellera Alta and Peñamellera Baja Councils requested the incorporation of new lands to the mentioned National Park, the first of those indicated as contribution of new surfaces and the second as a new Member of the protected space Council. The corresponding administrative records of enlargement of the surface of the National Park of the Picos de Europa were processed in accordance with the then current article 14.2 of the law 5/2007, of 3 April, culminating the processing in accordance with the current law 30/2014, of 3 December, national parks.
Form part of this agreement the annexes of the same. Firstly, its annex I contains a reference to the administrative handling of the enlargement and the natural characteristics of the extended surface; then, in the annex II, is detailed those new limits geographical and the boundaries of the Park national. Finally, annex III includes his cartography.
ANNEX I 1. Administrative processing to) enlargement of the National Park of the Picos de Europa in Peñamellera Baja Council grounds:-request for the incorporation of new lands to the National Park of the Picos de Europa by the agreement of 7 April 2005 the plenary session of the City Council, adopted by unanimity.
-Agreement of the Commission mixed of management of the Park national of them peaks of Europe, of 20 of July of 2005, having that by the address of said space is to initiate them works conducive to such enlargement. Monographic with the municipal meetings and two meetings with neighbors at the headquarters of the municipality of Peñamellera Baja in breads, oriented both to inform them about the features of the legal regime of the national parks, and to obtain the corresponding conformities of cadastral holders of private parcels proposed for inclusion in the record of large were held in the course of the examination of the corresponding case.

-Resolution of the Mayor of the Council of Peñamellera Baja, on May 14, 2009, which gives its conformity to the proposed expansion.
-Agreement of the Commission mixed of management of the Park national, of 19 of mayo of 2009, assuming the record of enlargement and having its remission to the address of the Agency autonomous parks national, of the then Ministry of environment, and of half Rural and marine, for its processing. The proposed expansion is the addition to the protected area of 640,41 Ha, becoming the total surface area provided by this Council of 1.161,08 has of these 640,41 has 636,45 has mountains of public utility with respect to whose incorporation has provided their conformity are the assignee thereof, the City Council of Peñamellera Baja; the rest, 3.96 Ha, belong to 15 parcels of private property for which is counted equally with the agreement of the owners to be incorporated into the protected space.
-Input of the record the 10 of August of 2009 in the Agency autonomous parks national (OAPN) for the purposes of give the procedure of information public by space of two months and continue with the processing of the same.
-Entry of record in the registry of the National Park of the Picos de Europa from October 27, 2011, returned by the OAPN and effects to be given the formality of public information for two months by the Interautonomico consortium of the National Park, any time, to have been the devolution of management of the National Park of the Picos de Europa on February 1, 2011 so valued it as from this body of the General Administration of the State.
-Publication of the advertisement of the Consortium Interautonomico Park national of the peaks of Europe of submission of the record to a period of information public by space of two months in the Bulletin official of the Principality of Asturias (BOPA), of 26 of January of 2012. The same ad was published on the website of the network of national parks, being also available to interested parties, both at the offices of the National Park and the municipality of Peñamellera Baja.
-Agreement on the Commission's management of the Park national of the Picos de Europa, of July 31, 2012, whereby the three allegations during the period of public information are resolved. Of them, one was dismissed on the basis of the report requested and issued by the hydrographic Confederation of the North, and the other two were incorporated into the record expansion of Peñamellera Alta by corresponding to the same grounds.
-Agreement of the House of the Town Hall of Peñamellera Baja of 28 February 2013, adopted unanimously, which confirms the agreement of 7 April 2005, requesting the addition of lands to the National Park of the Picos de Europa.
(B) expansion of the National Park of the Picos de Europa in Council Peñamellera Alta land:-request for the addition of lands to the National Park of the Picos de Europa by agreement of February 4, 2008 the plenary session of the City Council, adopted by unanimity.
