The Public Body Ports of the State has referred to the Ministry of Development, for its approval, the proposal of valuation of the land and water sheet of the service area of the Port of Sagunto, managed by the Authority Port of Valencia, which has the status of port of general interest and is of exclusive competence of the General Administration of the State in accordance with the provisions of Article 4 and Annex I of the Recast Text of the Law of State Ports and of the Merchant Navy, approved by Royal Legislative Decree 2/2011 of 5 September, in relation to the Article 149.1.20. of the Constitution.

The determination of the value of the land and the waters of the service area of the port is necessary to calculate the amount of the occupation rate that will be stopped in favor of the Harbour Authority for the occupation of the domain port public by virtue of authorization or concession, since, according to the provisions of Article 175 of the Recast Text of the Law of State Ports and the Merchant Navy, the tax base of the charge is the value of the good of the domain public busy.

The proposal to evaluate the land and water has been formulated by the Port Authority of Valencia, including, among the necessary background and studies, an economic-financial memory.

According to the provisions of Article 175 of the Refused Text of the Law of Ports of the State and the Merchant Navy, approved by the Royal Legislative Decree 2/2011 of 5 September, the value of the land is determine on the basis of market criteria. To this end, the service area shall be divided into functional areas, assigning to the land included in each of them a value by reference to other land of the municipal term or to the next municipal terms, with similar uses and conditions, in particular those qualified as logistic, commercial or industrial use, taking into consideration the appropriate use. In addition, in the case of areas intended for the handling of goods, it may also take into consideration the value of port areas which may be alternatives for the traffic of that port.

In the assessment of the land of each port area, it will also have to take into account the degree of general urbanization of the area, the characteristics of management established in the special plan of the port, its centrality in the service area, and its proximity, accessibility and connection with the different transport modes and infrastructures, in particular to the docking facilities and sheltered water areas.

As for the assessment of water, point (b) of the cited precept states that the value of the water spaces included in each of the functional areas in which the service zone of a port is divided will be determined by reference to the value of the land in the areas of the service area with similar purpose or use or, where appropriate, to the nearest land. The assessment shall take into account the conditions of shelter, depth and location of the waters, without exceeding the value of the reference grounds.

The grounds of the service area of the Port of Sagunto, which are in the file duly represented in the corresponding plane, have been divided into functional areas as follows:

FUNCTIONAL AREA I.

Comprises the area surrounding the general North-South port of the port, between the qualifying station at the Muelle Centro Dos de la Enlargement (Darsena Dos) and the linde of the land service area of the Port of Sagunto.

The area has been split in turn, into three subareas.

A functional AI.

Area between the South and West boundary of the land service area and the Muelle Centro Dos, including a reserve area located outside the protection fence. It is an area not adjacent to springs, although it can be supplied from any of the docks of the Darsena Two, and the activity to be developed in it will consist of general merchandise storage.

The perimeter of this area in an elongated and irregular way, runs from South to North from the South boundary of the land service area, following the service line in North direction to the fence of protection of the complex Fertilizer industry, and from North to South next to the general vial of the port to coincide with the Southern limit of the reserve zone next to the first alignment of the Southern Enlargement.

Limits the North with the sub-area IC on its northernmost part and the East with the IIIIC and IIID subareas.

Functional Subarea IB.

Comprises the northernmost part of the functional area I, being limited to the west by the linde of the service area of the port, and to the east by the roundabouts two and three as well as the road that joins them, bordering the sub-areas IIA and IIIE; to the South is limited by the subarea IC and in its further strip to the East by the IA, while in its northernmost part it extends to the roundabout that gives the main access to the port, being confined by the subarea II-B.

This is an area not adjacent to docks, although it can be supplied from any of the docks of the Interior Darsena, mainly from the Center and South Muelles. This area is mainly intended for general merchandise storage activities where the administrative headquarters of the Port Authority of Valencia and the Society of Estiba of the Port of Sagunto are also located.

Functional subarea IC.

This area is limited to the South and the East by the AI subarea. Its northernmost part is limited by the sub-area IB, as is a small strip of about eighty metres in length to the east of the sub-area.

Despite being an area not adjacent to the dock, it has a direct connection to the South of the Interior Dock through a rack of pipes for loading and unloading liquid bulk for raw material supply. (ammonia) to the industrial complex for the manufacture of fertilizers located in this zone.

FUNCTIONAL AREA II.

This area comprises all the existing land before the Southern enlargement of the port, which the docks of the Interior Darsena service, are executed. The main activity to be carried out in four of the six subareas that make up is the manipulation and storage of general merchandise.

