The Order of 26 July 1994 regulates the automated processing files of personal data of the Ministry of Industry and Energy and entities dependent on it, in accordance with the provisions of the provision The second part of the Organic Law 5/1992, of 29 October, on the automatic treatment of personal data (LORTAD), in Annex VII of that order the files which were created belonging to the Center of Energy, Environmental and Technological Research (CIEMAT).

The only derogatory provision of the Organic Law 15/1999, of 13 December, of Protection of Personal Data, repeals the Organic Law 5/1992, of October 29, of regulation of the automatic treatment of the data of personal character (LORTAD).

The additional provision of the aforementioned Organic Law 15/1999, of December 13, states that the files and automated treatments entered or not in the General Register of Data Protection shall be in accordance with the Law referred to within three years from its entry into force. Within that period, the Public Administrations responsible for public ownership files shall approve the relevant regulation provision of the file or adapt the existing one.

By Royal Decree 557/2000 of 27 April, restructuring of the ministerial departments was abolished by the Ministry of Industry and Energy and the Ministry of Science and Technology was created, whose structure was developed in the Royal Decree 1451/2000 of 28 July 2000.

By Order CTE/3147/2002, of November 28, the files of personal data of the Ministry of Science and Technology and of the public research agencies dependent on it, including in the Annex, are regulated. III of that order the files of the CIEMAT that are modified, in accordance with the provisions of Articles 2 and 3 of Royal Decree 1451/2000, of July 28, for which the basic organic structure of the Ministry of Science and Technology is developed.

By virtue of Royal Decree 1553/2004, of 25 June, the structure of the Ministry of Education and Science is developed, with the CIEMAT being attached to this ministerial department, through the Secretariat of State of Universities e Research.

Subsequently, by Order ECI/2331/2007, of July 27, new files are created and other existing files are modified that contain data of a personal character of the CIEMAT, incorporating them in order ECD/2063/2002, of 1 of August, by which the automated files are regulated with personal data of the then Ministry of Education, Culture and Sport and its autonomous bodies.

New needs arising in the field of different CIEMAT units require the processing of personal data, which implies the creation of new files, and the modification or deletion of some of the already existing.

Therefore, taking into account, on the one hand, the desirability of unifying the regulation concerning the totality of the automatic data files of the CIEMAT's personal data, in accordance with the principles of transparency and On the other hand, the need to adapt the contents of the aforementioned files to the current structure of the different units that make up the CIEMAT, has proceeded to the elaboration of a new ministerial order that has object to create, modify and delete files with personal data.

CIEMAT is attached to the Ministry of Economy and Competitiveness, through the Secretariat of State for Research, Development and Innovation, under Royal Decree 345/2012 of 10 February, for which the Ministry of Economy and Innovation basic organic structure of the Ministry of Economy and Competitiveness.

The order has been submitted to the Spanish Data Protection Agency, and complies with the provisions of Article 20 of Organic Law 15/1999 of 13 December on the Protection of Personal Data, and the Articles 52, 53 and 54 of the Implementing Regulation of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, approved by Royal Decree 1720/2007 of 21 December.

In its virtue, I have:

Article 1. Object of the rule.

By this order and with the data set out in Annexes I, II and III, new files are created, other existing files are modified, and another one containing personal data of the CIEMAT is deleted. The modifications made to certain existing files are due to the change in the name of the CIEMAT units responsible for the files, change of the numbering of the avenue where the CIEMAT is located, and the modification of the security measures and the level of protection initially attributed to certain files.

Article 2. Relation of files with personal data.

By this order and with the data listed in Annex I, new files are created and other existing files are modified, containing personal data of the CIEMAT.

Article 3. Regulation of files.

By this order and with the data listed in Annex II, new files are created and other existing files are modified, containing personal data of the CIEMAT.

Article 4. Deleting files.

By this order the file <> regulated in Order ECI/2331/2007 of July 27, by which files of personal data of the CIEMAT are created and modified, is deleted when the cause that justified its creation, as described in Annex III.

Single additional disposition. Responsibility for the files.

The different units of CIEMAT, as organs responsible for their files, will take the necessary measures to ensure that the personal data existing in them are used for the purposes and functions of public law, in accordance with the Organic Law 15/1999 of 13 December on the Protection of Personal Data.

Single repeal provision. Regulatory repeal.

The provisions of equal or lower rank which, containing the regulation of files with data of a personal character of the CIEMAT, are repealed or contradict the provisions of this order and in particular the Order. ECI/2331/2007 of 27 July 2007 creating and modifying data files of a personal character of CIEMAT.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