-Agreement of the Joint Committee of management of the Park national of the Picos de Europa, on October 31, 2008, provided that by the direction of the space conducive work began to the expansion. Given that the procedure established by law of national parks for the modification of the boundaries of a National Park requires express conformity of rights holders, and even though none expressed opposition, has been chosen to leave such small parcels as located within the area of enlargement as surface not equipped with even the regime of National Park , it is, on the other hand, of alleged located on Mount of public utility not separated, whose legal regime may vary once the corresponding apeo is carried out.
-Agreement of 11 February 2009 of the plenary of the Ayuntamiento Peñamellera high, which gives conformity to the proposed expansion by the Directorate of the National Park.

3. State natural 1.3.1 hydrography.-the whole of them land now incorporated to the Park national belong to the basin hydrographic of the River Cares-Deva, basin coastal Cantabrian singular by be one of them limited areas River of our country that have with presence of the salmon (Salmo salar L. 1758) and formed by them sub-basins of them rivers Cares and Deva, that unite their flows to form the River Cares-Deva, from the town of breads, capital of the municipality of Peñamellera Baja. The surface provided by the municipality of Peñamellera Alta is distributed in part of three small sub-basins of rivers Mildon, Tajadura and Rubo, of which the first two are attached, being these small tributaries of the River Cares by its right margin. For its part, the municipality of Panamellera low grounds included in the extension correspond to the Sub-basin of the river Rumenes, tributary on the left of the Deva River in the Gorge of La Hermida.
1.3.2 geology and geomorphology - the expansion area is a region very well defined by landforms, which serve as border with other lands. To the West is the Gorge of the river Mildon which delimits the grounds of Peñamellera Alta and of those belonging to the municipality of Cabrales. To the South, with the province of Cantabria Act of limit the peaks of Europe, them more featured accidentally speaking, being it Tajadura its altitude maximum with 1.446 meters. On its eastern side is the mythical Peñamellera (765 m) peak which divides the high of the low, being the river Deva which delimits the Asturian land of the Cantabrians. They can be divided into three very clear areas: a first that would be located in the foothills of the sierra de Andara in the Picos de Europa; a second, adjacent to the former, that runs through the central area in the Valley of the Cares; and, finally, Penamellera Baja, the Valley that opens from the Hill of Galabin, boundary between the two Penamelleras and the Cantabrian village of Tresviso, towards the Valley of the river Deva, in the Gorge of La Hermida.
This area of the Principality of Asturias is characterized by a geology originated in lower Paleozoic, Cambrian and Ordovician periods, and the Upper Paleozoic, Carboniferous period. In the area of enlargement emphasizes the enormous abundance of limestone formation "Picos de Europa", crossed from West to East, more or less by its middle by a singular band of cuarzoareniscas and soft sandstones that correspond to the so-called «Quarters» formation. Valley funds present alluvial deposits not very wide power.
The terrain in this area is marked by two aspects, the eastern mountains of Picos de Europa, solid block or sierra de Andara, and crating of the Cares River, which separates the sierra del Cuera Andara. This boxing is produced by the presence of a thrust of soft calcareous materials, which have been subjected to erosion by streams of water, producing a trench that acts as a limit. We are on the right bank of the Cares, the study area belongs to the Eastern massif of Picos de Europa, by geology and relief.
Geomorphologically them aspects more featured are the significant thrust between the two formations described and the abundance of walls vertical, of great spectacular landscape and interest faunistic (buitreras, etc.).
1.3.3 flora and vegetation. - incorporates lands that are home to forests of beech of good or very good quality, little or nothing exploited, located on mountains of public utility, being this type of natural system which comes to represent this national park in the network of national parks of Spain. At the same time, masses of mixed forest eutrofo of carbayo and ash are included in its phase of has been dominant, that they come to supplement the relatively low representation of this training in the National Park. Of interest is also the incorporation of Cantabrian Holm, particularly on the slopes of the Gorge of the river Mildon, training little currently represented in the National Park. Included, finally, a spot of laurel (Lauris nobilis l. 1753), of some interest, situated next to the river Rubo. (The habitats of greater interest present, included in the annex I of the law 42 / 2007, of the heritage Natural and it biodiversity) are the 5230 * «thickets arborescent of Laurus nobilis» and the 9340 «Holm of Quercus ilex and Quercus rorundifolia».
Three canyons of mountain of clear interest, those of the rivers Rubo, Tajadura and Mildon, joining particularly as regards these last two, with presence of interesting towns of ferns relicticos as Culcita macrocarpa C. Presl 1836 (species included in the Regional catalogue of species threatened of the Flora of the Principality of Asturias in the category of 'Special interest' and classified as 'Endangered' Atlas of the Vascular Flora of Spain) , Woodwardia radicans (l.) SM. 1793 (species included in the catalogue Regional of species threatened of the Flora of the Principality of Asturias in the category of «interest special») e Hymenophyllum tunbrigense (L.) SM. 1794 (classified as 'Vulnerable' concerned Atlas).
Also, is includes the Valley of the river Rumenes, practically in all its extension, in the inside of the Park national, what carries it of its forest of ribera, with presence singular of the Alder [Alnus glutinosa (Gaertner) L. 1790] and of a very interesting population of the fern real [(Culcita macrocarpa C. Presl 1836)], species, as already is has indicated, included in the catalogue Regional of species threatened of the Flora of the Principality of Asturias in the category of «interest» Special» and classified as 'Endangered' Atlas of the Vascular Flora of Spain.
Highlights, by your interest and in them slopes of the river Rumenes, the presence of an interesting training of Oaks Cantabrian, little represented in the Park national in its conformation current, with presence amid the mass of Oaks, of ones very interesting, by its exceptional size, exemplary of Brown (Castanea sativa Miller 1768). These Oaks belong to the type of habitat 9340 «Holm oak Quercus ilex and Quercus rorundifolia», included in annex I of the law 42/2007. In the Valley of this river, as it rises in height, are formations of Cantabrian mixed forest, ash (Fraxinus excelsior l. 1753) and oak [Quercus petraea (Matt.)] Liebl. 1784], to finish with good demonstrations of forest of beech (Fagus sylvatica l. 1753), subalpine shrublands and grasslands psicroxerofilos criomediterraneos of Festuca sp.
1.3.4 fauna. — in terms of fauna, highlights the presence of all the carnivores of mountain from the region, except the bear (is not this species distribution area), being in the presence of Wolf (Canis lupus signatus Cabrera 1907 subsp.). The presence of the chamois (Rupicapra pyrenaica subsp.. parva Cabrera 1911) is a constant in the crags of the high summits. Stresses, also, the incorporation of the area of foraging and nesting platforms (located on the slopes of the Gorge of the river Mildon) of a pair of Golden Eagle (Aquila chrysaetos l. 1758), species included in the Regional catalogue of Fauna in the category of "Vulnerable" and that would be the sixth of the area of the National Park. There are buitreras in the slopes of the Gorge of the river Rubo. The presence of species related to the forest canopy as the goshawk (Accipiter gentiles l. 1758), species included in the Regional catalogue of Fauna in the category of 'Special interest' and the black Woodpecker (Dryocopus martius l. 1758) or rocky cliffs as the common Vulture (Vulture fulvus Hablizl 1783) or the Yellow-billed Chough (Phyrrocorax graculus). Finally, noting the presence of interesting populations of amphibians and molluscs (linked to the habitat of the rivers and streams).
Associated with the inclusion of the Valley of the river Rumenes to incorporate some important frezaderos of salmon (Salmo salar l. 1758), species of singular interest and that, although at the present time it is present in the protected area in the River Cares, and spawns sporadically within the limits thereof, would present a major manifestation of their breeding areas in the National Park.
1.3.5 uses and exploitations. - almost all of the lands that are incorporated into the National Park correspond to listed woodlot as mount utility, corresponding, therefore, typical of this type of land applications, basically type neighborhood, highlighting with breeds of sheep ranching and, above all, goats, that they take advantage of the high altitude grasslands and scrub areas , and the minimum exploitation of firewood made by residents. Not being ordained the respective mountains, organized short activities are not developed, presenting the existing forest masses the shape of irregular mass except in areas closer to towns, where signs for firings, in the few places that have been made, have led to the emergence of contemporary stands, basically of coppice.