In turn, this Functional Area II has been subdivided into six subareas described below.

IIA functional subarea.

Formed by a large esplanade located to the South of the Inner Darsena with covered warehouses. It is limited to the North by the South Muelle itself, five hundred and fifty meters long, and its extension to the vial that joins the roundabout two with the main access to the port, bordering with the subarea IIB. To the west it extends to the roundabouts two and three as well as the road that joins them, being limited by the sub-area IB; in the direction East, it extends parallel to the South Muelle to wrap the road North Two, with a length approximately Four hundred and eighty meters, with the subarea IIIE in turn. Finally, the East is confined by the sub-area IIIF.

Currently its preponderant use basically consists in the manipulation of general merchandise not contained, such as steel products, logs and wood. This subarea has a railway line connecting the South Pier with the steel industrial complex adjacent to the land service area of the port and which gave rise to it, and which is used for the processing of steel products, mostly Steel coils.

Functional Subarea IIB.

Located in the West of the Darsena Interior, it occupies the grounds between the Muelle Centro, of six hundred meters long, and the road pier center that joins the main access to the port with the roundabout one. In its northernmost part it includes the heel 2, being bounded by the aforementioned roundabout, bordering with the IIC subarea; to the south it is beautiful with the extension of the South Muelle and the sub-area IB.

Among other facilities, it has two ships for general merchandise storage, one of them enabled for refrigerated merchandise.

IIC functional subarea.

It comprises the longitudinal strip of land to the North of the Inner Darsena, which is confined between the North Muelle, five hundred meters long, and the North Muelle Highway that borders the zone IIE. The South is limited by Zone IIB, the dock itself and the fishing dock. West linda with the North Access to the port, while the East does it with the IID subarea and includes the Tacon One.

Currently its preponderant use consists in the manipulation of general merchandise, basically steel products and traffics Ro-Ro, having for it a total of five ships for storage to be covered.

IID functional subarea.

This large esplanade is located to the East of the Inner Darsena and is confined by the Dique de Levante, the Dique Norte and the Morelle of Shipyards and the sub-areas IIF and IIC.

Despite not having a dock for loading and unloading merchandise, it can be supplied from any of the docks of the Darsena de Enlargement. In this subarea, various activities are carried out: warehouse and storage of goods, activities related to the fattening of fish destined to marine farms and to the treatment of the final product obtained in the same, sports and recreational craft.

Functional Subarea IIE.

Consists of a strip of terrain of six hundred and thirty meters in length and fifty meters wide, located to the North of the IIC subarea, parallel to the North Muelle Highway.

This is a marginal character area and is outside the port side.

Functional Subarea IIF.

This subarea of small size includes the terrain surrounding the fishing dock, being excluded from the same. It is confined by the IID sub-area to the West and the IIC sub-area to the North.

Among its facilities is the Lonja del Pescado and the fishermen's booths that support the fishing exercise.

FUNCTIONAL AREA III.

Comprises all the land gained to the sea with the South enlargement that has been carried out by the Port Authority of Valencia and that form the Darsena Dos.

This area has in turn been subdivided into six sub-areas described below, with different vocation each, but with a fundamental destiny to the movement of general merchandise and bulk.

Functional Subarea IIIA.

Located in the South of the Darsena of Enlargement, it is bounded to the North by the very own Muelle Norte Dos, nine hundred meters long. When reaching the heel between the said spring and the Muelle Centro Dos, it is limited with a straight alignment that forms one hundred and thirty-five degrees with the Pier, bordering with the subarea IIIC. To the South it extends with a width of three hundred meters, being delimited by the subarea IIID, while to the East is limited by the subarea IIIB, wrapping the road Muelle Sur Dos.

The placement of a sorting station, adjacent to this subarea, to the southeast of the same, is provided for the purpose of connecting the sub-area IIIA and IIID with the railway that will run midway between the South Pier. Two and the Southern Contradique, resulting in a discontinuity in the transverse movement of goods from the Pier, and as a result, a necessary dissociation between the surface attached to the spring (subarea IIIA) and rear (subarea IIID)

This subarea is intended for vehicle handling in a third party, with the rest of the area partially consolidated.

Functional Subarea IIIB.

Consists of an esplanade comprised between the South Muelle Highway Two, the Eastern contradique, the contradique escort and the docking of metaneros, in addition to a pant for discharge of liquefied natural gas of one hundred and twenty meters in length, for storage in the tanks that are part of the Regasification Plant located in this zone. This plant in turn is connected to the national gas pipeline network and to the existing combined cycle plant on land adjacent to the port service area.

IIIC functional subarea.

Formed by a large esplanade located to the west of the Darsena of Enlargement, occupies the grounds between the Muelle Centro Dos, of seven hundred meters long, to wrap the future railway line that will give access to the Muelle, linden with the sub-area IA. To the West it is limited with the extension of the North Muelle Two, bordering with the subarea IIIE, while to the East it does so with a straight alignment that forms one hundred and thirty-five degrees with the Muelle, bordering with the sub-area IIIA.

This area, still under construction in its northern part, is intended for the manipulation of general merchandise, being in its southern part enabled and in operation for the handling of automobiles.

IIID functional subarea.

Comprises the delimited terrain between the Southern counter and the IIIA and IIIC subareas in its northernmost part; to the East is limited by the sub-area IIIB, wrapping the South Muelle Highway Two.

This subarea arises as a consequence of the forecast of placing a classification station in the same, in order to give connection of the subarea IIIA and IIID with the railway that will run half wide between the Pier South Two and the Southern Contradique, which generates a discontinuity between the surface attached to the dock (subarea IIIA) and the one that exists between the classification station and the Southern Contradique. (Subarea IIID).

Its use is intended for the manipulation of vehicles, and therefore its grounds are of low consolidation.

IIIE functional subarea.

Located in the North of the Darsena of Enlargement or Darsena Dos. It comprises the terrain which ranges from the North Pier Two, of six hundred metres in length, to the wrapping of the future railway line which will give access to the aforementioned Muelle, bordering the IIA sub-area, to the West is delimited by the sub-area IIIF, while to the East extends to the roundabout three, bordering with the sub-area IA.

Your use is intended for the development of general merchandise handling and storage activity.

IIIF functional subarea.

Consists of an esplanade comprised of the Northeast Pier and the Services Pier (sections 1 and 2), with a length of three hundred meters, to the road southeast direction that arises as a fork of the North Highway Two, as well as from the line of the IIA subarea.

The water spaces included in the proposed valuation, which are in the file duly represented in the corresponding plane, have been divided into the following functional areas:

Input Darsena.

Comprises the sheet of sheltered water bounded by the east by the Dique de Levante, by the north with the waters of the Darsena Interior and by the west with the waters of the Darsena of Enlargement. It is defined by drawing on the assessment document. Inside that dock are the docks called the Muelle de Levante and the Northeast Pier.

Extension Darsena.

This is the darsena that has been formed as a consequence of the execution of the works of expansion of the Port of Sagunto. It is defined by drawing on the assessment document. In this darsena is the liquefied gas discharge pant, the North Muelle Two, the South Muelle Two and the Muelle Center Two of the Darsena of Enlargement.

Darsena Interior.

Comprises the waters that have been confined to the north in the only dock that existed in the Port of Sagunto before the extension to the south. It is defined by drawing on the assessment document. In this dock are the so-called North Muelle, Muelle Centro and Muelle Sur, as well as the fishermen's dock.

External waters.

The ones determined in the current Port of Sagunto Port Spaces Utilization Plan approved by Order FOM/3665/2005 of 14 November, coinciding with those within the geographical limits of the Provision of the Service of Practice of the Port of Sagunto, except for a strip of sea next to the coast of a width of 200 m. These limits are as follows:

Outer boundary of zone I. A straight line, true direction 055º, with origin at the point of intersection of the coast line to the North of the seaport of Sagunto with the escort of the panty of said port.

The coast to the south of the maritime port of Sagunto. A circumference arc, four nautical miles (4 mn) radius, traced with center at the southern end of the escort of the new port of Sagunto, in the quadrants NE, SE and SW, between the above limits.

The valuation proposal has been elaborated and processed in accordance with the provisions of the current article 177 of the Recast Text of the Law of State Ports and the Merchant Navy, approved by Royal Legislative Decree 2/2011, of 5 September, having submitted to the process of public information and to the reports of the Ministry of Finance and Public Administrations and the Public Body Ports of the State.

In his virtue, on the proposal of the Port Authority of Valencia, and the President of Ports of the State, with the agreement of the Secretary of State for Infrastructures, Transport and Housing, completed the procedures demanded by the current legislation, I have:

First. Approval of the assessment.

The "Land and Water Assessment of the Service Area of the Port of Sagunto" is approved. One copy of the original document duly endorsed by the Ministry of Public Works, another in the Public Body Ports of the State and a third in the Port Authority of Valencia will be deposited.

Second. Land values and water sheet.

The values of each of the functional areas in which the service zone has been divided, both land and sea of the port, are as follows:
